The following have been modified:

SOLICITATION

1. GENERAL INSTRUCTIONS

1.1. Offerors that intend to submit a proposal as a Prime Contractor shall submit a written non-binding notice of intent to the Contract Specialist, by email, at sean.t.mcgovern@navy.mil within eighteen (18) days of the solicitation release date. An informational copy shall also be sent to the Contracting Officer at daniel.belcher@navy.mil.

1.2. It is the Offeror's responsibility to bring to the attention of the Contracting Officer at the earliest possible time, but prior to the closing date, any ambiguities, discrepancies, inconsistencies, or conflicts between the SOW and other solicitation documents attached hereto or incorporated by reference. All questions shall be submitted to the Contract Specialist, by email, at sean.t.mcgovern@navy.mil within fourteen (14) days after issuance of this solicitation. An informational copy shall also be sent to the Contracting Officer at daniel.belcher@navy.mil.

1.3. Any questions received after fourteen (14) days after issuance of this solicitation may not be addressed and may not result in an extension to the proposal due date. Questions relating solely to an Offeror's possible Organizational Conflict of Interest shall be addressed directly to the Contract Specialist at sean.t.mcgovern@navy.mil. An informational copy shall also be sent to the Contracting Officer at daniel.belcher@navy.mil.

1.4. Price will not be evaluated in this solicitation in accordance with FAR 15.304(c)(1)(ii). Therefore, the Government intends to award to all qualifying Offerors in response to this solicitation. A qualifying Offeror must be deemed a responsible source (see FAR 9.104-1), and submit a technically acceptable proposal conforming to the requirements of this solicitation. Any Offeror who receives a No Confidence rating for either evaluation factor will not be considered technically acceptable. If the Contracting Officer determines that it is in the best interest of the Government, the Government may cease to continue evaluation of a proposal after assigning a “No Confidence” rating for Factor 1. In order to expedite the responsibility determination required by FAR 9.103(b), provide documentation of the Offeror’s adequate financial resources, or the ability to obtain them (FAR 9.104-3(a)). This documentation will only be used to establish responsibility in the event of contract award, and will NOT be used to evaluate pricing in subsequent Task Orders.

1.5. Offerors shall not submit more than one offer in response to this solicitation, and only offers submitted in accordance with these instructions will be accepted.

1.6. Proposals shall be clear and concise, and shall include sufficient detail to permit the Government to adequately evaluate and substantiate proposal statements.

1.7. The Government reserves the right to cancel this solicitation at any point before contract award. In the event this solicitation is canceled, the Government has no obligation to reimburse Offerors for any costs incurred.

1.8. The total magnitude for each construction project will be disclosed with each individual Task Order Request, but will not exceed $6 million for construction or $7.5 million for repairs.

1.9. This requirement is set-aside for HUBZone Small Business Concerns. Proposals from other Offerors will not be considered.

2. PROPOSAL SUBMISSION AND FORMAT

2.1. Proposals in response to this solicitation shall be valid for 365 calendar days (FAR 52.215-1(d)).

2.2. SAFE Submission

Electronic proposals shall be submitted via DoD Safe Access File Exchange (SAFE) https://safe.apps.mil/ (FAR 52.215-1(c)(1)). The Government will not accept proposals through any other medium.

In accordance with Paragraph 1.1, Offerors must notify the POCs listed above of their intent to propose within eighteen (18) days of the solicitation release date. The notification email shall include the name and email address of the Offeror representative submitting the proposal. Twenty one (21) days after the solicitation release date the Government will send a ‘drop-off request’ through DoD SAFE to the Offeror email provided. This request will provide the link required to submit proposals. It is the Offeror’s responsibility to confirm receipt once proposals are submitted.

2.3. Operating System and Applications

Proposals will be accessed with the Microsoft Windows 10 Operating System. Proposal files shall be submitted using only the applications listed below:

2.4. Hyperlinks

Offerors may use hyperlinks within and among proposal Factor files. NOTE: Each Factor submission shall be on a stand-alone basis. Any information required for evaluation, and not found in its designated file, is assumed omitted from the proposal.

2.5. Virus Free Electronic Submission

Offerors shall ensure that proposals are virus free. The Offeror shall certify, in the proposal cover letter, that all electronic proposal information delivered throughout the evaluation (e.g., initial proposal, responses to evaluation notices, final proposal revisions) is virus free. Offerors shall specify the software, version, and virus definition used to check the data.

