CONTROLLED UNCLASSIFIED INFORMATION (CUI)
1. DEFINITION. Controlled Unclassified Information is defined as unclassified information meeting standards for safeguarding and dissemination controls pursuant to law, regulations, and government-wide policies under Executive Order 13556, which establishes a uniform program for designation of information meeting the standards for CUI, uses standardized marking, and ensures information is only controlled when needed.
2. CATERGORIES OF CUI. CUI consists of the following;
For Official Use Only (FOUO) information;
Privacy Act Information (See PII attachment);
Department of State Sensitive But Unclassified (SBU) information;
Department of Defense (DoD) and Department of Energy (DoE) Unclassified Controlled Nuclear Information (UCNI);
Drug Enforcement Administration (DEA) Sensitive Information;
Foreign Government Information (FGI);
Unclassified Navy Nuclear Propulsion Information (U-NNPI); and
National Geospatial Intelligence Agency Limited Distribution Information
3. GENERAL GUIDANCE: Controlled Unclassified Information (CUI) such as FOUO, Security Classification Guides (SCG), and other information with Distribution Statements B thru F, are not authorized for public release and cannot be placed on a publicly accessible web site or web server.
a. Distribution statements for classified documents will be determined by the Security Classification Guide used to mark the document.
b. All technical data provided to the contractor by the government will be protected from public disclosure in accordance with the markings contained therein.
c. Any material produced under the terms of this contract will be classified directly from the source document(s) from which it was obtained. It will be marked with the most restrictive downgrading/declassification statement contained in such documents.
4. TRANSMITTAL. All emails containing such information or attachments must be appropriately marked, and digitally signed and encrypted if being transmitted within Navy networks, or outside a Navy network to an approved contractor email address. All transmissions to personal email accounts (AOL, Yahoo, Hotmail, Comcast, etc.) are prohibited.

5. OFFSITE HANDLING. The contractor shall provide adequate physical protection to such information as to preclude access by any person or entity not authorized such access by the government.
6. DISCLOSURE POLICY: All other information relating to the items to be delivered or services to be performed under this contract may not be disclosed by any means without prior approval of the authorized representative of the contracting officer. Dissemination or public disclosure includes, but is not limited to, permitting access to such information by foreign nationals or by any other person or entity; publication of technical or scientific papers; advertising; or any other proposed public release. Due to the sensitivity of this program, no classified material received or generated under this contract will be transferred to any other contractor or agency without the approval of the Contracting Officer or Contracting Officer’s Representative (COR).
7. FACILITY VISITS: All visit requests for contractor personnel visiting NSWCDL shall meet the following requirements;
a. Requests must be sent through the Joint Personnel Adjudication System (JPAS), under SMO code 001785 for GENSER and 001783 for SCI.
b. Visit requests for Contractor Personnel not submitted via JPAS shall be faxed to the COR, TPOC or the respective department administrative office no later than five (5) working days prior to the intended visit for NEED-TO-KNOW certification. All requests shall contain the information required by Chapter 6, NISPOM, and shall not exceed 12 months.
c. Visit requests for subcontractors to other activities will have a NEED-TO-KNOW certified by the prime contractor.
d. Information on this contract is not releasable to personnel possessing limited (reciprocal) clearances without the written approval of NSWCDD.

Section 01 00 00 - General Requirements
GENERAL REQUIREMENTS
01010 SCOPE OF SERVICES
1. SCOPE OF SERVICES
1.1. The Contractor shall provide all management, labor, material, equipment, transportation, supervision, and environmental and quality controls, to accomplish simultaneous maintenance, sustainment, repair, and minor construction projects at the following locations: Naval Surface Warfare Center Dahlgren Division (NSWCDD);
Pumpkin Neck Annex Explosive Experimental location in King George, VA; NSWCDD Dam Neck Activity (DNA) in Virginia Beach, VA; Surface Warfare facilities at Wallops Island on the Eastern Shore, VA; and NSWCDD facilities located at the Naval Observatory in Washington, DC.
