The following have been modified:

52.212-1 ADDENDUM

The Government intends to award a Firm-Fixed-Price (FFP) contract as a result of this solicitation in accordance with FAR Part 13.5.

The procedures of FAR 15.3 do not apply to this source selection. While not an all-inclusive list, some examples of FAR 15.3 requirements that do not apply are the competitive range determinations, the FAR 15.3 rules for discussions, format evaluation plans, and formal evaluation documentation.

Award will be made to the quoter whose quote is most advantageous to the Government under the selection criteria set forth in this solicitation. The Government intends to evaluate quotes and award a contract based on initial quotes.

Therefore, the quoter’s initial quote should contain the quoter’s best terms from a Staffing Approach, Past Performance, and Price standpoint. The Government may contact any or all of the quoters with questions concerning their quotes. The Government reserves the right to award a FFP contract to other than the lowest priced quote; award a FFP contract without exchanges; or award a FFP contract after exchanges, whichever is in the best interest of the Government.

QUESTIONS:

Quoters may submit questions regarding clarification of solicitation requirements directly to the Contract Specialist via email at Larissa.v.benoit.civ@us.navy.mil. It is requested that all questions be received no later than three (3) days after the solicitation posting. Time may not permit responses to questions received after that date to be prepared and issued prior to the receipt of quotes. The Government reserves the right to not answer questions after the deadline.

INSTRUCTIONS FOR SUBMISSIONS OF QUOTES:

(1) All submission and attachments shall be in Microsoft Office Word or Adobe pdf. The Price Quote may include a Microsoft Excel submission. Submissions are page limited to the maximum number of pages, as defined below.

These page limitations are inclusive of the executive summary and any charts, diagrams, and/or other graphics.

Graphics (including tables) in the quote may use an alternative font with 8-point size type or larger. Each “page” is defined as one sheet, 8 ½” x 11”, with at least one-inch margins on all sides, using a font with a point size of 12 or greater (e.g. Times New Roman” style with 12-point font). Lines shall, at a minimum, be selected as single-spaced in Microsoft Word with Microsoft Word Normal character spacing. Pages shall be consecutively numbered.

Multiple pages, double pages, two-sided pages, or foldout will count as an equivalent number of 8 ½” x 11” pages.

The quoter is permitted to submit no more than one page for each of the following, which will not be included in the page count: a cover sheet, list of tables, list of figures, compliance matrix, table of contents, tabs and dividers.

Pages submitted in excess of the page limitations described within will not be evaluated.

GENERAL:

Quotes shall include the following legend on each page:

The quote should contain the following items in addition to other information required by this solicitation.

2. Quoters are strongly encouraged to confirm their quote was received PRIOR to the closing date and time. It is the responsibility of the quoters to ensure that the Contracting Office has received their entire quote, with all attachments, PRIOR to the solicitation closing date and time. Only the documents received prior to the solicitation closing date and time will be evaluated.

Volume I: Factor I – Security Clearance

The quoter shall provide proof/verification that it possesses a current Secret Facility clearance at time of quote submission as identified in the PWS.

The proof/verification shall be in the form of Defense Security Service verification certifying it possesses a current Secret Facility Clearance against the vendor’s CAGE code, and shall include the following:

a) Cage Code,

b) Facility Name,

c) Physical Location,

d) Facility Clearance Status/Level,

e) Status Date/Issue Date,

f) Safeguarding Level,

g) Authorized Access To,

h) FCL Limitation,

i) Facility Security Officer,

j) Facility Security Officer Phone Number,

k) DSS Field Office, and

l) DSS Field Office Phone Number.

2. All proposed personnel for the contract shall possess a SECRET clearance.

Volume II: Factor II – Staffing Approach

It is anticipated that the following key personnel will be required to perform the contract:

a) Photographer V/Program Manager

b) Photographer IV

c) Illustrator III

The quoter shall provide a staffing approach that demonstrates its understanding of and capability to meet the requirements in accordance to the Performance Work Statement (PWS).

The quoter shall demonstrate the ability to provide, recruit, and retain personnel with the experience, certifications, and other qualifications needed to successfully perform the requirements of the solicitation including the PWS starting on the first day of the period of performance.