2.6. Multimedia and Graphics

Sound and video (e.g., MPEG) files shall not be imbedded within the proposal. Offerors should:

a. Avoid submitting large files

b. Simplify color palettes and minimize the use of color images or graphics;

c. Minimize size of graphics files; and

d. Avoid scanned images.

2.7. Pre-award Clearance

VETS-4212 (FAR 52.222-38): Provide documentation that the Prime, and any Sub-contractors over $100k (total value), is current with their reporting as required by FAR Subpart 22.13.

2.8. Proposal Format

Fonts: Proposal text fonts shall not be smaller than Microsoft Word Times New Roman 11 or Arial Narrow 12 point font, single column, normal character spacing and position. The text for charts, tables, graphs, and figures shall be no smaller than Microsoft Word, Times New Roman or Arial Narrow, 9 point font. Line spacing shall be at least single-spaced.

Pages: All pages shall be formatted as 8.5” x 11” letter size with one-inch margins all around. 11” x 17” is allowed for charts, tables, and graphs only. Any proposal text included on these pages, other than the information specific to the graphics, will not be considered in the evaluation. One 11” x 17” page will be counted as two pages. All material shall be contained within the page limits identified below for each section, and all appendices, charts, graphs, diagrams, tables, photographs, drawings, etc., are included in the page count. Not included in the page count are title pages, tables of content, glossaries of abbreviations, acronyms, or definitions. Evaluators will only evaluate up to the maximum number of pages specified in Table 2 below.

Headers and Footers: Information contained in headers and footers shall only provide company name, solicitation number, proposal section (e.g. Factor 1), disclosure markings (FAR 52.215-1(e)), dates, or page numbers. Text sizes shall be no smaller than Microsoft Word, Times New Roman or Arial Narrow, 9 point font.

2.9. Business Volume

Cover Letter: The Cover Letter shall indicate the Offeror’s unconditional agreement to the terms and conditions in this solicitation. Offeror shall identify all enclosures being transmitted as part of the proposal, proposed Sub-contractors to be utilized under the contract, and type of sub-contract the Prime will have with each Sub-contractor.

The letter shall also include the CAGE code, DUNS number, and DCMA/DCAA Points of Contact (if applicable) for the Prime Contractor and all proposed Sub-contractors.

Mandatory Requirement: The Offeror shall demonstrate the compliance with the Mandatory Requirement listed below. In addition, the Mandatory Requirement shall be maintained throughout the life of the Contract. An Offeror not this requirement at time of proposal submission will not be considered for award. The mandatory requirement is as follows:

Requirement 1: Facility Location:

The Prime Contractor’s primary facility providing support to this requirement must be located within 100 miles of NSWCDD (Naval Surface Warfare Center Dahlgren Division) in Dahlgren, VA.

Pre-Award Documentation: Include the documentation required in accordance with Section 2.7 above.

Partnering Documentation: Provide documentation identifying the arrangement and disclosing company relationships (FAR 9.603) for any Joint Venture, Teaming Arrangement, Mentor-Protégé, etc. established for the purposes of this solicitation.

Solicitation Section Responses: The Offeror shall either include a statement that a potential organizational conflict of interest does not exist at any tier or present a plan to neutralize any actual or perceived organizational conflicts of interest in accordance with L-209-H009. The statement and/or mitigation plan shall cover all Team Members.

Offerors shall complete the Representations and Certifications as instructed in Section 004500 - Representations, Certifications and Other Statements of Offerors.

001100 TECHNICAL FACTORS AND BASIS FOR AWARD

1. BEST VALUE SOURCE SELECTION FACTORS

Each proposal will be evaluated on two separate Factors. The distinction between the two Factors is described as follows:

1. Prior Experience - pertains to whether or not the Offeror has previously performed work that is similar to the type of work covered by this requirement in terms of size, scope, and complexity. Size refers to contract/task order/project dollar value and duration; scope refers to work that is the same or similar to that identified in Section 010100 Scope of Services; and complexity refers to performance challenges and environmental conditions similar to that expected for the facilities and conditions described by the solicitation. Prior Experience assesses the Offeror’s ability to perform the work successfully based on whether similar work has been performed in the past. An Offeror without demonstrated prior experience may be rated less favorably than an Offeror with such prior experience.