1.2. In addition to standard maintenance, sustainment, repair, and minor construction, the following are considered within the scope of this contract:
a) Joint scoping of project requirements between the Contractor and NSWCDD Government to jointly identify project requirements for individual Task Orders.
b) Field surveying of sites to document existing conditions (e.g. utilities, grading, sidewalks, etc.), and mapping of new site conditions required to update GIS (graphic information system).
c) Soil boring sampling at potential work sites; analyzing the samples and providing test reports to the
Government in determining soil-bearing capacity of a given site.
d) Sampling and testing of potential existing hazardous construction materials (e.g. lead paint, flooring mastic, pipe insulation, etc.). Providing test reports to the Government documenting materials sampled.
e) Performing and providing engineering analysis and evaluations to determine the structural or electrical capacity to support mission equipment.
f) Providing energy computations for infrastructure solutions including: energy or thermal performance of wall and roof systems; projecting energy performance of new systems (e.g. new boiler, AHU, hot water heater, etc.)
1.3. Work performed under this contract will be complex in nature, and require multiple disciplines working simultaneously to include coordination with Architect-Engineer (A-E) Contractors as necessary. All such work shall be accomplished in strict accordance with all applicable Navy and local instructions, processes, and procedures and applicable building and life safety code requirements.
2. HOURS OF OPERATION
Normal working hours at all locations are Monday through Friday, 0600 to 1700. Work shall not occur outside those hours unless previously approved by the Contracting Officer, or specified in a Task Order. In the event that
Government testing schedules interfere with the Contractor’s planned work schedule, and that interference will cause a delay in schedule or increase in price, notify the Contracting Officer immediately.
01020 TASK ORDER PROCESS
1. ORDERING PROCEDURES
1.1. All subsequent Task Orders under this Multiple Award Construction Contract (MACC) will be awarded as
Firm-Fixed-Price (FFP). The Government will utilize either a Best Value Tradeoff or Lowest Price Technically
Acceptable (LPTA) process in award decisions as deemed appropriate by the Government for each individual Task
Order. The Contracting Officer may decide to award a non-competitive Task Order after consideration of:
1. Contract minimums
2. Urgency of requirement
3. Capacity to perform
1.2. For competitive Task Orders, the Contracting Officer will issue a Task Order Request (TOR) to the MACC once construction projects are identified. The TOR will include all specifications necessary for the Contractor to adequately bid on the work, as well as the disclosure of magnitude as required by FAR 36.204.
1.3. A site visit will be scheduled as necessary to review and clarify the requirements of the TOR, verify existing conditions, and obtain whatever measurements and information are necessary to develop a complete and accurate
Task Order Proposal (TOP).
2. CONTRACTOR PROPOSALS
An acceptable TOP shall consist of the following:
2.1. Cover Sheet: Each TOP cover sheet shall include contract number, project number, project title, contact information for the Contractor, performance period, assumptions, exceptions, and the date to which the proposal will be valid. At a minimum each proposal shall be valid for 120 calendar days unless a longer period is requested in the
RFP.
2.2. Price: An electronic copy of the Contractor’s pricing, with sufficient data to substantiate pricing (data other than certified cost or pricing, ref. FAR 52.215-20 Alt IV). The Government reserves the right to request additional pricing information after receipt and evaluation of proposals.
2.3. Project Schedule: Each TO proposal shall include a brief critical path schedule, taking into account the major work elements, mobilization, material delivery times, anticipated weather delays, and final inspection. The proposed timeline should be of sufficient detail to demonstrate that the Offeror can meet the Governments proposed Period of
Performance (PoP).
3. PERIOD OF PERFORMANCE
3.1. If the Government has a maximum PoP it will be stated in the TOR. If not the Contractor can propose a PoP using the brief critical path schedule. The PoP shall start on the TO award date. The calculated PoP is made up of the following:
Pre-Construction Period: Not more than 30 calendar days. Time allotted to the Contractor to submit insurance and bonding information, submission of preconstruction submittals required by specifications, and onsite mobilization.
Physical Construction: Varies by TO. Time allotted to the Contractor to complete all construction activities required by the TO.
Project Closeout: Not more than 30 calendar days. Time allotted to the Contractor to prepare all project close out submittals and submit application for final payment.
4. EVALUATION
The Government will evaluate TOPs based on criteria stated in the TOR.
5. COMMENCEMENT OF WORK
5.1. TOs will be issued by the Contracting Officer using the Department of Defense (DD) Form 1155, Order for
Supplies and Services. Each TO will include the following information:
Date of Task Order;
Contract Number and Task Order Number;
Item Number, description, material submittal requirements, quantity and unit prices for items and total;
Task order price and delivery or performance date;
Accounting and appropriation data;
Liquidated damage, if any; and;
Any statement of work, drawings or other pertinent data.
