About this file
This is a Recommendation for Other Than Full and Open Competition memorandum submitted to justify sole-source procurement of specialized bandpass filter assemblies from MIL-SAT LLC by the Naval Surface Warfare Center, Dahlgren Division (NSWCDD).
The procurement concerns two filter assembly components: eight E502 Bandpass LHCP Filter Assemblies and eight E501 Bandpass RHCP Filter Assemblies manufactured by MIL-SAT LLC, with an estimated total cost and 6-8 week delivery requirement. These assemblies are direct replacement components for existing 6011-4-DTS and 6011-4-TVHD antenna systems currently installed at NSWCDD. The justification for sole-source procurement is based on proprietary data constraints, as MIL-SAT LLC is the Original Equipment Manufacturer (OEM) and retains exclusive proprietary data rights and technical schematics. The recommendation asserts that no other vendor possesses legal rights or technical documentation to manufacture exact replacement parts, and that procuring from alternative manufacturers would present unacceptable schedule risks, technical risks requiring significant reverse-engineering efforts, and costs exceeding twelve months of effort. Market research confirmed that the material is unavailable through General Services Administration Federal Supply Schedules or NASA Solutions for Enterprise-Wide Procurement contract vehicles, and that no other manufacturer's products can meet the government's minimum requirements. However, the OEM has verified several authorized resellers are available for their proprietary products. The memorandum includes certification statements from both the recommending official and the Contracting Officer, dated 7/13/2026, confirming that only one or limited sources are reasonably available.

Subj: RECOMMENDATION FOR OTHER THAN FULL AND OPEN COMPETITION
Ref: (a) 0612-12 - MIL-SAT Bandpass (BP) Assemblies Package
1. It is recommended that other than full and open competition be used to acquire the following manufactured by MIL-SAT LLC:
Part Number Description Quantity E502 E502 Bandpass LHCP Filter Assembly 8 E501 E501 Bandpass RHCP Filter Assembly 8
The total estimated cost is with delivery required 6-8 weeks after receipt of the order.
The requested material represents the minimum requirements of the government.
2. The requiring activity is the Naval Surface Warfare Center, Dahlgren Division (NSWCDD).
The material must be compatible in all aspects (form, fit, and function) with the existing 6011-4-DTS and 6011-4-TVHD antenna systems presently installed.
Proprietary data limits competition. These assemblies are direct replacement parts/components for the existing equipment. Procuring filters from another manufacturer would present unacceptable schedule risks and loss of information technology data to dealing with and the concept of operations (CONOPS). MIL-SAT LLC is the Original Equipment Manufacturer (OEM) and retains the proprietary data rights for these components. No other vendor has the legal right or the technical schematics to manufacture the exact replacement parts. Using any other source would introduce unacceptable technical risk, require significant reverse-engineering, and result in unacceptable delays and duplication of cost. In order to research, procure, install, and reconfigure, would require greater than twelve (12) months of effort and exceed , not to mention the loss in investment(s) made with our current provider to meet our needs. The failure to repair the existing Radar Absorbing Material (RAM) would cause a substantial impact to critical requirements.
3. Market research demonstrated that MIL-SAT LLC is the OEM for these components. Market research determined that this material is not available on General Services Administration Federal Supply Schedules and National Aeronautic and Space Administration Solutions for Enterprise-Wide Procurement contract vehicles. It was determined that no other manufacturers products will provide the current capabilities or meet the Governments minimum requirements.
Communication with the OEM has verified that there are several authorized resellers available for their proprietary products.
CERTIFICATION
I certify that the facts and representations under my cognizance, which are included in the above recommendation, are accurate to the best of my knowledge and belief. I understand that the processing of this recommendation precludes the use of full and open competition.