2. Past Performance - pertains to how well an Offeror has performed on its demonstrated prior experience.

Past Performance assesses the risk of doing business with an Offeror based on the quality of performance on similar efforts in the past, if any. Offerors without a record of Past Performance or for whom information on Past Performance is not available will be evaluated neither favorably nor unfavorably.

2. FACTOR 1 – PRIOR EXPERIENCE

2.1 Corporate Summary: Provide an overview of the Offeror’s corporate or business history. Include answers to the following questions as applicable:

1. How long has the Offeror been in the construction business?

2. Where do the majority of the Offeror’s construction projects occur?

3. What licenses or certifications are held by the Offeror?

4. What industry awards have the Offeror received?

5. Has the Offeror received any citations, lawsuits, or prosecutions?

2.2 The Offeror shall submit no more than five construction projects that best demonstrate prior experience on projects that are similar in size, scope, and complexity to the projects that will be ordered under this MACC. All submissions shall be for projects performed by the Offeror within the last five years of the issue date of this RFP and may be for military, federal, state and local government, or private projects. Projects may have been performed as a Prime or Sub-contractor, however projects performed as a Sub-contractor will be valued less than those performed as a Prime. All projects shall be single tasks, contracts, or jobs. Offerors shall not submit whole IDIQ contracts as a single project.

2.3 The projects submitted under this Factor shall include the following:

1. Contract/Task Order number, Project title

2. Contract Type, dollar value, and location of the work performed

3. If work was performed as a Prime or Sub-contractor

4. Project Completion Date (or indicate if ongoing)

5. Description of any licenses/qualifications required for performance

6. Clear description of the size, scope, and complexity of the work performed for the project and the project’s similarity to the requirements of the RFP. The Government is not bound by the Offeror’s opinion in determining similarity.

7. How the company’s learning and experience from the project will provide value to the Government.

2.4 The prior experience confidence rating, as defined in the table below, is the evaluation of the Offeror’s demonstrated ability to successfully perform the contract’s requirements, based on Prior Experience information.

3. FACTOR 2 – PAST PERFORMANCE

3.1 For each project submitted for prior experience, Offerors shall provide a reference for the Offeror familiar with the project who can confirm the quality of the Offeror’s work on the project. Offerors shall submit any CPARS data for a project, if applicable. References shall include the following items:

1. Contract/Task Order number, Project title

2. Name, telephone numbers, and e-mail for the reference

3.2 The Government may also use other information available from Government sources to evaluate an Offeror’s past performance. The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the Offeror.

3.3 The past performance confidence rating, as defined in the table below, is the evaluation of the Offeror’s demonstrated ability to successfully perform the contract’s requirements, based on past performance information.

Rating Description

High Confidence Based on the Offeror’s prior experience record, the Government has high confidence that the Offeror understands the requirement and will be successful in performing the work.

Some Confidence Based on the Offeror’s prior experience record, the Government has reasonable confidence that the Offeror understands the requirement and will be successful in performing the work.

Low Confidence Based on the Offeror’s prior experience record, the Government has low confidence that the Offeror understands the requirement and will be successful in performing the work.

No Confidence Based on the Offeror’s prior experience record, the Government has no confidence that the Offeror understands the requirement and will be successful in performing the work.

Rating Description Substantial Confidence

Based on the Offeror’s performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.

3.4 Adverse Past Performance is defined as Past Performance information that supports 1) a less than satisfactory rating; or 2) any unfavorable comments received from sources without a formal rating system that cause evaluator concern. When a performance record indicates performance problems, the Government will consider the number and severity of the problems and the appropriateness and effectiveness of any corrective actions taken (not just planned or promised). The Government may review more recent contracts or performance evaluations to ensure corrective actions have been implemented and to evaluate their effectiveness. In accordance with FAR 15.306(b)(4), if a competitive range is to be established, communications must be held with any Offeror who will be excluded from competition because of adverse Past Performance information, unless the Offeror has previously had the opportunity to comment on such information.

3.5 Offerors without a record of Past Performance or for whom information on Past Performance is not available will not be evaluated favorably nor unfavorably, and as a result, will receive a “Neutral Confidence” rating for this Factor.

