Section SF 1449 - CONTINUATION SHEET

SECTION I

In regards to this solicitation; if we provide a 3rd party letter of agreement between the hotel and ourselves are we allowed to submit a quote?

Answer: In accordance with Section 3 of the Performance Work Statement, the contractor shall demonstrate that it has managerial control of the facility and is not acting as an agent or authorized third party. Privity of contract shall be established between NMPDC and the hotel. A Third Party Letter of Agreement will not be considered.

There is a requirement that third parties are not allowed, yet this is for small businesses. Can the following statement be removed from the PWS?: “The contractor shall demonstrate that it has managerial control of the facility and is not acting as an agent or authorized third party.”

Answer: The language included in the PWS cannot be removed. In accordance with Section 3 of the Performance Work Statement, the contractor shall demonstrate that it has managerial control of the facility and is not acting as an agent or authorized third party. Privity of contract shall be established between NMPDC and the hotel.

I am confirming that my company (we do not own or manage a hotel) can bid on this lodging/meeting space requirement. There is a statement about the contractor having to demonstrate managerial control of the facility. I can assure you that we manage all of our subcontractors and provide a service far superior than working with the hotel alone.

Answer: In accordance with Section 3 of the Performance Work Statement, the contractor shall demonstrate that it has managerial control of the facility and is not acting as an agent or authorized third party. Privity of contract shall be established between NMPDC and the hotel.

Can we participate as a facilitator for our client hotels? The contract will be with the hotel.

Answer: You may participate provided the resultant quote establishes privity of contract between the ordering activity and the hotel. Furthermore, the submission must demonstrate that quoter has managerial control of the facility and is not acting as an agent or authorized third party.

There is a requirement that third parties are not allowed, yet this is for small businesses. Is there any likelihood you will remove the third party restriction?

Answer: The language included in the PWS cannot be removed. In accordance with Section 3 of the Performance Work Statement, the contractor shall demonstrate that it has managerial control of the facility and is not acting as an agent or authorized third party. Privity of contract shall be established between NMPDC and the hotel.

Is there a contract associated to the requirement? If yes, can you kindly provide the incumbent contractor and incumbent contract number?

Answer: 1750 Rockville Pike LLC (Rockville Hilton), N00189-14-D-Z020

FBO.gov does not have the Past Performance Information Form posted on the solicitation for N0018919RZ0006. Can you provide me with an electronic copy of the Past Performance Information Form?

Answer: Please see the attached Past Performance Information Form.

Because it takes time for clients to fill out and return the Past Performance Information Form to the contracting officer, are you willing to delay the Response suspense from 17 May 2019 to 1 Jun 2019?

Answer: The closing date for the solicitation is currently 5/21/19. This date may be subject to change. Please continue to monitor NECO for updates.

Can a meeting procurement company submit a bid on behalf of the hotel?

Answer: In accordance with Section 3 of the Performance Work Statement, the contractor shall demonstrate that it has managerial control of the facility and is not acting as an agent or authorized third party. Privity of contract shall be established between NMPDC and the hotel.

The training room required is one room per course per year, minimum of 50 people capacity, classroom style seating or theatre style seating? Can you elaborate please? Is this room for orientation only?

Answer: The conference room would need to offer classroom style seating. It will be utilized as a training space to facilitate a lecture with PowerPoint for the POMI courses.

For this requirement I wanted to verify the verbiage for parking. Are you wanting complimentary parking?

Answer: Please review the PWS for requirement specific details. Any items not included in the PWS are therefore not required.

Section 2(v), Page Limitations, of the Submission of Quotes section of the Solicitation states that Volume I (Non-price Quote) is limited to seven pages. Volume I is to consist of Management Approach, Performance Approach and Past Performance. Section 2(v) states that Management Approach is limited to two pages, and Performance Approach is limited to seven pages. The page count information is contradictory. Can an offeror submit seven pages for Management Approach and two pages for Performance Approach (for a total of 9 pages), without exceeding the page limits for Volume I?

Answer: The solicitation erroneously stated the total page allowance for Volume I –Non Price Quote to be 7 pages. The page limitation for Volume I – Non Price Quote has been increased from 7 to 12 pages. The breakdown is shown below:

Management Approach – (2 pages) Performance Approach – (8 pages) Past Performance– (2 pages)

Section 2(v), Page Limitations, of the Submission of Quotes section of the Solicitation states that Volume I (Non-price Quote) is limited to seven pages “inclusive of any charts, diagrams, and/or other graphics.” Volume I is to consist of Management Approach, Performance Approach and Past Performance. Section 3 of the Performance Work Statement requires the contractor to “demonstrate that it has managerial control of the facility and is not acting as an agent or authorized third party.” Limiting Volume I to seven pages is an inadequate amount of space for a small business to provide its Management Approach, Performance Approach and Past Performance, and demonstrate how it will have managerial control over the facilities, especially given that the seven pages is inclusive of chart, diagrams, and/or other graphics. Would the Contracting Officer consider excluding charts, tables and other graphics from the page count for Volume 1 or increasing the page count for Volume 1?

Answer: We cannot exclude charts, tables, diagrams and other graphics. However, the page limitation for Volume I – Non Price Quote has been increased from 7 to 12 pages.

3. Can the Contracting Officer exclude Past Performance information forms from the page count in Volume I?

Answer: We cannot exclude the past performance forms. However, in effort to accommodate this request, we have increased the page limitations for Volume 1- Non Price Quote from 7 to 12 pages.

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (AUG 2018)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits a quote in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of quotes. Submit signed and dated quotes to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotes may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, quotes must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of quotes;

(3) The name, address, and telephone number of the quoter;

(4) A technical description of the items being quoteed in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the quoter shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the quote is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotes that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of quotes. The quoter agrees to hold the prices in its quote firm for 30 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotes. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple quotes. Quoters are encouraged to submit multiple quotes presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each quote submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of quotes:

(1) Quoters are responsible for submitting quotes, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotes or revisions are due.

(2)(i) Any quote, modification, revision, or withdrawal of a quote received at the Government office designated in the solicitation after the exact time specified for receipt of quotes is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of quotes; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of quotes and was under the Government's control prior to the time set for receipt of quotes; or

(C) If this solicitation is a request for Quotes, it was the only Quote received.

(ii) However, a late modification of an otherwise successful quote, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the quote wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that quotes cannot be received at the Government office designated for receipt of quotes by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotes will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Quotes may be withdrawn by written notice received at any time before the exact time set for receipt of quotes. Oral quotes in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile quotes, quotes may be withdrawn via facsimile received at any time before the exact time set for receipt of quotes, subject to the conditions specified in the solicitation concerning facsimile quotes. A quote may be withdrawn in person by a quoter or its authorized representative if, before the exact time set for receipt of quotes, the identity of the person requesting withdrawal is established and the person signs a receipt for the quote.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate quotes and award a contract without discussions with quoters. Therefore, the quoter's initial quote should contain the quoter's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; accept other than the lowest quote; and waive informalities and minor irregularities in quotes received.

(h) Multiple awards. The Government may accept any item or group of items of a quote, unless the quoter qualifies the quote by specific limitations. Unless otherwise provided in the Schedule, quotes may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity quoteed, at the unit prices quoteed, unless the quoter specifies otherwise in the quote.

The Quoter also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. If the Quoter does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Quoter should indicate that it is a quoter for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

If the Quoter does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Quoter. The quoter shall demonstrate relevant past performance or affirmatively state that it possesses no relevant past performance. Quoters should provide a detailed explanation demonstrating the relevance of the contracts or efforts to the requirements of the solicitation.
