C. All items shall fit and work together interchangeably as an integrated system. The contract requires furniture quality workmanship. Sharp edges and burrs are not acceptable.

D. Sections 3.5.2 through 3.5.9, 3.7, 4.4.4 and 4.4.7 of MIL-PRF-32038 do not apply. SST is the current official abbreviation for stainless steel. CRES is an obsolete abbreviation for stainless steel. All stainless steel shall have a Number 4 finish, unless otherwise indicated.

If a referenced specification has been canceled without replacement and the Contract Line Item Description or this Requirements Statement do not cite an updated replacement specification, the Contractor may substitute a commercial equivalent. If there are option choices available within the cited specifications that are not specified by the contract, the Contractor shall select the grades and conditions etc. as the Contractor recommends. Additional detail, drawings, or even a sample, may be required to obtain approval if the catalog and description does not adequately describe the item.

(4) The SME, and approval of all Drawings, Substitutes, Deviations, RFDs, or ECPs shall be by the requiring activity, Mid Atlantic Regional Maintenance Center (MARMC), Code 352. Requests shall be e-mailed to Mid Atlantic Regional Maintenance Center (TBD@navy.mil), by the vendor at the same time they are submitted to the Contracting Officer. Individual Delivery Orders may indicate an alternate or additional SME.

(5) Mid Atlantic Regional Maintenance Center will forward the Government response to the vendor, the PCO/ACO, not later than thirty (30) days after receipt. Time will not be added to the vendor's production or delivery schedule because of failure to identify and submit requested deviations, waivers, drawings, RFDs, ECPs, or requests for clarification.

(6) The vendor shall email a copy of each Delivery Order within 72 hours of receipt to TBD@navy.mil and TBD @navy.mil.

J. Estimated annual quantities in the basic solicitation are estimates only. The actual Delivery Order quantities for any Find Numbers may be more or less than the estimated quantity in the solicitation. Any resulting contract will not be an exclusive source, nor an obligation for the Government to purchase through this vehicle. If the first unit of production inspection is changed to be at destination, delivery will be considered to have been made when evidence of government acknowledgement of request for shipping has been provided to the designated MARMC representative (TBD @navy.mil), or other SME if indicated by the Delivery Order. The 14 days for government action would begin upon receipt of the material at the inspection location. It is the contractors’ responsibility to re-package the first unit of production, even if it is accomplished at destination.

Additional Orders should not be made under this solicitation until after first unit of production inspection of the first delivery order has been satisfactorily completed and any issues addressed satisfactorily.

Orders should not be made under this solicitation while a vendor is late on another order, or while there are any other outstanding technical or quality issues.

The following Find Numbers will require First Unit of Production Inspection by the government whenever first ordered. Some of the listed Find Numbers are expected to be included in the First Delivery Order. All of the First Delivery Order is subject to the First Unit of Production Inspection. Additionally, the First Unit of Production Inspection requirements apply to the listed Find Numbers, even if they are not ordered until a later Delivery Order.

C.2. INSPECTION AND ACCEPTANCE (ADDITIONAL PROVISIONS)

Tailoring for Quality Management System ISO 9001 under 52.246-11:

Compliance with an ISO 9001 compliant system is required; however, being registered or certified is NOT required for the distributor or reseller. System and records are subject to reviews and evaluations as reasonably necessary to ascertain compliance. The Government has the right to inspect and test all supplies called for by the contract, to the extent practicable, at all places and times, including the period and location of manufacture, and in any event before acceptance. The Government may use a third party for reviews, evaluations and inspections. These reviews, evaluations and inspections shall be conducted in a manner that will not unduly delay the contract work. Copies of records shall be provided on request. Records shall be retained for at least one year past the last delivery under this solicitation. Additional orders should not be placed with a vendor while there are unresolved QA issues.

Tailoring for in house manufacturing and flow down to subcontractors under 52.246-11:

The requirement for ISO 9001 compliant systems must flow down to subcontractors and suppliers for purposes of this contract. Any product, operation or process that uses a Limited Distribution Drawing is critical and complex.

Casting and/or welding operations require in-process control. Honeycomb related manufacturing and fabrication require in-process control.

Products or components of products which invoke MIL-S-901 or MIL-DTL-901 require in-process control and are critical and complex.

Welding operations must be under an ISO 9001 compliant system.

Honeycomb related manufacturing and fabrication must be under an ISO 9001 compliant system.

Subcontracts or purchase orders must pass down the requirement that manufacturing facilities must be in compliance with a documented quality management system which has been accepted under a DCMA audit or an ISO 9001-2008 (or later) system certified by a third party accredited by ANAB, (except as superseded lower in this paragraph for limited applications) and that they are subject to audit for the purpose of this contract. Subject to approval for this contract, systems may be otherwise documented as approved by the Government in lieu of being certified.

