SUMMARY

SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

SUMMARY

1. The time and date for receipt of proposals remains 1600 EST (local time/Philadelphia, PA) on Friday, 8 December 2017.

NOTE: Part I of this amendment provides a list of questions and answers/comments received in response to this solicitation. The questions and answers/comments are provided for all potential offerors to review but shall not be considered to be terms and conditions of the solicitation. All revisions to the solicitation resulting from consideration of these questions by the Government (and other revisions, as required) have been incorporated into the solicitation as specified in Part II of this amendment. Quoters are cautioned to review the entire solicitation including amendments and attachments (if applicable) to ensure a complete understanding of the requirements of this solicitation.

Part I:

Questions received in response to Solicitation N0018917RZ092

GENERAL QUESTIONS

1. 1. Per N0018917RZ092; Amendment 0002, Page 32, Section H.b.iii, (OCI Clause) stating, (iii) “The contracting officer shall have the sole discretion to determine whether a potential or actual organizational conflict of interest exists concerning any interest or contract. The contracting officer may take such steps as are necessary in the best interest of the Government to eliminate potential or actual conflicts of interest.”

Question: Please confirm the OCI/Mitigation Plan is to be submitted as part of Volume II – Cost/Price Proposal.

Response: See Part II. The OCI plan is to be submitted as part of the Cost/Price proposal.

2. Within Amendment 0002, the Government provided an updated link (https://health.mil/Reference-Center/Forms) where several forms referenced in the solicitation could be found. However, the link does not provide the Data Sharing Agreement (DSA).

Question: Can the Government please provide a copy DSA for the offeror to review?

Response: See Part II. The link (https://health.mil/Military-Health-Topics/Privacy-and-Civil-Liberties/Submit-a-Data-Sharing-Application) has been added.

3. Based upon the answers to questions #51 – 56, can the government confirm that it is still possible for a non-IPA Corporate Experience/Past Performance qualification that is highly relevant to all task areas of the PWS and meets magnitude (≥57FTE) and complexity (multiple geographic locations) considerations to receive “Substantially Confident” and “Very Relevant” ratings?

Response: We cannot provide a responses to hypothetical situations. As stated in Section L, “Greater weight will be given to experience obtained as an Independent Public Accounting (IPA) firm.”

4. Based upon the answers to questions #51 – 56, can the Government confirm that it will also recognize Corporate Experience/Past Performance qualifications for which an IPA was a subcontracted teaming partner on both the Corporate Experience/Past Performance and on the current proposal as receiving “greater weight” in the evaluation?

Response: The solicitation is clear on its face. Section L25 states “The Offeror may identify contracts or efforts for its proposed subcontractors among the three of corporate experience/past performance references provided in its proposal. It is the contractor’s responsibility to adequately explain the relevance of a reference provided for a subcontractor’s corporate experience/past performance to the effort that the subcontractor is proposed to perform under the solicitation.”

5. Based upon the answers to questions #30 – 37 within Amendment 0002, can the Government confirm that the OCI restriction on “the performance of audits for or on the DHA and DON” only refers to the performance of financial statement/accounting audits? If so, please revise the Section H – OCI Clause language of (c)(i)(1) to state “performance of financial statement audits” to ensure that other types of unrelated audits, e.g., manpower, policy, information technology systems, are excluded from this future contracting restriction.

Response: Audits are not limited to financial statement/accounting audits.

6. Regarding question 31, please confirm that the certifications for non bona fide employees of the offeror should be included in Volume II.

Response:See Part II. Yes, this is to be included in Volume II.

7. RFP H17 Task Order Procedures paragraph (b) states that CPFF and FFP tasks will be tendered under this Multiple Award Contract, however the Section B doesn't include a FFP CLIN. Please confirm that FFP tasks will be tendered, and a separate FFP CLIN will be established under the MAC contract.

Response: Solicitation clause 52.216-1 states “the Government reserves the right to issue both Cost Plus Fixed Fee and Firm Fixed Price type task orders.” CLIN 0001 will be used to issue the FFP orders as well as the CPFF orders.

8. This acquisition is for an IDIQ, which is an award that authorizes companies to compete for subsequent task orders that specify the actual work to be performed. At the IDIQ stage, an offeror may, or may not, have specific employees envisioned for performance under this contract; the actual identification and proposal of such employees will not occur until the Task Order competition, where more specific requirements, to include geographic location, more specific PWS activities and deliverables, a specific timeframe for task order work (impacting employee availability), and possibly additional labor requirements, may be provided. All of these aspects could impact which specific employees are proposed and what the compensation of prospective employees would be. For these reasons, would the Government postpone the Compensation Plan Requirement until the Task Order solicitations?

