SECTION SF 30 BLOCK 14 CONTINUATION PAGE
SUMMARY OF CHANGES
SECTION SF 1449 - CONTINUATION SHEET
The following have been added by full text:
ANSWERS TO SUBMITTED QUESTIONS
A. The following questions and answers are provided for clarification only and do not change the requirements identified in the performance work statement.
Changes to the performance work statement are described in paragraph B, below.
Q 1:
The Solicitation instructions (p. 72) require offerors to " submit a single set of corporate experience and past performance information (maximum of three (3) of its most relevant contracts)". However, on the same page, the following is also noted: " Relevant references submitted under the Corporate Experience factor will also be considered in the evaluation of Past Performance. Only a single set of up to five references shall be submitted." Can the government please clarify these conflicting statements and confirm that a maximum of 3 and not 5 references for corporate experience and past performance information are to be provided.
A 1:
Only a single set of up to three (3) references shall be submitted.
Q 2:
The Solicitation instructions (p. 71) indicate that " Volume I, Technical Quote, is limited to a maximum of five (5) pages" and we understand that this is inclusive of the “Corporate Experience and Past Performance Information Form” for each reference submitted (i.e., a total of 3 pages). As such, it appears that offerors are limited to 2 pages to discuss their Performance Approach. Is this a correct assumption?
A 2:
Corporate experience will not count as part of Volume I. See B 1, below.
Q 3:
Can the government please consider providing a "Statement of Equivalent Rates for Federal Hires" for the 3 exempt positions called for in the Solicitation.
A 3: As these three categories are not covered under the Service Contract Act of 1965, the Government is not providing equivalent rates for these categories.
Q 4:
Can the government please indicate how it will ensure that the small business Prime Contractor (who is ultimately responsible for the entire contract and the delivery of all services) is not unduly reliant on its sub-contractor(s) experience and/or expertise.
A 4:
Per 52.219-14, prime contractors are limited to performing at least 50% of cost of contract.
Q 5:
The Solicitation indicates that this is a 100% small business set aside. Can the government confirm that unlike a "Total" or "Partial" small business set-aside wherein a small business Prime (who will perform more than 50% of the requirements) can have large business subcontractors, in a "100%" small business set aside, the prime and any proposed sub-contractors must all be small businesses under NAICS 561110.
A 5:
This is a total small business set aside; prime contractors must perform at least 50% of the cost of the contract performance incurred.
Q 6:
The NAICS Code for the Presolicitation and Solicitation on the FBO page is 541612 - Human Resources Consulting Services, and the NAICS on the Form 1449 is 561110. Please advise.
A 6:
NAICS code 541612 is a typographical error. The correct NAICS is 561112.
Q 7:
Please advise if an incumbent is providing the services and if they are eligible to bid.
A 7:
This contract action is currently performed by Dynamic Systems Technology, Inc. under contract N68836-12-C-0033 POP 28 September 2012-27 August 2013. The incumbent is eligible to submit a bid.
Q 8:
Since this will be a FFP contract, may the contractor reduce staffing during the period of performance if efficiencies are discovered?
A 8:
No, contractors shall provide the staff required in the PWS.
Q 9:
Since this is a FFP contract, will the monthly invoice amount remain the same regardless of actual hours worked?
A 9:
Yes, with the exception of authorized overtime hours.
Q 10:
Do you want bidder to fill in travel and ODC costing or leave it blank ?
A 10:
Yes, fill out travel and ODC CLINS.
Q 11:
Since this will be a FFP contract, may the contractor, based on the contractor's local management, manage working hours and comp time so as to not incur time-and-a-half overtime ?
A 11: Overtime is to be paid, post approval, after the contractor requests it. Therefore, if a contractor neither needs nor requests overtime to fulfill the mission, then none shall be paid.
Q 12:
Considering there are 13 contractor FTEs, shouldn't there be a required on-site Project Manager so this work won't have the appearance of a personal services contract?
A 12:
Per PWS section 12.0, “Contractor employees performing services under this order shall be controlled, directed, and supervised at all times by Contractor management personnel.” It is incumbent on the contractor to supervise its employees.
Q 13:
Page 58 contains a table titled SCA Labor Category. Are these recommended or required categories? Considering this is a FFP contract, why is the Navy telling bidders how to categorize staff? The Navy should be concerned with product/service outcome, not the contractor's internal labor descriptions/mappings.
A 13:
Per Service Contract Act of 1965, those labor categories fall under the Service Contracts Act, which requires that each service employee to be paid not less than minimum monetary wages and fringe benefits determined by the Secretary of Labor. For more information see FAR 52.222-41 and 52.222-43.
Q 14:
Page 58 table titled SCA Labor Category contains an entry of: 01112 - Data Entry Operator III. This is not a valid DOL SCA labor code - category.
A 14:
See B 3, below.
Q 15:
Considering the objective of this proposed effort, why was this solicitation not set-aside for Veteran (VOSB) or Service Disabled Veteran (SDVOSB) bidders?
A 15:
As this is a re-solicitation of a previous contract action, the previously used NAICS and set-aside are being utilized.
Q 16:
How many total FTE’s (Key Personnel) are required under this requirement? Do we need resumes?
A 16:
This solicitation has no key personnel requirements that require resumes.
B. The following changes are being made to the solicitation:
