Performance Work Statement United States Naval Academy (USNA)

Commercial Tents with Power Generation Services

1.0 OVERVIEW

The purpose of this Performance Work Statement (PWS) is to obtain contractor support to provide commercial tents, power generation services, tables, chairs, and climate control capabilities along with the personnel and management to complete the requirements described herein the Performance Work Statement (PWS). The required supplies and services will enable the USNA d to extend the dining facility space and capability to provide meals to the Brigade of Midshipmen, while maintaining social distancing and serve all meals in a timeframe that allows for minimal interruption to the academic schedule.

2.0 OBJECTIVES

The objective of this requirement is to obtain contractor support to provide multiple tents with a sufficient number of tables, chairs, electrical capability, and power generation services to support the requirements to feed the Brigade of Midshipmen at the USNA. The Contractor will be required to deliver, assemble and disassemble all items listed in this PWS.

3.0 SCOPE

The Contractor will provide the personnel, management, materials, and equipment necessary to complete the requirements described in this PWS. The contractor will designate an on-site working supervisor that is qualified to lead the crew, perform task during set-up, and take down of equipment. On-site supervisor shall be required to possess and utilize a cell phone and company email address capable of sending and receiving email messages to conduct business. The working supervisor will coordinate all activities with the Contracting Officer’s Representative (COR) and provide direction of all activities to crewmembers.

The contractor shall deliver and set-up tents, with power generation, lights, electrical receptacles, tables, and chairs at to Smoke Court located at the USNA. Tents are required at two (2) locations within the area of Smoke Court.

3.1 Tents

3.1.1 The contractor shall provide two (2) 18 meters x 35 meters structured tents that will each cover a concrete area that is approximately 60ft x 115ft.

3.1.2 Tents: The contractor shall deliver and set-up the tents with power generation to two (2) designated locations. Each location shall accommodate no less than 380 Midshipmen. Tents will have sides and entryways sufficient to provide protection form environmental elements.

3.1.3 Tent Installation: The contractor shall ensure each of the two (2) tents are properly anchored to the ground.

The contractor is responsible for providing all required tent staking and tie-down materials. Tie-down must be sufficient to withstand winds of 25-30 mph. Designated sites are concrete pads. Vehicles are not to be parked or driven on concrete pads.

3.2 Power Generation

3.2.1 Power Generation: The contractor shall provide generation capabilities to sufficiently power internal lights, dining services equipment, electrical receptacles, and HVAC.

3.2.2 Generators: The contractor shall provide fuel powered generators with capabilities to sufficiently power internal lights, electrical, and HVAC.

3.2.3 Generator Services: The contractor shall provide a certified generator mechanic-repair technician that is on call for the duration of the contract. Repair technician must be available 24 hours/day or on-site repair and must arrive within 60 minutes of notification.

3.2.4 Fuel: The contractor shall be responsible for refueling operations as well as provide fuel. The government will NOT provide fuel during contracted support.

3.3 HVAC

3.3.1 HVAC: The contractor shall provide HVAC (cooling/heating) to each tent.

3.3.2 HVAC: The HVAC will need to run an estimated 15 hours a day, 7 days a week.

3.3.3 HVAC Service: The contractor shall provide for an on-call certified HVAC repair technician for the duration of the contract. Repair technician must be available 24 hours/day for on-site repair and must arrive with 60 minutes of notification.

3.4 Electrical: The contractor shall provide electrical capabilities to allow for lighting as well as the operation of galley equipment.

3.5 Tables and Chairs

3.5.1 Tables: The contractor shall provide a number of tables sufficient to allow for 800-1000 Midshipmen per tent to dine.

3.5.2 Chairs: The contractor shall provide for 800 to 1000 folding chairs.

3.5.3 Miscellaneous: Contractor shall provide disposable tablecloths for each table. Tablecloths will be disposed of after each meal.

3.6 Doors: The contractor shall provide four (4) hard-door entrances to each tent structure.

4.0 REQUIREMENTS

4.1 Application. This Performance Work Statement (PWS) contains basic instructions for assembly and disassembly of commercial tents with power generation services

4.2 Personnel. The Contractor shall provide a qualified crew of sufficient size to perform the assigned tasks. A standard crew consists of one (1) working supervisor and laborers to deliver, assemble tents, place generators, install lighting, and set up tables and chairs. Contractor will also be responsible for the disassembling of all items at the completion of contract. When workload changes, additional crews/crew members may be required to accomplish the assigned task.

The Contractor shall ensure all crew members are in a proper uniform that provides for easy recognition at all times.

The Contractor shall ensure that all crew members working under this contract have successfully passed all security/screening processes required to perform work on USNA.

The Contractor shall ensure that all crew members are physically able to perform all duties required by the contract.

4.3 Materials. The Contractor will provide all required equipment and materials.

4.4 Documents and Reports. The contractor will ensure all the documentation performed by the contractor personnel will be accurate and legible. All invoices submitted for billing will be complete to include and detailed an accurate account of services performed.

4.5 Contractor Proximity to USNA. The Contractor should be within 50 miles of proximity to the USNA or able to provide personnel within two (2) hours in the event urgent support is needed.

5.0 QUALITY CONTROL AND ASSURANCE

5.1 Quality Control: The contractor will implement and maintain a Quality Control Plan (QCP) to ensure work performed conforms to the scope of work and meets the requirements under this PWS. The QCP will, at a minimum provide a method for performing inspections; identifying, correcting and preventing problems/defective service; addressing customer complaints, and improving the quality of services over the life of the contract.

5.2 Quality Assurance. The Government reserves the right to perform inspections and surveillance to evaluate the Contractor’s compliance to the contract terms and performance of the requirements in the PWS. The Government will make every effort to ensure that the surveillance methods used are conducted in an objective, fair, and consistent manner. The Government will assign a Contracting Officer’s Representative (COR) who will be responsible for monitoring performance in accordance with the requirements of the PWS and the Quality Assurance Surveillance Plan (QASP). 5.0 GOVERNMENT FURNISHED PROPERTY/EQUIPMENT/INFORMATION (GFP/GFE/GFI)

No government furnished equipment shall be provided.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019)

The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications--Commercial Items.

(a) Definitions. As used in this provision--

Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing--

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and

(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

52.204-26 COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES--REPRESENTATION (DEC

2019)

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

ADDENDUM TO FAR 52.212-1

The Government intends to solicit and award on a sole source basis to Grand Rental Events. Therefore, the vendor’s initial quote shall contain the vendor's best terms from a price standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

1) At the time of solicitation closing date, the quoter shall submit their quote via electronic submittal to lorna.mohney@navy.mil. Only electronic submissions shall be accepted.

2) Price quotes will be due on the closing date of subject RFQ and must be held firm for sixty (60) days.

3) Submission of Quotation in addition to FAR 52.212-1, Instructions to Quoters - Commercial Items, the following information is provided. Quotes must include the completed solicitation documents as follows:

A complete and signed Standard Form 1449, Solicitation/Contract/Order for Commercial Items, and executed copy of Amendments, if applicable, completed by the quoter.

RFQ Section - Schedule of Supplies/Services - completed by the quoter.

All supplemental information to support proposed price, to include but not limited to copies of previously paid invoices, sales history for the same or similar items, price list with effective date and / or copies of catalog pages along with any applicable discounts.

Unless completed in SAM, RFQ Section, Representations, Certifications and Other Statements of Vendors, completed by the offeror in accordance with FAR 52.204-8 and DFARS 252.204-7007 Alt. A.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Vendors responding to this solicitation are advised that, prior to award, the Government may request vendors to submit information/data to support price reasonableness such as copies of paid invoices for the same or similar items, sales history for the same or similar items, price list with effective date and/or copies of catalog pages along with any applicable discounts. Failure to submit the requested information may result in disqualification of the submitted quote.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JUN 2020)

ALTERNATE I (OCT 2014)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision--

“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

“Subsidiary” means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Veteran-owned small business concern” means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

“Women-owned small business concern” means a small business concern --

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
