Staffing Approach

We suggest the Government require Letters of Intent for all key personnel regardless of their employment status with the proposing contractor or remove the requirement. Requiring Letters of Intent for only some bidders provides the incumbent company's Prime Contracting partner with an unfair competitive advantage and does not negate any risk of personnel leaving their employer before award.

Decline to make this change, incumbent is not eligible for an award under this procurement.

Volume 1: Non-Price Proposal Evaluation

Criteria

Factor I: Facilities Clearance

The Facility Clearance verification provided via the Defense Counterintelligence and Security Agency’s (DCSA) National Industrial Security System (NISS) is marked as Controlled Unclassified Information (CUI). The inclusion of this within Volume I will require our entire volume to be marked as CUI and handled accordingly. Please provide guidance on how the Government would like us to submit this CUI volume. We suggest the Government consider requiring a letter from the Facility Security Officer with all of the information contained in the instructions on page 14 in lieu of the official NISS verification.

Facility Clearance may be sent as an attachment, see amendment 0001.

7 PWS Place of Performance Page 94 Will the Government confirm that the place of performance is at the Navy Warfare Development Center, Norfolk, VA. This section states that this is the Place of Performance unless otherwise noted in specific task descriptions, however, no other places of performances or remote/hybrid options are listed in the PWS task descriptions and there are current incumbent staff working remotely/hybrid to include out of state residences not within reasonable commuting distance to NAVWARDEVCEN in Norfolk.

Navy Warfare Development Center, Norfolk, VA is the primary place of performance. Remote/Hybrid options are available but determined by eligibility and need.

8 Instructions to Offerors Ostensible

Subcontracting Risk

We request the Government adjust the Instructions to Offerors as well as the Evaluation criteria of the RFP such that it ensures no violation of the Ostensible Subcontracting Rule as defined by 13 CFR 121.103(h) for offerors. Currently, the RFP is high risk for violation of this rule, especially with the low number of staff and 50% Key Personnel designation, and presents the Government with significant risk of protest. We suggest that all Past Performance samples must belong to the Prime Contractor to demonstrate that the Prime contractor has the relevant experience and does not need to rely upon its more experienced subcontractor (the incumbent) to win the contract; require evidence that the majority of the new contract workforce will not be hired from the subcontractor; proof that the Prime contractor's proposed management including Key Personnel did not serve with the subcontractor on the incumbent contract or that the Key Personnel requirement (including LOIs) is removed altogether. These recommendations represent the SBA's Office of Hearings and Appeals four-factor test for determining when a prime contractor may be unusually reliant on a subcontractor.

9 Labor Categories Minimum Education

Requirements 96-102

Some of the labor category descriptions appear to be missing information or have conflicting requirements in the minimum education sections as follows:

•Quality Assurance Technician Desktop Specialist: “A Bachelor’s degree in Computer Science, Information Systems, Information Management, or other closely related scientific or technical discipline. With a Master’s degree (in the fields described above), five (5) years’ experience of which at least one (1) year must be specialized. With ten years of experience of which at least eight (8) years must be specialized, a degree is not required.

•Software Engineer II: “A Bachelor’s degree in Computer Science, Information Systems, Information Management, or other closely related scientific or technical discipline. With a Master’s degree (in the fields described above)” •Application Engineer II: “A Bachelor’s degree in Computer Science, Information Systems, Information Management, or other closely related scientific or technical discipline. With a Master’s degree (in the fields described above)” •Senior Domino Database Manager III: “A Bachelor’s degree in Computer Science, Information Systems, Information Management, or other closely related scientific or technical discipline. With a Master’s degree (in the fields described above), ten (10) years’ experience of which at least one (1) year must be specialized. With ten years of experience of which at least eight (8) years must be specialized, a degree is not required.”

•Telecommunications/Security Technician I: “A Bachelor’s degree in Computer Science, Information Systems, Information management, or other closely related scientific or technical discipline. With a Master’s degree (in the fields described above), five (5) years’ experience or which at least one (1) year must be specialized.”