The quoter shall provide resumes in Volume II for all proposed personnel and for sufficient personnel to successfully perform the requirements of the solicitation including the PWS starting on the first day of the period of performance. Each resume is limited to two (2) pages **

By submitting a quote, the quoter represents and certifies that all individuals proposed for a specific labor category meet the education, specialized experience, general experience, certifications, and other qualifications required in the solicitation for that labor category. If the quoter does not currently employ a person, the quoter shall submit a letter of intent from the potential employee to work for the vendor in Volume II.

Factor III – Past Performance

To demonstrate its past performance, the quoter shall identify up to three (3) of its most relevant contracts performed within five (5) years of the solicitation closing date. Those contracts must also reflect one (1) year of completed performance by the closing date of the solicitation. The quoter shall provide a detailed explanation demonstrating the relevance of the contracts to the requirements of the solicitation. Quoters may submit a maximum of three (3) references.

For purposes of the past performance factor of this solicitation, a contract is defined as (i) a single contract that is not an indefinite-delivery/indefinite-quantity (IDIQ) contract, a blanket purchase agreement (BPA), or a Federal Supply Schedule (FSS) contract (also known as a GSA Schedule contract), (ii) a single delivery order (DO), task order (TO), technical direction letter (TDL), or technical area task (TAT) issued under an IDIQ contract, a BPA, or an FSS contract, or (iii) a combination of no more than three (3) DOs, TOs, TDLs, and/or TATs issued under an IDIQ contract, BPA, or FSS contract. Offerors shall not submit an IDIQ contract, BPA, or FSS contract as a reference.

Quoters may submit a maximum of three (3) DOs, TOs, TDLs, and/or TATs issued under an IDIQ contract, BPA, or FSS contract as one of the examples of past performance. Such a combination must also meet the requirements stated above: each individual example in the combination must have been performed within three (3) years of the solicitation closing date and demonstrate at least one (1) year of completed performance by the solicitation closing date. If a combination of DOs, TOs, TDLs, and/or TATs is used as a past performance example, the offeror shall state the specific experience claimed, period of performance, and dollar value of each. A past performance example that does not provide the level of detail required may not be evaluated. Only one combination of DOs, TOs, TDLs, and/or TATs is permitted in the past performance submission.

If a proposed subcontractor’s past performance is provided as an example of past performance, the percentage and type of work to be done by the proposed subcontractor on the solicitation requirement must be stated. A past performance example that does not detail clearly the percentage and types of work in the solicitation that the subcontractor is proposed to perform may not be evaluated.

If a past performance example in which the quoter or a proposed subcontractor served as a subcontractor is submitted, the past performance submission shall detail clearly the work that the offeror or proposed subcontractor performed and the magnitude (dollar value) of only that work. A past performance example that does not differentiate between the overall contract effort and the subcontractor effort may not be evaluated.

The past performance of proposed subcontractors that will be performing major or critical aspects of the solicitation will be considered as highly as the offeror’s past performance.

Failure of quoters to provide the required information and level of specificity may result in the past performance example not being evaluated.

Regarding joint ventures, work done individually by a member of the joint venture and work done by the joint venture itself will be considered. Joint venture references must meet the requirements stated above: they must have been performed within three (3) years of the solicitation closing date and demonstrate at least one (1) year of completed performance by the solicitation closing date. Additionally, if a joint venture member submits a past performance reference, the joint venture member shall detail clearly the work that it performed and the magnitude (dollar value) of only that work. A reference that does not differentiate between the overall contract effort and the joint venture member’s effort may not be evaluated. The past performance of a joint venture member that will be performing major or critical aspects of the solicitation will be considered as highly as the joint venture’s past performance.

The quoter shall complete a “Past Performance Information Form” for each reference submitted and shall include the completed form in Volume III. The form is an attachment to the solicitation. The forms will count toward the Volume III page limit described above.

For each contract submitted, quoters shall include relevant contract documentation, such as the contract and the PWS, substantiating the work performed. This contract documentation will not count against Volume III page limitation. Unless discussions are held, failure to submit such substantiating documentation will result in that contract not being evaluated.

