4. Statutory Authority Permitting SOLE SOURCE.

The statutory authority permitting other than full and open competition is 10 USC 2304(c)(5)- A sole source acquisition authorized or required by statue, as implemented by FAR 6.302-5.

5. Rationale Justifying Use of Cited Statutory Authority.

Source Selection Information – FAR 2.101 and 3.104

In accordance with FAR 19.1406(a), the Contracting Officer does not have a reasonable expectation that quotes would be received from two or more SDVOSB concerns, the anticipated award price of the contract, inclusive of options, is less than $4,000,000.00, and the requirement is not currently performed by an 8(a) participant under the provisions of FAR Subpart 19.8 and has not been accepted as a requirement by the SBA under FAR Subpart 19.8.

In addition, this action both supports the SDVOSB socio-economic program, and is in accordance with the guidance of the Deputy Assistant Secretary of the Navy (DASN) memo, The Ability to Award a Sole

Source Contract through Various Socioeconomic Programs dated 10 May 2017.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A sources sought/ combined synopsis/ solicitation was posted to the Government – Wide Point of Entry -

(GPE) on 22 February 2018. The posting was for a sole source follow-on to contract N00189-17-C-

Z022, which would have a period of performance of one base year and (2) one year options. Immersion

Consulting expressed interest in the requirement. The Government engaged Immersion in conversations to assess their capabilities. Immersion is interested in submitting a quote for this requirement in the future but did not feel there was sufficient time for them to transition into performing this work at the moment. As a result, the Contracting Officer decided to extend the current contract for a period of one year instead of awarding a new contract as previously planned. The one year extension will allow for the

Government to resolicit these services as competitive which will foster competition and allow for

Immersion to submit a quote for the follow-on. In addition the extension allows for FMO to avoid a break in coverage.

As a result of the above, the Contracting Officer has a reasonable expectation that Iron Arch would be the only SDVOSB concern that would submit a quote at this time. It is expected the follow-on to the contract will be issued as competitive and will result in at least two SDVOSB submitting quotes.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

As stated in paragraph 6 above, FLC Norfolk, Contracting Department, Philadelphia Office has decided to extend the current contract for a period of one year. It is expected that this extension will allow sufficient time for at least one other company to properly prepare and submit a quote for this requirement.

The follow on to contract N00189-10-D-Z022 will be competed as a SDVOSB set aside.

9. CONTRACTING POINT OF CONTACT