SECTION 01 00 00 - GENERAL REQUIREMENTS

The following have been modified:

GENERAL REQUIREMENTS

010100 SCOPE OF SERVICES

1. SCOPE OF SERVICES

1.1. The Contractor shall provide all management, labor, material, equipment, transportation, supervision, and environmental and quality controls, to accomplish simultaneous maintenance, sustainment, repair, and minor construction projects at the following locations: Naval Surface Warfare Center Dahlgren Division (NSWCDD);

Pumpkin Neck Annex Explosive Experimental location in King George, VA; NSWCDD Dam Neck Activity (DNA) in Virginia Beach, VA; Surface Warfare facilities at Wallops Island on the Eastern Shore, VA; and NSWCDD facilities located at the Naval Observatory in Washington, DC.

1.2. In addition to standard maintenance, sustainment, repair, and minor construction, the following are considered within the scope of this contract:

a) Field surveying of sites to document existing conditions (e.g. utilities, grading, sidewalks, etc.), and mapping of new site conditions required to update GIS (graphic information system).

Limited Confidence

Based on the Offeror’s performance record, the Government has a low expectation that the Offeror will successfully perform the required effort.

No Confidence Based on the Offeror’s performance record, the Government has no expectation that the Offeror will be able to successfully perform the required effort.

Unknown Confidence (Neutral)

No performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

b) Soil boring sampling at potential work sites; analyzing the samples and providing test reports to the

Government in determining soil-bearing capacity of a given site.

c) Sampling and testing of potential existing hazardous construction materials (e.g. lead paint, flooring mastic, pipe insulation, etc.). Providing test reports to the Government documenting materials sampled.

d) Performing and providing engineering analysis and evaluations to determine the structural or electrical capacity to support mission equipment.

e) Providing energy computations for infrastructure solutions including: energy or thermal performance of wall and roof systems; projecting energy performance of new systems (e.g. new boiler, AHU, hot water heater, etc.)

1.3. Work performed under this contract will be complex in nature, and require multiple disciplines working simultaneously to include coordination with Architect-Engineer (A-E) Contractors as necessary. All such work shall be accomplished in strict accordance with all applicable Navy and local instructions, processes, and procedures and applicable building and life safety code requirements.

2. HOURS OF OPERATION

Normal working hours at all locations are Monday through Friday, 0600 to 1700. Work shall not occur outside those hours unless previously approved by the Contracting Officer, or specified in a Task Order. In the event that Government testing schedules interfere with the Contractor’s planned work schedule, and that interference will cause a delay in schedule or increase in price, notify the Contracting Officer immediately.

010200 TASK ORDER PROCESS

1. ORDERING PROCEDURES

1.1. All subsequent Task Orders under this Multiple Award Construction Contract (MACC) will be awarded as Firm-Fixed-Price (FFP). The Government will utilize either a Best Value Tradeoff or Lowest Price Technically Acceptable (LPTA) process in award decisions as deemed appropriate by the Government for each individual Task Order. The Contracting Officer may decide to award a non-competitive Task Order after consideration of:

1. Contract minimums

2. Urgency of requirement

3. Capacity to perform

1.2. For competitive Task Orders, the Contracting Officer will issue a Task Order Request (TOR) to the MACC once construction projects are identified. The TOR will include all specifications necessary for the Contractor to adequately bid on the work, as well as the disclosure of magnitude as required by FAR 36.204. TORs will be issued in accordance with Simplified Acquisition Procedures to the maximum extent practicable.

1.3. A site visit will be scheduled as necessary to review and clarify the requirements of the TOR, verify existing conditions, and obtain whatever measurements and information are necessary to develop a complete and accurate Task Order Proposal (TOP).

1.4. Each Contractor’s ability to meet quality standards and delivery requirements based on their past performance under previous Task Orders will be considered. This past performance will be documented in the Quality Assurance Surveillance Plan (QASP) assessment for each Task Order. Contractors who fail to meet the specification and schedule requirements of individual Task Orders may be suspended or removed from further participation in the MACC IDIQ. A single “Unsatisfactory” rating may not result in disqualification from the MACC, unless the unsatisfactory performance is so egregious that it is in the Government’s best interest, as determined by the PCO. Two consecutive “Unsatisfactory” performances, or multiple “Unsatisfactory” performances across a single one year period (365 day period) may result in disqualification from the MACC, if deemed in the Government’s best interest, as determined by the PCO.

2. CONTRACTOR PROPOSALS

An acceptable TOP shall consist of the following:

2.1. Cover Sheet: Each TOP cover sheet shall include contract number, project number, project title, contact information for the Contractor, performance period, assumptions, exceptions, and the date to which the proposal will be valid. At a minimum each proposal shall be valid for 120 calendar days unless a longer period is requested in the

TOR.