Subcontracted operations limited to shearing, bending and punching are not required to be manufactured under a compliant system. However, all items shall have been visually and dimensionally inspected under an ISO 9001 compliant system prior to offering for delivery to the government. (End of Tailoring)

C.3. INSPECTION DETAILS

Manufacturer inspection: Vendors may rely on the material certifications from the manufacturer provided that traceable documentation is available, and that the manufacturer is in compliance with a documented quality management system which has been accepted under a DCMA audit or an ISO 9001-2008 (or later) system certified by a third party accredited by ANAB. The vendor is not required to have copies of all inspection records on hand, but inspection records shall be available on request from the government. If documentation is not otherwise available, the vendor is responsible to comply with all testing and inspection called for by first tier references.

Inspection for delivery under this solicitation:

Inspection for delivery shall include a lot based sample to be visually and dimensionally inspected. Inspection shall include examination for attributes addressed in MIL-PRF-32038. Sharp edges or burrs are not acceptable.

Lot Size Definition & Alternative Sample Size:

The statistics of sampling plans can be complicated. In lieu of other sampling size and sampling criteria, the vendor may elect to consider each Find Number submitted for delivery at one time as its’ own lot and use the following sampling criteria: If the delivery quantity is 1, 2 or 3, all are inspected. If the delivery quantity of that Find Number is not more than 8, 3 samples shall be selected at random. If the delivery quantity of that Find Number is 9 through 25, 5 samples shall be selected at random. If the delivery quantity of that Find Number is 26 through 40, 7 samples shall be selected at random. If the delivery quantity of that Find Number is more than 40, 10 samples shall be selected at random. If any samples are found to be defective, the defective items are rejected, and every item in the lot must be individually inspected. This sampling scheme may be applied to all materials under this solicitation.

Smaller sample size and cursory inspection may be applied to mass produced items such as FN 723 ARR based on a documented QMS and email approval from the SME.

The government may choose to perform additional inspections. Inspection records shall be retained and made available for review on request through at least one year past the end of the last delivery on the contract. Inspection records for Find Numbers containing honeycomb shall include material certification and shall be traceable by lot or batch and shall be consistent with a documented Quality Management System.

C.4. INSPECTION AND ACCEPTANCE TERMS

Inspection and acceptance as cited in Delivery Orders.

Supplies/services will be inspected/accepted at: If the First Unit of Production Inspection is changed to be at destination, delivery will be considered to have been made when evidence of government acknowledgement of request for shipping has been provided to the designated MARMC representative (TBD @navy.mil), or other SME if indicated by the Delivery Order.

52.209-4 FIRST ARTICLE APPROVAL--GOVERNMENT TESTING (SEP 1989)

(Contracting Officer shall insert details)

(a) The Contractor shall deliver 1 unit(s) of Lot/Item (Find Number) within Prescribed calendar days from the date of this contract to the Government at (insert name and address of the testing facility) for first article tests. The shipping documentation shall contain this contract number and the Lot/Item identification. (b) Within 7 calendar days after the Government receives the first article, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article. The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.

(c) If the first article is disapproved, the Contractor, upon Government request, shall submit an additional first article for testing. After each request, the Contractor shall make any necessary changes, modifications, or repairs to the first article or select another first article for testing. All costs related to these tests are to be borne by the Contractor, including any and all costs for additional tests following a disapproval. The Contractor shall furnish any additional first article to the Government under the terms and conditions and within the time specified by the Government. The Government shall act on this first article within the time limit specified in paragraph (b) of this clause. The Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule or for any additional costs to the Government related to these tests.

(d) If the Contractor fails to deliver any first article on time, or the Contracting Officer disapproves any first article, the Contractor shall be deemed to have failed to make delivery within the meaning of the Default clause of this contract.

(e) Unless otherwise provided in the contract, the Contractor--

(1) May deliver the approved first article as a part of the contract quantity, provided it meets all contract requirements for acceptance and was not consumed or destroyed in testing; and

(2) Shall remove and dispose of any first article from the Government test facility at the Contractor's expense.

(f) If the Government does not act within the time specified in paragraphs (b) or (c) of this clause, the Contracting Officer shall, upon timely written request from the Contractor, equitably adjust under the Changes clause of this contract the delivery or performance dates and/or the contract price, and any other contractual term affected by the delay.

(g) The Contractor is responsible for providing operating and maintenance instructions, spare parts support, and repair of the first article during any first article test.

(h) Before first article approval, the acquisition of materials or components for, or the commencement of production of, the balance of the contract quantity is at the sole risk of the Contractor. Before first article approval, the costs thereof shall not be allocable to this contract for (1) progress payments, or (2) termination settlements if the contract is terminated for the convenience of the Government.

(i) The Government may waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the Offeror/Contractor and have been accepted by the Government. The Offeror/Contractor may request a waiver.