5.2. The Contracting Officer will issue Notice to Proceed NTP after receipt and approval of all required pre-construction submittals. In rare circumstances, on projects deemed emergencies, the Contracting officer may issue verbal direction prior to the issuance of the written TO. In those circumstances, the NTP shall be the date the
Contractor received the verbal NTP from the Contracting Officer with written notification to follow with seventy-two (72) hours.
01030 SAFETY
1. SAFETY
1.1. The Contractor shall comply with the requirements of NSWCDD, Department of the Navy (DON), and DOD safety policies and practices currently in force and all subsequent revisions. Established policies, directives, and guidance relating to safe operating practices and personnel safety are mandatory and shall be complied with at all times. The Contractor shall monitor and observe all activities and personnel to ensure strict adherence and compliance to applicable standard operating procedures and safety procedures. The Contractor shall observe all applicable technical, safety, and policy requirements as applies to the handling of hazardous materials.
1.2. The Contractor shall address and comply with all applicable workplace and work environment conditions for compliance with the intent and letter of Federal, State, local and DoD Occupational Safety and Health laws and regulations, policies, and practices.
1.3. All operations are subject to DOD/DON/NSWCDD safety inspections. The Contractor shall support NSWCDD annual safety and environmental facility audits and data collection efforts. The Contractor shall be responsible to correct any deficiencies noted in the annual inspection.
2. ENVIRONMENTAL AND HAZARDOUS MATERIALS HANDLING
2.1 The Contractor, suppliers, and Sub-contractors shall comply with all certification, licensing, and training requirements for all federal, state, and local laws and regulations with respect to the handling and disposal of hazardous materials.
2.2 The Contractor shall create a Hazardous Material Management Plan (HMMP) (CDRL A002) at locations where the Contractor disposes of hazardous materials such as batteries; fluorescent tubes, caulking tubes, and refrigerant.
Contractor shall utilize hazardous materials collection points or Government collection centers for discarded hazardous material.
2.3 Asbestos and lead‐based paint assessments may be required on this contract to determine the presence of hazardous material during demolition or at utility points of connections. Work on and around waterfront structures, including under deck and underwater, and work in confined spaces may be required on this contract. The Contractor shall be able to accept work that involves asbestos, lead paint, Poly‐Chlorinated Biphenyls (PCB) s, and other hazardous materials, work on and under waterfront structures, and in confined spaces.
01040 SECURITY
1. SECURITY
This contract may require access of classified information up to and including Secret. The Contractor shall possess a
Secret Clearance and their employees requiring access to classified information shall be eligible to possess a security clearance. The Department of Defense Contract Security Classification Specification (DD Form 254)
(Exhibit A) will provide the security classification requirements for each Task Order. The Contractor shall obtain personnel Interim Secret security clearances prior to starting to work on tasks requiring clearances. Access to classified spaces and material and generation of classified material shall be in accordance with the relevant DD
Form 254. All Contractor personnel requiring unescorted access to NSWCDD facilities shall be required to possess and maintain a minimum of a Secret security clearance.
2. Portable Electronic Devices
2.1 Non-Government and personally owned portable electronic devices (PEDs) are prohibited in all NSWCDD buildings with the exception of personally owned cell phones which are authorized for use in spaces up to and including Controlled Access Areas. The Contractor shall ensure the onsite personnel remain compliant with this
PED policy. NSWCDD instruction defines PEDs as the following: any electronic device designed to be easily transported, with the capability to store, record, receive or transmit text, images, video, or audio data in any format via any transmission medium. PEDs include, but are not limited to, pagers, laptops, radios, compact discs, and cassette players/recorders. In addition, this includes removable storage media such as flash memory, memory sticks, multimedia cards and secure digital cards, micro-drive modules, ZIP drives, ZIP disks, recordable CDs, DVDs, MP3 players, iPad, digital picture frames, electronic book readers, kindle, nook, cameras, external hard dish drives, and floppy diskettes.
2.2 PEDs belonging to an external organization shall not be connected to NSWCDD networks or infrastructure without prior approval from the NSWCDD Information Assurance and Compliance Branch. This approval will be granted using the TARIS form and action tracker process.
2.3 Personally owned hardware or software shall not be connected or introduced to any NSWCDD hardware, network, or information system infrastructure.