Response: No.

9. Is it the government’s intent to issue small business set asides to the reserved small business awardee, within the IDIQ?

Response: Please refer to FAR 16.505(b)(2)(i)(F).

10. For the small business reserve award, will the small business be required to perform the standard 51% work share for all resulting Task Order at the IDIQ level or on each individual Task Order?

Response: The requirement for small businesses to perform at least 50 percent of the cost of contract performance only applies to set-aside requirements.

11. If a task order RFQ is full and open amongst the IDIQ holders, and the small business is awarded, does the small business workshare requirement in the FAR apply to the Task Order?

Response: Please see the response to the previous question.

12. The OCI clause states: (a) Definitions - In this clause:

(i) “Contractor” means the firm signing this contract;

(ii) “DON Audit Contractors” means any firm, or subcontractor thereof, that has been engaged in or is currently engaged in conducting an audit on any element of the Department of the Navy.

(c) Restrictions on Contracting

(i) The contractor agrees that during the term of this contract, and for a period of 36 months thereafter, neither it nor its affiliates shall (1) enter into any contract for the performance of audits for or on the DHA and DON, (2) create for themselves any interest in DHA and DON Audit Contractors; (3) consult or discuss with DHA and DON Audit Contractors any aspects of work under this contract unless expressly required by the contract or a task order thereunder.

Question: As stated in the OCI clause, did the government intend to restrict any interest between the contractor (bidder) and the DHA Audit Contractors and DON Audit Contractors, to include the subcontractors thereof, during the term of this contract, and for a period of 36 months thereafter? If that is the intent, would the government disclose the complete list of DHA Audit Contractors and their subcontractors and the DON Audit Contractors and their subcontractors?

Response: The government’s intent is not to restrict interest between the contractor and the DHA and DON Audiot Contractors. The OCI clause requires the offeror/contractor to submit an OCI mitigation plan if there is an interest with these companies. For a complete list of the DHA and DON Audit Contractors, you should submit a FOIA request to the Contracting activity that awarded the DHA and DON Audit contracts.

13. In reference to the OCI clause, would the government define “DHA Audit Contractors” as they have defined “DON Audit Contractors?”

Response: See Part II.

14. The OCI clause states, “Prospective offerors are requested to furnish with their proposals, information for itself and its associates pertaining to any contracts as or with DHA and DON Audit Contractors or any substantial interest in DHA and DON Audit Contractors, within the last 36 months prior to the closing date for Final Proposal Revisions.”

Question: Would the government define “substantial interest”?

Response: No.

PART II:

SECTION C - DESCRIPTIONS AND SPECIFICATIONS

The following have been modified:

PERFORMANCE WORK STATEMENT

BUMED FINANCIAL AND BUSINESS OPERATIONS MANAGEMENT SUPPORT (FBOMS)

1.0 SCOPE

In recent years, the Military Health System (MHS) has been operating in an environment of constant change. The establishment of the Defense Health Agency (DHA) promoted efficiencies through the shared service functions, requiring increased integration with each of the Service medical branches. With the enactment of the FY17 National Defense Authorization Act (NDAA), further integration is forthcoming with significant changes in the areas of leadership, governance, and the delivery of healthcare for the entire MHS. These changes will affect the role, culture, and work of front-line doctors, nurses, and all staff of Navy Medicine. Additional disruptors such as the implementation of the electronic health record, MHS GENISIS, a move to a new financial accounting system, and the impending financial audit all put Navy Medicine in a position to experience further transformational changes. As such, proactive steps need to be taken to improve outcomes for the organization. In an environment of ever increasing need for efficiency and effectiveness due to downward pressure on costs, a focus on people, process, technology and policy will allow Navy Medicine to recognize success. Navy Medicine requires support to ensure that those people, process, technology and policies are adequately supporting its mission and ability to deliver the goal of the MHS Quadruple Aim: readiness, cost effectiveness, population health and patient experience.

This program, complete with program management and operation support services, financial management operations, business process improvement, change management and information management support, all in a geographically dispersed environment, provides best business practices that support and enhance the overall mission capabilities. It also provides opportunity for improvement for all core business functions throughout BUMED.