•SharePoint Administrator II: “A Bachelor’s degree in Computer Science, Information Systems, Information Management, or other closely related scientific or technical discipline. With a Master’s degree (in the fields described above), five (5) years’ experience of which at least one (1) year must be specialized.”

•SharePoint Knowledge Manager: “A Bachelor’s degree in Computer Science, Information Systems, Information Management, or other closely related scientific or technical discipline. With a Master’s degree (in the fields described above), five (5) years’ experience of which at least one (1) year must be specialized. With ten years of experience of which at least eight (8) years must be specialized, a degree is not required.”

•Agile Scrum Master: “A Bachelor’s degree in Computer Science, Information Systems, Information Management, or other closely related scientific or technical discipline. With a Master’s degree (in the fields described above), five (5) years’ experience of which at least one (1) year must be specialized. With ten years of experience of which at least eight (8) years must be specialized, a degree is not required.”

Some LCATs have wording stating that personnel with a master’s degree need fewer years of experience while others imply that candidates need a minimum of a master’s degree. Can the government please clarify these requirements across all LCATS?

10 Is this an entirely new effort or is there an incumbent currently providing these services? If so, would you provide the incumbent contract details?

This is a follow-on procurement to N0018919F0298 where the incumbent is Nexagen Networks, Inc.

11 Is outsourcing/subcontracting the work outside the USA (i.e. performed by workers without US visas) allowed provided we sanitize sensitive data before subcontracting the work (if so required by your solicitation)?

IAW RFP "SUPTXT204-9400(4-22) CONTRACTOR UNCLASSIFIED ACCESS TO FEDERALLY CONTROLLED FACILITIES, SENSITIVE INFORMATION, INFORMATION TECHNOLOGY (IT) SYSTEMS OR PROTECTED HEALTH INFORMATION" all contractor employees must be a US citizens and IAW with the PWS performance is in Norfolk, Virginia.

12 If #11 is allowed, is our understanding correct that the provision in FAR 52.219-14 which imposes a limit on subcontracting to up to 50% of the contract value shall apply for services to be performed under the contract for which you are Contracting Officer?

13 What are some of the security clearance and auditing implications if we were to go ahead with this structure? The outsourcing destination envisioned here is Thailand specifically.

14 Would you accept a vendor with a Secret FCL at time of proposal, with the ability to obtain a Top Secret FCL?

No.

15 Could we use our subcontractor/teaming partner's facility clearance with the expectation that we would sponsor our own should we win the contract?

No, the prime awardee must possess the required facility clearance.

16 Would we be eligible for contract award, if one of the Joint Venture members has a Top-Secret Clearance?

The lead small business partner to the joint venture must possess the required facility clearance level, refer to CFR Title 13, Chapter 1, Part 121.

17 Is it necessary for the past performance to originate solely from the joint venture, or are the individual past performances from each member of the joint venture also acceptable?

Please refer to the RFP Addendum to FAR 52.212-1, Volume 1, Factor III, past performance under a JV should be submitted the same as the instructions for subcontractor/partner references.

18 Is this a new or existing opportunity? If existing, who is the incumbent; what is the contract value and contract number?

The cover page should indicate the following:

- Title of the proposal

- Volume Number (I or II)

- Proposal Category (Factor/Sub-factor)

- Request for Proposal Number

- Name and Address of Offeror, CAGE Code, SAM Unique Entity ID, and applicable Tax I.D. Number (TIN)

- Point of Contact name, telephone number, and email address

- Proposal valid for 180 days after solicitation closing

Proposals shall be prepared in two (2) separate and distinct volumes (attachments):

There are two volumes, with Volume I containing 3 Factors. Factor II Technical Approach has 2 Sub-Factors. Referencing the 3rd bullet of the referenced and underlined text, it appears that the government wants a cover page for each Factor and each Sub-factor.