3. Electronic Spillages
3.1. Electronic spillages (ES) are unacceptable and pose a risk to national security. An electronic spillage is defined as classified data placed on an information system (IS), media or hardcopy document possessing insufficient security controls to protect the data at the required classification level, thus posing a risk to national security (e.g., sensitive compartmented information (SCI) onto collateral, Secret onto Unclassified, etc.). The Contractor's performance as it relates to ES will be evaluated by the Government. ES reflects on the overall security posture of the Government and a lack of attention to detail with regard to the handling of classified information of IS security discipline and will be reflected in the Contractor's performance rating. In the event that a Contractor is determined to be responsible for an ES, all direct and indirect costs incurred by the Government for ES remediation will be charged to the Contractor.
3.2 NSWCDD Command Security will continue to be responsible for the corrective action plan in accordance with the security guidance reflected on the Department of Defense (DOD) Contract Security Classification Specification -
DD254. Command Security will identify the Contractor facility and contract number associated with all electronic spillages during the investigation that involve Contractor support. Command Security will notify the Contracts
Division with the Contractor facility name and contract number, incident specifics and associated costs for cleanup.
The Contracting Officer will be responsible to work with the Contractor Facility to capture the costs incurred during the spillage clean up. The Contractor is also responsible for taking Information Security Awareness training annually, via their Facility Security Officer (FSO), as part of the mandatory training requirements.
4. Operations Security (OPSEC)
4.1. The Contractors (including Sub-contractors) shall supplement their current security practices by requiring any personnel involved in executing this contract to complete Government-sponsored and administered Operations
Security (OPSEC) training. In addition, the Contractor shall be aware of the Critical Information List (CIL) for the organization they are supporting as well as the OPSEC plan for NSWCDD. Upon contract award, all identified
Contractors and Sub-contractors shall sign a Contractor's conformance statement and submit it to the NSWCDD
COR named in block 13 of the DD 254 thereby acknowledging that they will meet the requirements of this contract.
The COR shall contact their Department Training Coordinator to schedule key employees to attend the Government-sponsored OPSEC training. The Contractor shall immediately notify the Government upon the discovery of any nonconformance with the OPSEC Plan.
01050 GENERAL REQUIREMENTS
1. PROJECT REQUIREMENTS
1.1. Each Task Order (TO) will specify the project requirements. The following are required in all TOs:
a) Procuring all construction equipment, materials, and documentation necessary for timely completion of projects. The Contractor shall maintain all certification and re-certification equipment paperwork; inspection records (QA/QC form filled out by Government TPOC to inspect prior to small projects, attached to SR ticket); and permits and licenses for heavy equipment operation.
b) Providing a project schedule at the beginning of each Task Order. A Government approved scheduled is required prior commencing work on any project. The Contractor shall be required to maintain the construction schedule throughout the duration of the project and adjust the schedule accordingly based on any project delays or efficiencies incurred throughout the course of the project.
c) Conducting a site visit prior to commencing work in order to verify existing conditions; coordinating with
NSWCDD/NAVFAC to confirm location and type of existing utilities at buildings or sites that may be impacted by construction work.
d) Regularly inspecting all work to ensure it is in accordance with all project requirements, design documents, and safety requirements.
e) Obtaining all permits and regulatory approvals required to perform work (ex: Virginia Department of
Environmental Quality, VDEQ).
f) Operation and Maintenance Support Information (OMSI): Providing training to the Government on operating and maintaining all critical systems. The Contractor shall submit to the Government all O&M manuals at the conclusion of each Task Order.
2. REGULATIONS
2.1 All work performed under this contract shall be performed following applicable Government plans, standards, policies, and processes. The Contractor’s activities shall conform to the systems test and operations environment and standards including all updates, improvements, and additions to these process documents made over the life of the contract. The Contractor shall use the Department of Defense (DoD) Unified Facilities Criteria (UFC) for facilities and infrastructure construction and modification. All documentation shall be developed within the software environment specified by the Government, Microsoft Office toolset and other specific tools and environments as stipulated in each Task Order. Deviations from these processes, policies, and procedures are not authorized without advance approval by the COR.
2.2. All projects under this contract shall comply with the most recent edition of applicable federal, state, and local laws, codes, and regulations including but not limited to the following (any exception must be approved in writing by the CO):

2.3. The Contractor shall comply with the requirements of NAVSEA and NSWCDD instructions / manuals found at https://wwwdd.csd.disa.mil/program/Security_Office/index.html regarding performance in Government facilities.