In addition to the information requested above, quoters shall contact their past performance references and request that each reference complete the “Past Performance Report Form” also attached to the solicitation and email the completed survey form directly to Larissa Benoit at Larissa.v.benoit.civ@us.navy.mil by the CLOSING DATE/DUE DATE OF THIS SOLICITATION. The Government reserves the right to consider Past Performance Report Forms received after the due date of the solicitation and to contact references for verification or additional information.

The Past Performance submission is limited to 5 pages per reference, including the Past Performance Information Form for the reference**

Factor III – Price

Quoters shall provide completed RFQ documents and additional supporting documentation as described below:

a. A complete and signed Standard Form 1449, “Solicitation/Contract/Order for Commercial Items” and executed copy of any and all amendments (if applicable);

b. Unless completed in System for Award Management (SAM) website (https://www.sam.gov), the quoter shall complete the representations and certifications contained in the solicitation. If the vendor has completed all of the representations and certifications required by this solicitation in the SAM, then the vendor need not submit the hardcopy version of those documentation.

c. In the event any portion of the quote is written by anyone who is not a bona-fide employee of the firm submitting the quote, a certificate to this effect shall be furnished, which a responsible officer of the quoter shall sign. It shall also identify the person’s name, employment capacity, the name of the person’s firm, the relationship of that firm to the quoter, and the portion of the quote the person wrote.

D. Quoters responding to this solicitation are advised that, prior to award, the Government may request the submission of additional information/data to support price reasonableness such as copies of paid invoices for the same or similar items, sales history for the same or similar items, price lists with effective date and/or copies of catalog pages along with any applicable discounts etc. Failure to submit the requested information may result in disqualification of the submitted quote.

e. A completed and signed page 1 of the most current version of the RFQ and any amendments, as applicable;

f. For the purposes of the quote, all labor rates should be proposed at the Government site (Submarine Base New London, CT) covered by Wage Determination 2015-4111;

g. The quote shall be valid for 120 calendar days from RFQ closing date unless another time is specified in an amendment to the solicitation;

h. Oral communications are not acceptable in response to this notice. All responsible sources may submit a quote, which shall be considered by the agency.

The completion and submission of the above items will constitute a quote and will indicate the quoter’s unconditional assent to the terms and conditions of this RFQ and any attachments and/or exhibits hereto. Quoters objecting or taking exception to the terms and conditions of the RFQ may be determined to be ineligible for award.

All price and price supporting information shall be contained in the price quote. Quoters are responsible for submitting sufficient information to enable the Government to fully evaluate their price quote.

52.212-2 ADDENDUM

The Government intends to award a Firm-Fixed-Price (FFP) contract as a result of this solicitation in accordance with FAR 13.5. Award will be made to the responsible quoter whose quote is most advantageous to the Government under the selection criteria set forth in this solicitation.

The Government intends to evaluate quotes and award based on initial offers. Accordingly, the quoter should submit its most favorable terms from a facility clearance, staffing approach, past performance and price standpoint. All vendors shall already have, at a minimum, an active Secret Facility clearance at time of solicitation. Staffing approach is more important than Past Performance and when combined, are more important than Price. The Government reserves the right to award a FFP contract to other than the lowest priced quoter, award a FFP contract without exchanges or conduct exchanges if later determined by the PCO to be necessary and in the best interest of the Government.

The evaluation of quotes will be conducted as follows: Initially, the quotes will be ranked according to price, from lowest to highest.

The Government will evaluate the lowest priced quoter first. Quoters who receive an “Unacceptable” rating for the Facility Clearance will no longer be considered for award and no further evaluation will be conducted. If the lowest price quoter is evaluated to have a Facility Clearance rating of “Acceptable”, the evaluation will proceed to Factor II

– Staffing Approach.

If the lowest price quote is evaluated to have a staffing approach rating of “Acceptable” but not an overall Past Performance Confidence Assessment rating of “Substantial confidence” assessment rating, the next lowest priced quoter will be evaluated.

The evaluation process will continue (in order of price from lowest to highest) until a quote is evaluated to have an “Acceptable” staffing approach rating and “Substantial Confidence” Past Performance Confidence Assessment rating. At that time, the quoter’s price will be evaluated for price reasonableness. If the pricing is found fair and reasonable, award shall be made to that quoter without further consideration of any other quoters. If it is determined that the price is not fair and reasonable, an integrated assessment best value award decision shall be made among all lower priced awardable quotes. If no quotes are rated with a Past Performance rating of “Substantial Confidence”, the Contracting Officer shall make an integrated assessment best value award decision from among the awardable quoters.

