G. If not listed above, the applicable revision of all referenced documents, including second and lower tier reference documents, shall be the one in effect on 14 May 2018. For military and government specifications and standards the source for obtaining copies and for determining effective dates is the Acquisition Streamlining and Standardization Information System (ASSIST), database posted at quicksearch.dla.mil. For commercial specifications and standards the source for obtaining copies and for determining effective revisions is the website of the issuing organization such as www.asme.org or www.ansi.org. https://webstore.ansi.org/ provides an extensive database. The drawings listed above are posted on MSCorpHab.com or can be requested through the contracting office or the Subject Matter Expert (SME) identified in Delivery Orders. Limited Distribution drawings must be requested.

H. Many Military and Federal Specifications are being canceled and/or converted to commercial equivalents. Referenced drawings have not in all cases been updated to cite the currently applicable specification. If a referenced specification has been canceled without replacement and the Contract Line Item Description or this Requirements Statement do not cite an updated replacement specification, the Contractor may substitute a commercial equivalent. If there are option choices available within the cited specifications that are not specified by the contract, the Contractor shall select the grades and conditions etc. as the Contractor recommends. In the event there is an alteration to the drawing or specification after the Invitation for Bid, the supplier may, upon approval of the procuring activity, fabricate the item to the newer design.

I. All items shall be made strictly in accordance with the line item descriptions and this Requirements Statement except where a Request for Deviation (RFD), or Engineering Change Proposal (ECP), has been approved explicitly for this contract.

(1) RFDs and ECPs must be precisely defined. The government may require detailed sketches, drawings, data or samples to clarify and document any requests. Due to the Habitability nature of the items, appearance is a factor in the evaluation of all RFDs and ECPs. Submittals shall include contract number, applicable CLIN and Find Number, description of the differences, reason for the differences, cost impact, schedule impact, identification of units which are affected, any effect on logistics support, action taken to prevent future recurrence of any non-conformance, reference to all previous correspondence that is related to the RFD or ECP or similar requests, and the contractor’s point-of contact including phone number and e-mail address. Submittals shall be in the contractor’s format. The submission of requests via electronic means (e.g., e-mail) is preferred.

(2) Reference to a manufacturer’s model number or item number is intended to be descriptive and not restrictive. The referenced items represent the required sizes, configuration, materials, finish, quality, and workmanship. Alternate proposals for items that are believed equal or a better value to the government are welcome.

(3) For any items, vendors may propose equivalent commercial items. For each alternate or substitute item, the vendor’s proposal shall include a detailed description and catalog cuts, including renderings or photographs. Additional detail, drawings, or even a sample, may be required to obtain approval if the catalog and description does not adequately describe the item.

(4) The SME, and approval of all Drawings, Substitutes, Deviations, RFDs, or ECPs shall be by the requiring activity, Mid Atlantic Regional Maintenance Center (MARMC), Code 352. Requests shall be e-mailed to Mid Atlantic Regional Maintenance Center (TBD@navy.mil), by the vendor at the same time they are submitted to the Contracting Officer. Individual Delivery Orders may indicate an alternate or additional SME.

(5) Mid Atlantic Regional Maintenance Center will forward the Government response to the vendor, the PCO/ACO, not later than thirty (30) days after receipt. Time will not be added to the vendor's production or delivery schedule because of failure to identify and submit requested deviations, waivers, drawings, RFDs, ECPs, or requests for clarification.

(6) The vendor shall email a copy of each Delivery Order within 72 hours of receipt to TBD@navy.mil and TBD @navy.mil.

J. Estimated annual quantities in the basic solicitation are estimates only. The actual Delivery Order quantities for any Find Numbers may be more or less than the estimated quantity in the solicitation. Any resulting contract will not be an exclusive source, nor an obligation for the Government to purchase through this vehicle. The government intends to use this vehicle only to the extent that it is believed to be advantageous to the Government.

K. QUALITY MANAGEMENT SYSTEM - Higher-Level Contract Quality system compliance is required.

Compliance with an ISO 9001 compliant system is required; however, being registered or certified is NOT required for the distributor or reseller. System and records are subject to reviews and evaluations as reasonably necessary to ascertain compliance. The Government has the right to inspect and test all supplies called for by the contract, to the extent practicable, at all places and times, including the period and location of manufacture, and in any event before acceptance. The Government may use a third party for reviews, evaluations and inspections. These reviews, evaluations and inspections shall be conducted in a manner that will not unduly delay the contract work. Copies of records shall be provided on request. Records shall be retained for at least one year past the last delivery under this solicitation. Additional orders should not be placed with a vendor while there are unresolved QA issues.

Tailoring for in house manufacturing and flow down to subcontractors under 52.246-11:

The requirement for ISO 9001 compliant systems must flow down to subcontractors and suppliers for purposes of this contract. Any product, operation or process that uses a Limited Distribution Drawing is critical and complex.

