About this file

This document is a Sole Source Justification for Fire Arms Training Simulator (FATS)/Small Arms Weapon Simulator (SAWS) maintenance warranty support services. The contract will be awarded to InVeris Training Solutions, Inc. for a base year from 15 September 2025 to 14 September 2026, with two additional 12-month option periods ending on 14 September 2028. The total estimated value is $160,500 for the base period and $641,500 if all options are exercised, funded through Navy Operations & Maintenance (O&MN) appropriations.

The justification emphasizes InVeris's proprietary technology, noting they are the only manufacturer capable of servicing the FATS/SAWS BLUEFIRE® system. The simulators feature unique technological capabilities, including wireless communication, precise sensor tracking, and specialized firearms modifications. The proposed contract was synopsized on SAM on 09 April 2025, with InVeris being the only company expressing interest. The Navy's contracting activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, and the requiring activity is Naval Construction Group One and Two under Navy Expeditionary Combat Command.

SOLE SOURCE JUSTIFICATION

1. Identification of Agency and Contracting Activity.

The requiring activity is Naval Construction Group One and Two under Navy Expeditionary Combat Command, Virginia Beach, Virginia; the contracting activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, Contracting Department – Fleet Directorate.

2. Description of the Action Being Approved.

This is a sole source action for the provision of Fire Arms Training Simulator (FATS)/Small Arms Weapon Simulator (SAWS) maintenance warranty support services that are currently performed under Contract N0018922P0611. Contract N0018922P0611 was awarded 26 August 2022 on a sole source basis as a firm fixed price contract to InVeris Training Solutions, Inc., a large business; the existing contract expires on 14 September 2025.

This is a follow-on to a non-competitive requirement.

3. Description of Supplies/Services.

The instant requirement is for the FATS/SAWS Bluefire maintenance warranty support services. The services are expected to begin no later than 15 September 2025 and continue through 14 September 2026 as the base year with an additional two (2) 12-month periods, ending on 14 September 2028.

4. Statutory Authority Permitting Sole Source.

The statutory authority permitting this sole source actions is 41 U.S.C. 1901 Simplified acquisition procedures – a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a)

5. Rationale Justifying Use of Cited Statutory Authority.

A patent, copyright, proprietary data, or licensing agreement limits competition. The proprietary data are described as follows:

1. InVeris is the only manufacturer that can properly service the FATS/SAWS BLUEFIRE® proprietary technology offered in the FATS/SAWS BLUEFIRE® line. InVeris small arms weapons simulators are developed using original manufacturer constructed firearms/weapons.

These firearms are highly modified and reengineered and contain numerous proprietary compounds and configuration electronics in order for them to interact with the computer software/firmware associated only with these simulator systems.

2. All proprietary repair parts or components that are needed to perform repair/replacement must be procured from InVeris. Additionally, the source code for the software and firmware that controls both the computer system and the firearm simulators is also proprietary to InVeris. As a result, any changes, modifications, updates, or fixes to the software can only be performed solely by InVeris certified service technicians. Support for the FATS/SAWS must only be provided by InVeris service technicians to maintain warranty.

3. The ISMT/SAWS System-Controlled firearms offer unparalleled diagnostics and sensor capability. They allow tracing for on-screen display where the muzzle of the firearm is pointing throughout the entire Hostile Intent Determination (HID) scenario training and NAVY/ NECC proscribed courses of fire. The simulators contain sensors to measure grip pressure, trigger squeeze, safety on/off, and finger presence within the trigger guard. They are also programmable for a predetermined number of rounds, with the instructor able to initiate jams and misfires at any time during a course of fire, or when a live-action HID scenario is playing.

4. Wireless BlueFite® configuration: Firearm simulators use RF technology to communicate with the system via one-to-one encrypted data link, allowing only a single firearm to communicate with its paired dongle. This data-link prevents intrusion or bleed-over between other firearms operating at the, same time and allows precise recording of hits on target assigned to the specific firearm. The FATS/SAWS BlueFire® systems retain the sensor feedback and control of weapons with exception of analog sensor functions. The FATS/SAWS wireless BlueFire® weapon simulators can also be used simultaneously with FATS/SAWS tethered weapon firearm simulators.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a Description of Market Research, if applicable, and a List of Interested Sources, if any.

The proposed contract was synopsized on SAM on 09 April 2025 and only InVeris expressed an interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than InVeris to provide the required supplies and services.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSUP Fleet Logistics Center (FLC) Norfolk has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP Fleet Logistics Center (FLC) Norfolk will assess whether competition for future requirements is feasible.

To date, no other sources expressed an interest in the requirement.

Furthermore, market research has determined that InVeris can meet the government’s minimum needs.

9. Contracting Point of Contact.

The point of contact at NAVSUP Fleet Logistics Center Norfolk, is Sherell Brown, Code 212.1, who may be contacted by e-mail at sherell.g.brown.civ@us.navy.mil; or Morgan Olszak, Code 212.1, who may be contacted by e-mail at morgan.e.olszak.civ@us.navy.mil.