2.2. Price: An electronic copy of the Contractor’s pricing, with sufficient data to substantiate pricing (data other than certified cost or pricing). The Government reserves the right to request additional pricing information after receipt and evaluation of proposals.

2.3. Project Schedule: Each TO proposal shall include a brief critical path schedule, taking into account the major work elements, mobilization, material delivery times, anticipated weather delays, and final inspection. The proposed timeline should be of sufficient detail to demonstrate that the Offeror can meet the Governments proposed Period of Performance (PoP).

3. PERIOD OF PERFORMANCE

3.1. If the Government has a maximum PoP it will be stated in the TOR. If not the Contractor can propose a PoP using the brief critical path schedule. The PoP shall start on the TO award date. The calculated PoP is made up of the following:

Pre-Construction Period: Not more than 30 calendar days. Time allotted to the Contractor to submit insurance and bonding information, submission of preconstruction submittals required by specifications, and onsite mobilization.

Physical Construction: Varies by TO. Time allotted to the Contractor to complete all construction activities required by the TO.

Project Closeout: Not more than 30 calendar days. Time allotted to the Contractor to prepare all project close out submittals and submit application for final payment.

4. EVALUATION

The Government will evaluate TOPs based on criteria stated in the TOR.

5. COMMENCEMENT OF WORK

5.1. TOs will be issued by the Contracting Officer using the Department of Defense (DD) Form 1155, Order for Supplies and Services. Each TO will include the following information:

Date of Task Order;

Contract Number and Task Order Number;

Item Number, description, material submittal requirements, quantity and unit prices for items and total;

Task order price and delivery or performance date;

Accounting and appropriation data;

Liquidated damage, if any; and;

Any statement of work, drawings or other pertinent data.

5.2. The Contracting Officer will issue Notice to Proceed NTP after receipt and approval of all required pre-construction submittals. In rare circumstances, on projects deemed emergencies, the Contracting Officer may issue verbal direction prior to the issuance of the written TO. In those circumstances, the NTP shall be the date the Contractor received the verbal NTP from the Contracting Officer with written notification to follow with seventy-two (72) hours.

010300 SAFETY

1. SAFETY

1.1. The Contractor shall comply with the requirements of NSWCDD, Department of the Navy (DON), and DOD safety policies and practices currently in force and all subsequent revisions. Established policies, directives, and guidance relating to safe operating practices and personnel safety are mandatory and shall be complied with at all times. The Contractor shall monitor and observe all activities and personnel to ensure strict adherence and compliance to applicable standard operating procedures and safety procedures. The Contractor shall observe all applicable technical, safety, and policy requirements as applies to the handling of hazardous materials.

1.2. The Contractor shall address and comply with all applicable workplace and work environment conditions for compliance with the intent and letter of Federal, State, local and DoD Occupational Safety and Health laws and regulations, policies, and practices.

1.3. All operations are subject to DOD/DON/NSWCDD safety inspections. The Contractor shall support NSWCDD annual safety and environmental facility audits and data collection efforts. The Contractor shall be responsible to correct any deficiencies noted in the annual inspection.

2. ENVIRONMENTAL AND HAZARDOUS MATERIALS HANDLING

2.1 The Contractor, suppliers, and Sub-contractors shall comply with all certification, licensing, and training requirements for all federal, state, and local laws and regulations with respect to the handling and disposal of hazardous materials.

2.2 The Contractor shall create a Hazardous Material Management Plan (HMMP) (CDRL A002) at locations where the Contractor disposes of hazardous materials such as batteries; fluorescent tubes, caulking tubes, and refrigerant.

Contractor shall utilize hazardous materials collection points or Government collection centers for discarded hazardous material.

2.3 Asbestos and lead‐based paint assessments may be required on this contract to determine the presence of hazardous material during demolition or at utility points of connections. Work on and around waterfront structures, including under deck and underwater, and work in confined spaces may be required on this contract. The Contractor shall be able to accept work that involves asbestos, lead paint, Poly‐Chlorinated Biphenyls (PCB) s, and other hazardous materials, work on and under waterfront structures, and in confined spaces.

3. ON-SITE SAFETY REQUIREMENTS

(a) The Contractor shall strictly adhere to Federal Occupational Safety and Health Agency (OSHA) Regulations, Environmental Protection Agency (EPA) Regulations, and all applicable state and local requirements.