2.4. Contractor Personnel
The Contractor shall employ a sufficient number of qualified personnel to adequately perform and oversee all work under this contract. When work is performed at any site, the assigned Lead (i.e. Superintendent, Supervisor, Foreman, etc.) or an appointed alternate shall be available as a liaison for the Government. Any appointed alternate shall be authorized to act on behalf of the contractor.
2.5. Employee Equipment
Contractor shall provide all required Personal Protective Equipment (PPE) and any special equipment required for safe and timely completion of projects. Certain Safety items will need to be approved by NSWCDD Base Safety prior to use (example: safety harness for fall protection).
2.6. Employee Requirements
The Contractor shall ensure that the employees and Sub-contractor employees have current, valid licenses and certifications necessary to perform their functions. Any cost or time associated with obtaining licenses or certifications shall be at the Contractor’s expense. Training necessary to ensure that personnel performing under this contract maintain the knowledge and skills to successfully perform the required functions is the responsibility of the
Contractor. The Contractor shall ensure manufacturer certified maintenance personnel perform maintenance and repair on mechanical and electrical critical systems in accordance with this PWS.

2.7. Employee Conduct
The Base Commander has authority to refuse access to any person working under this contract for reasons of misconduct, security, or if found to be or suspected to be under the influence of alcohol, drugs, or any other incapacitating agent (ref. 18 U.S.C.1382 (1972)). Assignment, transfer, and reassignment of Contractor personnel shall be at the discretion of the Contractor. However, when the Government directs, the Contractor shall remove from contract performance any person who endangers life, property, or national security through improper conduct.
All Contractor personnel engaged in work while on Government property shall be subject to the Standards of
Conduct contained in SECNAVINST 5370.2J. All persons engaged in work while on Government property shall be subject to search of their persons (no bodily searches) and vehicles at any time by the Go1vernment, and shall report any known or suspected security violations to the appropriate Security Department.
2.8. Employee Required Training
The Contractor shall have personnel certified in Hazard Communication (HAZCOM). On a Task Order basis, contractor personnel may be required to take training mandated by NSWCDD. Examples include but are not limited to Anti-Terrorism Training, Annual NSWCDD environmental awareness, Privacy Training, and Information
Assurance Training.
3. Mandatory Requirements
All Mandatory Requirements shall be maintained throughout the life of the Contract. The mandatory requirements are as follows:
Requirement 1: Facility Security Clearance:
The Contractor’s primary facility for supporting this contract is required to have and maintain a Facility Security clearance of SECRET. No safeguarding of classified material is authorized at the Contractor’s facility.
Requirement 2: Personnel Security Clearances:
All personnel assigned to this contract shall possess, and maintain at a minimum, SECRET security clearances. An interim SECRET (S) clearance is acceptable.
Requirement 3: Facility Location:
The Prime Contractor’s primary facility providing support to this requirement must be located within 100 miles of
NSWCDD in Dahlgren, VA.
01060 CONTRACT DATA REQUIREMENTS LIST (CDRL)
1. CDRL A001 – CONTRACTOR’S PERSONNEL ROSTER
Within ten business days of Task Order issue, the Contractor shall submit a list of all employees working on the project to the Contracting Officer. This list shall include each employee's name, work assignment, and confirmation of a Secret level security clearance. Changes to the personnel list shall be submitted at least ten business days in advance. In emergency situations and cases of adverse actions where ten business days’ notice is not possible, the
Contractor shall submit the required information regarding the change in writing to the Contracting Officer
Representative (COR) not later than 24 hours after the replacement employee is on board.
2. CDRL A002 – HAZARDOUS MATERIALS MANAGEMENT PROGRAM (HMMP) PLAN
The Contractor shall submit a Hazardous Material Management Plan (HMMP) as addressed in paragraph 2.2 of
Section 01010.
3. CDRL A003 – MONTHLY STATUS REPORT
Contractor shall provide a Monthly Status Report for each project in which the support was provided. The report shall discuss major impacts, issues, and steps for remediation of issues, proposals to improve operational efficiencies, effectiveness, quality, or the customer experience.
Projected Task Order Completion schedule – This should be the CDRL
01070 CONSTRUCTION WAGE RATE DETERMINATION
Construction Wage Determination(s) shall be current and site specific to each order and incorporated at the time the order is placed.