The Government is not dictating when a cover page/sheet/letter is used, offerors need to make this decision independently.

The contractor shall maintain a set of master source code and associated documentation in a labeled and bound format consistent with industry standards. This appears to suggest that source code and documentation is a physical (paper) asset? Does NWDC have a master repository with versioning capabilities or are these physical documents?

This is not a physical paper requirement and the verbiage is consistent with industry standard language. The source code will be stored within an approved development environment within GitLab.

7.1.2. The contractor shall maintain and report help desk statistics on total number of calls, resolution time, aged ticket report (72 hours, VIP closed tickets, closed and opened and greater than 24 hours). What does NWDC use as a Help Desk Ticket Management system?

Will the Government clarify the IA Technical Level requirement for the Quality Assurance Technician Desktop Specialist?

IT Technical Level requirement pertains to DoD's 8140 Cyber Workplace qualifications that outlines individual IT positions as requiring specific certifications to hold that position. In this case of IAT Level I for QA Tech Desktop Specialist while the Required Technical Skills/Experience lists experiences levels per skill as it pertains to years of experience.

PWS 23.1 (Quality

Assurance Technician Desktop Specialist)

N0018924R0018.pdf The requirements for the Quality Assurance Technician Desktop Specialist include a “Microsoft Office MCSE”, as well as “Level II: 5 years practical experience” on the same line. In addition, there is a requirement for a “Microsoft Certified Professional” (MCP) certification and “5 years practical experience”. It is our understanding that Microsoft no longer offers the MCSE and MCP certifications. For example, Microsoft retired the MCSE certification as of January 31, 2021.

Given that Microsoft no longer offers the MCSE or MCP certifications, will the Government clarify whether another certification will suffice for the Quality Assurance Technician Desktop Specialist?

MCSE and MCP requirements can be replaced with Microsoft 365 Fundamentals as a comparable certificate.

PWS 23.4 (Senior Domino

The requirements for the Senior Domino Database Manager III include a “Microsoft Office MCSE”, as well as “Level II: 10 years practical experience” on the same line. In addition, there is a requirement for a “Microsoft Certified Professional” (MCP) certification and “10 years practical experience”. As noted in the question above, it is our understanding that Microsoft no longer offers the MCSE and MCP certifications. Given that Microsoft no longer offers the MCSE or MCP certifications, will the Government clarify whether another certification will suffice for the Senior Domino Database Manager III?

MCSE and MCP requirements can be replaced with Comptia DataSys+ as a comparable certificate

We noted that the Functional Responsibilities for the Application Engineer II and Software Engineer II are identical.

Will the Government clarify whether these Functional Responsibilities for two Labor Categories are intentionally the same?

The functional responsibility for each of these roles was intended to be the same, as the same experience is required for both roles, the difference between the two comes with day-to-day tasking.

N0018924R0018.pdf The proposal instructions state, “The offeror shall provide a staffing approach that ensures a fully qualified work force is in place on the first day of contract execution.” In addition, the Section 7.4 of the PWS states, “The purpose of the Post-Award Orientation is to… 3.) review the 30-day transition-in to full performance…” These statements appear to be contradictory.

Will the Government clarify whether a fully qualified workforce is required on the first day of contract execution or within 30 days of award?

The PWS states, “The Government currently utilizes 6 primary database instances however, this number is subject to change in both quantity and complexity due to the nature of the tasking, the “database lab”, and the testing environment, which necessitates the creation of new databases on an as-needed basis.” Will the Government provide a breakdown of the 6 primary databases in the NWDC environment; e.g., Oracle and/or SQL?

The databases are SQL based.

PWS Section 19.2 includes the following: “Individuals who have access to system control, monitoring, or administration functions (e.g., system programmer) are said to have “privileged access” and therefore, require training and certification to IA Technical levels I, II, or III depending on the functions they perform. They must also be trained and certified on the OS or CE they are required to maintain.” We note that only one labor category—the Quality Assurance Technician Desktop Specialist described in PWS 23.1—includes a requirement for skills / experience with an OS or CE; i.e., Windows 10. Will the Government clarify the OS and CE certification requirements for each labor category in PWS 23?