(b) The Contractor shall ensure that each Contractor employee reads the document entitled, "Occupational Safety and Health (OSH) Policy Statement" within 30 days of commencing performance at NSWCDD. (c) The Contractor shall provide each Contractor employee with the training required to do his/her job safely and in compliance with applicable regulations. The Contractor shall document and provide, upon request, qualifications, certifications, and licenses as required.

(d) The Contractor shall provide each Contractor employee with the personal protective equipment required to do their job safely and in compliance with all applicable regulations.

(e) Contractors working with ionizing radiation (radioactive material or machine sources) must comply with NAVSEA S0420-AA-RAD-010 (latest revision)(provided upon request). Prior to bringing radioactive materials or machine sources on base, the Contractor must notify the Command Radiation Safety Officer in the Safety & Environmental Office.

(f) The Contractor shall ensure that all hazardous materials (hazmat) procured for NSWCDD are procured through or approved through the hazmat procurement process. Hazmat brought into NSWCDD work spaces shall be reviewed and approved by the Safety& Environmental Office prior to use by submitting an Authorized Use List addition form and Safety Data Sheet that shall be routed through the Government supervisor responsible for the specific work area.

(g) Upon request, the Contractor shall submit their OSHA 300 Logs (injury/illness rates) for review by the Safety Office. If a Contractor's injury/illness rates are above the Bureau of Labor & Statistics Industry standards, a safety assessment will be performed by the Safety Office to determine if any administrative or engineering controls can be utilized to prevent further injuries/illnesses or if any additional PPE or training will be required.

(h) Applicable Contractors shall submit Total Case Incident Rate (TCIR) and Days Away, Restricted, Transfer (DART) rates for the past three (3) years upon request by the Safety Office. A Contractor meets the definition of applicable if its employees worked 1,000 hours or more in any calendar quarter on site and where oversight is not directly provided in day-to-day activities by the command.

(i) The Contractor shall report all work-related injuries/illnesses that occurred while working at NSWCDD to the Safety Office.

(j) The Contractor shall ensure that all on-site Contractor work at NSWCDD is in accordance with the NSWCDDINST 5100.1D Occupational Safety and Health Instruction, available at:

2. PORTABLE ELECTRONIC DEVICES

2.1 Non-Government and personally owned portable electronic devices (PEDs) are prohibited in all NSWCDD buildings with the exception of personally owned cell phones which are authorized for use in spaces up to and including Controlled Access Areas. The Contractor shall ensure the onsite personnel remain compliant with this PED policy. NSWCDD instruction defines PEDs as the following: any electronic device designed to be easily transported, with the capability to store, record, receive or transmit text, images, video, or audio data in any format via any transmission medium. PEDs include, but are not limited to, pagers, laptops, radios, compact discs, and cassette players/recorders. In addition, this includes removable storage media such as flash memory, memory sticks, multimedia cards and secure digital cards, micro-drive modules, ZIP drives, ZIP disks, recordable CDs, DVDs, MP3 players, iPad, digital picture frames, electronic book readers, kindle, nook, cameras, external hard dish drives, and floppy diskettes.

2.2 PEDs belonging to an external organization shall not be connected to NSWCDD networks or infrastructure without prior approval from the NSWCDD Information Assurance and Compliance Branch. This approval will be granted using the TARIS form and action tracker process.

2.3 Personally owned hardware or software shall not be connected or introduced to any NSWCDD hardware, network, or information system infrastructure.

4. OPERATIONS SECURITY (OPSEC)

4.1. The Contractors (including Sub-contractors) shall supplement their current security practices by requiring any personnel involved in executing this contract to complete Government-sponsored and administered Operations Security (OPSEC) training. In addition, the Contractor shall be aware of the Critical Information List (CIL) for the organization they are supporting as well as the OPSEC plan for NSWCDD. Upon contract award, all identified Contractors and Sub-contractors shall sign a Contractor's conformance statement and submit it to the NSWCDD COR thereby acknowledging that they will meet the requirements of this contract. The COR shall contact their Department Training Coordinator to schedule key employees to attend the Government- sponsored OPSEC training.

The Contractor shall immediately notify the Government upon the discovery of any nonconformance with the OPSEC Plan.