All quotes will be reviewed for timeliness. Timely quotes will also be reviewed for compliance to the solicitation. If the quote is not compliant with the material terms of the solicitation, it may not be evaluated and the quoter will be notified that the quote is non-responsive.

1. Non-Price Quote Evaluation Criteria

The Non-Price quote is comprised of the following factors:

Factor I: Facility Clearance

Factor I will be evaluated on a “Acceptable/Unacceptable” basis on whether the quoter has, at a minimum, a Secret Facility Clearance, as shown below.

Quoters receiving an “Unacceptable” rating for the Facility Clearance will no longer be considered for award and no further evaluation will be conducted.

Factor II: Staffing Approach

Factor II will be evaluated on an “Acceptable/Unacceptable” basis on whether the quoter meets the PWS requirements of the solicitation. This factor will be evaluated utilizing the ratings below.

Rating Description Acceptable The quoter a) demonstrated the ability to provide, recruit and retain personnel with the experience, certifications, and other qualifications needed to successfully perform the requirements of the solicitation including the Performance Work Statement (PWS) starting on the first day of the period of performance.; b) provided resumes for all proposed personnel and for sufficient personnel to successfully perform the requirements of the solicitation including the PWS starting on the first day of the period of performance; and c) provided a letter of intent to work for the quoter from each potential employee not currently employed by quoter.

Unacceptable The quoter has not a) demonstrated the ability to provide, recruit and retain personnel with the experience, certifications, and other qualifications needed to successfully perform the requirements of the solicitation including the Performance Work Statement (PWS) starting on the first day of the period of performance.; b) provided resumes for all proposed personnel and for sufficient personnel to successfully perform the requirements of the solicitation including the PWS starting on the first day of the period of performance; and c) provided a letter of intent to work for the quoter from each potential employee not currently employed by quoter.

Quoters receiving an “Unacceptable” rating for the Staffing Approach will no longer be considered for award and no further evaluation will be conducted.

A rating of “Unacceptable” means that the quote is not awardable and is not susceptible to correction without what would be tantamount to the submission of an entirely new quote.

Quoters simply providing general statements or paraphrasing/parroting the PWS in whole or in any part may result in a rating of “Unacceptable”.

Factor III: Past Performance

The past performance evaluation factor assesses the degree of confidence the Government has in an quoter’s ability to meet the contract’s requirements based on the quality of a demonstrated record of recent and relevant performance. There are three aspects to the past performance evaluation: recency, relevancy, and quality. These are combined to establish a single performance confidence assessment rating for each quoter.

Past Performance Recency: Recency is the first aspect of the past performance evaluation and is the time period during which past performance references are considered relevant. Recency is critical to establishing the relevancy of past performance information. For purposes of this solicitation, recent past performance is within the past five years prior to the solicitation issuance date. Performance outside of this stated period will not be considered for evaluation purposes.

Past Performance Relevancy: Regarding relevancy, each past performance reference under the quoter’s Past Performance submission will be evaluated to determine its individual scope and magnitude relative to the instant requirement. The following definitions apply to this evaluation:

Scope: Experience in the areas described in the PWS.

Magnitude: The similarity of the dollar value of actually performed work that exists between the instant requirement’s PWS and the quoter’s referenced contracts during the stated period established by the solicitation.

The relevancy rating assigned from the below Past Performance Relevancy Descriptions will be considered in determining the weight to be given to that reference in the overall Past Performance Confidence Assessment.

References determined to be “Not Relevant” will not be further considered. Similarly, in determining the rating for the past performance factor, past performance of greater relevancy will have more influence on the past performance confidence assessment than past performance of lesser relevance.

Past Performance Relevancy Descriptions Table

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort this solicitation requires.

Past Performance Quality: The third aspect of the past performance evaluation is to establish the overall quality of the quoter’s past performance. The Government will review all past performance information collected and determine the quality of the quoter’s performance, including general trends and usefulness of the information, and will incorporated this into the performance confidence assessment. The quality of performance under a past performance reference that has no relevance to the instant requirement will not be considered in the overall assessment of past performance confidence.