The OS requirement is only applicable to the Desktop Tech position as this role services the windows 10 environment, this position's CE requirements can be fulfilled with A+ ( IAT I) or more commonly the higher SEC+ (IAT II) is used and fulfills the IAT I requirement in addition to the IAT II should it be needed. All positions require a SEC + CE certificate with the exception of the Quality Assurance Technician Desktop Specialist.

PWS 23 (Labor

Categories) N0018924R0018.pdf The labor category requirements include experience with tools and scripting languages such as XSLT. Will the Government accept candidates who have experience with other similar tools and scripting languages such as JSON, Postscript, and Extensible?

All acceptable languages and tools are outlined in section 6.6.1 of the PWS.

49 Proposal Instructions N0018924R0018.pdf The RFP specifies that Key Personnel resumes can only be two (2) pages in length. Given the extensive certifications and experience requirements for each labor category designated as Key, will the Government consider allotting bidders more than two (2) pages per resume in order to effectively demonstrate the qualifications of proposed candidates?

No, resumes shall be no longer than 2 pages each.

50 Proposal Instructions N0018924R0018.pdf Proposals in response to the subject solicitation are due to the Government by 2:00 PM on May 17, 2024. Offeror questions are due approximately two weeks before this deadline—at 2:00 PM on May 3, 2024. Given the need for clarification based on the answers to bidder questions, will the Government consider an extension of the proposal due date?

51 Proposal Instructions

The instructions for the price proposal state, “No price information shall be included in any other Volume including cover letters.” There is no other reference to a cover letter in the proposal instructions.

Will the Government clarify whether a cover letter is required with the proposal submission? If so, will the Government clarify:

- Whether specific information is required in the letter?

- Whether the letter is to be submitted in Volume II or as a separate file?

Cover letter, cover sheet, and cover page are interchangeable terms. Please refer to the RFP.

52 Proposal Instructions The instructions for the price proposal state, “The price proposal shall include all supporting data to clearly show how the fully-burdened labor prices were developed. This information shall include breakdown of the labor categories, labor hours and labor rates anticipated and should be submitted in Microsoft Excel format.” The instructions also include the following: “c) Service CLINs - The offeror shall provide a fully burdened price per month to meet the requirements as defined in the PWS.” Does the Government intend to provide an Excel spreadsheet that includes specific tabs to be completed? If not, how does the Government intend to ensure that price proposals are evaluated for consistency of information provided by offerors?

Section 21, Other Conditions and Requirements

The solicitation states: “Contractors shall fully review and comply with Commander, U.S. Fleet Forces Command (COMUSFLTFORCOM)/Commander, United States Pacific Fleet (COMPACFLT) instruction 6320.3B and supporting references. These documents establish Fleet policy concerning medical screening of contractors, and the provision of medical and dental care to contractors, who embark on United States (U.S.) Navy ships when the vessel is afloat and away from shore for periods of time greater than 24 hours. All contractors shall complete the required medical and dental screening form and submit the form to the ship’s Senior Medical Department Representative (SMDR) or Senior Medical Officer (SMO) prior to boarding.” Could the government please clarify whether any positions staffed for this solicitation require medical screenings, provision of medical and dental care, or embarkation on U.S. Navy ships?

NWDC was informed that this statement was to be included on all performance work statements. Positions for this effort will not be required to embark upon any US vessels.

On page 5, under CLIN 5001, the solicitation lists FAR 52.212-8. However, on page 21, the solicitation states that “Options, to include FAR 52.217-8, will be evaluated pursuant to solicitation provision FAR 52.217-5, Evaluation of Options.” Could the government confirm that the correct FAR clause in this instance is 52.217-8 and not 52.212-8?