010500 GENERAL REQUIREMENTS

1. PROJECT REQUIREMENTS

1.1. Each Task Order (TO) will specify the project requirements. The following are required in all TOs:

a) Procuring all construction equipment, materials, and documentation necessary for timely completion of projects. The Contractor shall maintain all certification and re-certification equipment paperwork; inspection records (QA/QC form filled out by Government TPOC to inspect prior to small projects, attached to SR ticket); and permits and licenses for heavy equipment operation.

b) Providing a project schedule at the beginning of each Task Order. A Government approved scheduled is required prior to commencing work on any project. The Contractor shall be required to maintain the construction schedule throughout the duration of the project and adjust the schedule accordingly based on any project delays or efficiencies incurred throughout the course of the project.

c) Conducting a site visit prior to commencing work in order to verify existing conditions; coordinating with

NSWCDD/NAVFAC to confirm location and type of existing utilities at buildings or sites that may be impacted by construction work.

d) Regularly inspecting all work to ensure it is in accordance with all project requirements, design documents, and safety requirements.

e) Obtaining all permits and regulatory approvals required to perform work (ex: Virginia Department of

Environmental Quality, VDEQ).

f) Operation and Maintenance Support Information (OMSI): Providing training to the Government on operating and maintaining all critical systems. The Contractor shall submit to the Government all O&M manuals at the conclusion of each Task Order.

2. REGULATIONS

2.1 All work performed under this contract shall be performed following applicable Government plans, standards, policies, and processes. The Contractor’s activities shall conform to the systems test and operations environment and standards including all updates, improvements, and additions to these process documents made over the life of the contract. The Contractor shall use the Department of Defense (DoD) Unified Facilities Criteria (UFC) for facilities and infrastructure construction and modification. All documentation shall be developed within the software environment specified by the Government, Microsoft Office toolset and other specific tools and environments as stipulated in each Task Order. Deviations from these processes, policies, and procedures are not authorized without advance approval by the COR.

2.3. The Contractor shall comply with the requirements of NAVSEA and NSWCDD instructions / manuals found at https://wwwdd.csd.disa.mil/program/Security_Office/index.html regarding performance in Government facilities.

2.4. Contractor Personnel

The Contractor shall employ a sufficient number of qualified personnel to adequately perform and oversee all work under this contract. When work is performed at any site, the assigned Lead (i.e. Superintendent, Supervisor, Foreman, etc.) or an appointed alternate shall be available as a liaison for the Government. Any appointed alternate shall be authorized to act on behalf of the contractor.

2.5. Employee Equipment

Contractor shall provide all required Personal Protective Equipment (PPE) and any special equipment required for safe and timely completion of projects. Certain Safety items will need to be approved by NSWCDD Base Safety prior to use (example: safety harness for fall protection).

2.6. Employee Requirements

The Contractor shall ensure that the employees and Sub-contractor employees have current, valid licenses and certifications necessary to perform their functions. Any cost or time associated with obtaining licenses or certifications shall be at the Contractor’s expense. Training necessary to ensure that personnel performing under this contract maintain the knowledge and skills to successfully perform the required functions is the responsibility of the Contractor. The Contractor shall ensure manufacturer certified maintenance personnel perform maintenance and repair on mechanical and electrical critical systems in accordance with this PWS.

2.7. Employee Conduct

The Base Commander has authority to refuse access to any person working under this contract for reasons of misconduct, security, or if found to be or suspected to be under the influence of alcohol, drugs, or any other incapacitating agent (ref. 18 U.S.C.1382 (1972)). Assignment, transfer, and reassignment of Contractor personnel shall be at the discretion of the Contractor. However, when the Government directs, the Contractor shall remove from contract performance any person who endangers life, property, or national security through improper conduct.

All Contractor personnel engaged in work while on Government property shall be subject to the Standards of Conduct contained in SECNAVINST 5370.2J. All persons engaged in work while on Government property shall be subject to search of their persons (no bodily searches) and vehicles at any time by the Go1vernment, and shall report any known or suspected security violations to the appropriate Security Department.

2.8. Employee Required Training

The Contractor shall have personnel certified in Hazard Communication (HAZCOM). On a Task Order basis, contractor personnel may be required to take training mandated by NSWCDD. Examples include but are not limited to Anti-Terrorism Training, Annual NSWCDD environmental awareness, Privacy Training, and Information Assurance Training.

3. MANDATORY REQUIREMENTS

The Mandatory Requirement shall be maintained throughout the life of the Contract. The mandatory requirement is as follows:

Requirement 1: Facility Location:

The Prime Contractor’s primary facility providing support to this requirement must be located within 100 miles of NSWCDD in Dahlgren, VA.