In order to evaluate Past Performance, the Government may also utilize existing data sources, including the Contractor Performance Assessment Reporting System (CPARS), the Federal Awardee Performance and Integrity Information System (FAPIIS), the Electronic Subcontract Reporting System (eSRS), or other databases;

communication with points of contact in the quoter’s customer’s organization, which could include private sector requirements and contracts personnel, Administrative Contracting Officers, Defense Contract Management Agency (DCMA) personnel, Procuring Contracting Officers, Contracting Officer’s Representatives, and other Government activity requirements personnel. The Government may verify past performance information. The Government may contact some or all of the references provided, as appropriate, and may collect information through questionnaires, telephone interviews, and existing data sources. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources, including sources outside of the Government. This information will be used for the evaluation of past performance.

Past Performance Confidence Assessment: The overall assigned rating for past performance will be the Past Performance Confidence Assessment rating, defined in the table below. The assignment of this rating will be based on the overall quality of the aggregated recent and relevant past performance and will consider the source of the information, the context of the data, and general trends in the quoter’s performance. Evaluation will focus only on work already performed. Work yet-to-be performed will not be considered.

If the quoter’s aggregated past performance is determined to be not relevant as defined in the solicitation, then the quality of the quoter’s past performance will not be evaluated through a confidence assessment and past performance factor will be rated as “Neutral Confidence”. If a quoter’s aggregate past performance is determined to be relevant, then each past performance reference under the quoter’s past performance submission that contributed to the determination of aggregate relevance (i.e., each reference that is rate at least somewhat relevant) will be evaluated to determine the quality of the quoter’s performance under that reference. The quality of performance on contract references that are rated not relevant is not evaluated even when the overall past performance is found to be relevant.

In the case of quoters for which there is no information on past contract performance or where past contract performance information is not available, the quoter may not be evaluated favorably or unfavorably on the past performance factor. In this case, the quoter’s past performance is unknown and assigned a performance confidence rating of “Neutral Confidence”. Although an quoter that lacks recent, relevant past performance may not be rated favorably or unfavorably with regard to past performance, the Government may determine that a “Substantial Confidence” or “Satisfactory Confidence” past performance rating provides better value to the Government than a “Neutral Confidence” past performance rating.

The past performance factor evaluation and past performance confidence assessment rating is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the quoter’s past performance will be used as a means of evaluating the relative capability of the quoter and other competitors to successfully meet the requirements of the solicitation.

Satisfactory Confidence Based on the quoter’s recent/relevant performance record, the Government has a reasonable expectation that the quoter will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the quoter’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The quoter may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the quoter’s recent/relevant performance record, the Government has a low expectation that the quoter will successfully perform the required effort.

No Confidence Based on the quoter’s recent/relevant performance record, the Government has no expectation that the quoter will be able to successfully perform the required effort.

Factor IV: Price Quote Evaluation Criteria

The quoter’s quoted price will be evaluated based on price reasonableness. The evaluation may include, but is not limited to, price comparison with other quoters and comparison with Independent Government Estimates (IGE).

Quoters responding to this solicitation are advised that, prior to award, the Government may request quoters to submit additional information or data to support price reasonableness, such as copies of paid invoices for the same or similar items, sales history for the same or similar items, price lists with effective date and/or copies of catalog pages along with any applicable discounts. Failure to submit the requested information may result in disqualification of the submitted quotation.

The Government may evaluate any and all information submitted by the quoter to support the price reasonableness of prices quoted. The method of evaluation used by the Contracting Officer is solely within the discretion of the Contracting Officer. The Government may conduct a price realism analysis on quotes received and may reject a quote for unrealistic prices.

Although price is not the most important evaluation factor, it has the potential to become more significant during the evaluation process. The degree of importance of price will increase with the degree of equality of the quotes in relation to the other factors on which selection is to be based. The importance of price will also increase when a quote’s price is so significantly high as to diminish the value to the Government that might be gained under the other aspects of the quote. If, at any stage of the evaluation, all quoters are determined to have submitted equal, or virtually equal, non-price quotes, price could become the factor in determining which quoter shall receive the award.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor I – Facility Clearance Factor II – Staffing Approach Factor III – Past Performance Factor IV - Price

Staffing Approach is more important than price, but, when combined, are more important than price.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