Casting and/or welding operations require in-process control. Honeycomb related manufacturing and fabrication require in-process control.

Products or components of products which invoke MIL-S-901 or MIL-DTL-901 require in-process control and are critical and complex.

Welding operations must be under an ISO 9001 compliant system.

Honeycomb related manufacturing and fabrication must be under an ISO 9001 compliant system.

Subcontracts or purchase orders must pass down the requirement that manufacturing facilities must be in compliance with a documented quality management system which has been accepted under a DCMA audit or an ISO 9001-2008 (or later) system certified by a third party accredited by ANAB, (except as superseded lower in this paragraph for limited applications) and that they are subject to audit for the purpose of this contract. Subject to approval for this contract, systems may be otherwise documented as approved by the Government in lieu of being certified. Subcontracted operations limited to shearing, bending and punching are not required to be manufactured under a compliant system. However, all items shall have been visually and dimensionally inspected under an ISO 9001 compliant system prior to offering for delivery to the government. (End of Tailoring)

C.3. INSPECTION DETAILS

Manufacturer inspection: Vendors may rely on the material certifications from the manufacturer provided that traceable documentation is available, and that the manufacturer is in compliance with a documented quality management system which has been accepted under a DCMA audit or an ISO 9001-2008 (or later) system certified by a third party accredited by ANAB. The vendor is not required to have copies of all inspection records on hand, but inspection records shall be available on request from the government. If documentation is not otherwise available, the vendor is responsible to comply with all testing and inspection called for by first tier references.

Inspection for delivery under this solicitation:

Inspection for delivery shall include a lot based sample to be visually and dimensionally inspected. Inspection shall include examination for attributes addressed in MIL-PRF-32038. Sharp edges or burrs are not acceptable.

Lot Size Definition & Alternative Sample Size:

The statistics of sampling plans can be complicated. In lieu of other sampling size and sampling criteria, the vendor may elect to consider each Find Number submitted for delivery at one time as its’ own lot and use the following sampling criteria: If the delivery quantity is 1, 2 or 3, all are inspected. If the delivery quantity of that Find Number is not more than 8, 3 samples shall be selected at random. If the delivery quantity of that Find Number is 9 through 25, 5 samples shall be selected at random. If the delivery quantity of that Find Number is 26 through 40, 7 samples shall be selected at random. 52.209-4 FIRST ARTICLE APPROVAL--GOVERNMENT TESTING (SEP 1989)

(Contracting Officer shall insert details)

(a) The Contractor shall deliver 1 unit(s) of Lot/Item (Find Number) within Prescribed calendar days from the date of this contract to the Government at (insert name and address of the testing facility) for first article tests. The shipping documentation shall contain this contract number and the Lot/Item identification. The characteristics that the first article must meet and the testing requirements are specified elsewhere in this contract.

(b) Within 7 calendar days after the Government receives the first article, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article. The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.

(c) If the first article is disapproved, the Contractor, upon Government request, shall submit an additional first article for testing. After each request, the Contractor shall make any necessary changes, modifications, or repairs to the first article or select another first article for testing. All costs related to these tests are to be borne by the Contractor, including any and all costs for additional tests following a disapproval. The Contractor shall furnish any additional first article to the Government under the terms and conditions and within the time specified by the Government. The Government shall act on this first article within the time limit specified in paragraph (b) of this clause. The Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule or for any additional costs to the Government related to these tests.

(d) If the Contractor fails to deliver any first article on time, or the Contracting Officer disapproves any first article, the Contractor shall be deemed to have failed to make delivery within the meaning of the Default clause of this contract.

(e) Unless otherwise provided in the contract, the Contractor--

(1) May deliver the approved first article as a part of the contract quantity, provided it meets all contract requirements for acceptance and was not consumed or destroyed in testing; and

(2) Shall remove and dispose of any first article from the Government test facility at the Contractor's expense.

(f) If the Government does not act within the time specified in paragraphs (b) or (c) of this clause, the Contracting Officer shall, upon timely written request from the Contractor, equitably adjust under the Changes clause of this contract the delivery or performance dates and/or the contract price, and any other contractual term affected by the delay.

(g) The Contractor is responsible for providing operating and maintenance instructions, spare parts support, and repair of the first article during any first article test.

(h) Before first article approval, the acquisition of materials or components for, or the commencement of production of, the balance of the contract quantity is at the sole risk of the Contractor. Before first article approval, the costs thereof shall not be allocable to this contract for (1) progress payments, or (2) termination settlements if the contract is terminated for the convenience of the Government.

(i) The Government may waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the Offeror/Contractor and have been accepted by the Government. The Offeror/Contractor may request a waiver.
