About this file

This document outlines a solicitation for planning, design, execution, analysis and assessment, and reporting support services for operational experimentation. Key details include that the Navy Warfare Development Command (NWDC) requires these services to meet operational goals and advance fleet readiness in Navy, joint, multi-service, and Allied environments. The Naval Supply Systems Command intends to award multiple hybrid contracts with both cost-plus-fixed-fee and firm-fixed-price contract line items to support these efforts. A security clearance is required to perform under the resultant contracts. As the services have been deemed non-commercial, the acquisition will follow the procedures in FAR Part 15 for contracting by negotiation.

PAYMENT OF FIXED FEE

PAYMENT OF FIXED FEE UNDER CPFF TASK ORDERS (CPFF MULTIPLE AWARD IDIQ) (SEP 2015)

(a) This contract is one of a set of Multiple Award Contracts (MAC). The fixed-fees established in the individual contracts are estimates only. The total Fixed Fee to be paid under any individual contract is the sum of the Fixed-Fees identified in any resultant CPFF task orders awarded to the individual contract holder. Fixed-price task orders do not impact the total fixed-fee to be paid under this contract.

(b) For CPFF task orders, the Government shall make monthly payments at the fixed fee payout rate established in accordance with paragraphs (1) and (2) below, for each task order direct labor hour invoiced by the contractor. The CPFF task order fixed-fee and fixed-fee payout rates shall be established as follows:

Non-Competitive CPFF Task Orders - The fixed fee payout rate for non-competitive task orders to be paid under any individual task order will be the hourly fee rate determined by dividing MAC solicitation’s Estimated Total Hours by the individual contractor’s proposed fixed fee for the award of the MAC contract. The task order fixed-fee shall be calculated by multiplying the task order level of effort by the below hourly fixed-fee payout rates –

____________Fixed Fee______Level of Effort_***_
Lot ITo be specified at time of awardxx,xxx*/**
Lot IITo be specified at time of awardxx,xxx*/**
Lot IIITo be specified at time of awardxx,xxx*/**
Lot IVTo be specified at time of awardxx,xxx*/**
Lot VTo be specified at time of awardxx,xxx*/**

Competitive CPFF Task Orders – The fixed-fee for competitive task orders shall be established by the competitive solicitation process. The maximum fixed fee percentage an individual contractor shall quote in response to any competitive CPFF task order solicitation is the fixed fee percentage that contractor proposed for the award of the MAC contract calculated in the same manner used for the proposal for the contract. However, the contractor is free to propose a lower fee percentage rate than that contractor proposed for the award of the MAC contract. The fixed fee payout rate under each competitive CPFF task orders shall be calculated by dividing the proposed fixed fee amount for that task order by the task order’s estimated level of effort.

If substantially fewer than the estimated hours established in any task order are employed in the performance of that task order, then the fixed fee amount for the task order shall be equitably reduced to reflect the reduction of work.

(d) All payments shall be in accordance with the provisions of FAR 52.216-8, “Fixed Fee,” and FAR 52.216-7, “Allowable Cost and Payment.” The total of all such payments shall not exceed eighty-five (85%) percent of the fixed fee specified under each applicable delivery/task order. Any balance of fixed fee due the contractor shall be paid to the Contractor, and any over-payment of fixed fee shall be repaid to the Government by the Contractor, or otherwise credited to the Government at the time of final payment.
