About this file

This document is a solicitation amendment for MK152 cushion kits. The Naval Surface Warfare Center, Indian Head Division seeks to award a firm-fixed price contract for the fabrication of cushion foam used to simultaneously ship four pieces of ordnance loaded at their facility. Vendors capable of providing the required cushion kits must identify their capabilities within ten days of this synopsis publication, including the solicitation number in any responses. Questions should be directed to the named contracting officer. The associated North American Industry Classification System code is for flexible polyurethane foam product manufacturing and the Product Service Code relates to packing and packaging supplies.

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

SUMMARY OF CHANGES

The purpose of this amendment is to 1) answer questions received in response to the solicitation issuance, and 2) extend the solicitation closing date, as follows:

1. Questions received in response to the solicitation issuance are answered below:

Question 1: Firm Fixed Pricing for Option Years - Is this negotiable or can the contract provide for economic price adjustment?

a. Due to the volatility of the cost of raw material for this project, there is concern of major market spikes of more than 5%.

b. If no provision for economic price adjustment can be made, is it acceptable to add a clause to our proposal such as: "X RETAINS THE RIGHT TO ADJUST PRICES IN THE EVENT OF NATURAL

DISASTER OR FORCE MAJEURE THAT RESULTS IN RAW MATERIAL INCREASES OF

MORE THAN 5%".

c. If neither of these options, is there a generally accepted price increase range per option year if we factor into the price the expected increase in the cost of raw material?

Answer 1: The Government has determined that a FFP contract is the most appropriate for this requirement, and is not including EPA clauses at this time. Offerors are to provide the Government with their best competitive pricing submission for the base year and all options.

Question 2: The solicitation references NSWC Indian Head Technical Drawings - are these different and separate from the DOD drawings? If so, can those also be made available?

Answer 2: Yes, the NSWC Indian Head Technical Drawings are separate from the DoD drawings. The NSWC Indian Head Technical Drawings were distributed via DoD Safe 21 February 2024.

Question 3: We did not respond to the initial "sources sought" announcement - are we still able to submit a proposal for this solicitation?

Answer 3: Yes, response to the initial sources sought announcement is not required to submit a proposal for this solicitation.

Question 4: After reviewing the drawings, we require some clarification on the material called out on them: A-A- 59136, Class 1, Grade D, Type 1: Flame spread index shall not exceed 125 and shall be tested per ASTM E 162.

Specific optical density shall not exceed 400 and shall be tested. Per ASTM E 662. Color similar to Blue/Gray, Color No. 35109 in accordance with FED-STD 595.

N0017424R0022

Some of the requirements appear to be pointing to the FRAS2 material, which has a density of 2.2-2.3 pcf. You’ll note at the bottom of the FRAS2 spec sheet it states the foam meets the flame-retardant requirements of: CID A-A- 59136, Class 1, Grade D, Type I, and FAR 25/853(a). However, this spec does not specifically address Optical Density and Flame Spread. This material is described as Blue/Green.

If you review the FRAS9# spec, it meets A-A-59136 Class 1 & 3, Grade D, Type V. This material spec specifically mentions the Optical Density (under 400 per ASTM E 662). It also mentions Flame Spread under 225 per ASTM E

162. (However, the Flame spread for the FRAS9# has a flame spread of <225, not 125 per the drawing requirements.) This material is described as Blue/Gray.

Can you please advise if one (or both) materials attached meet the customer's material need? See attachments.

Answer 4: FRAS9# from ‘Sealed Air Re Image‘ would work.

Our drawing states 225 flame index and the vendor had questions that if the flame index on the foam is below 225 but not quite 125, would that be alright and the answer is yes. The foam has quite a good density and meets our specs. The flame index for this foam type would be between 125-225 and we are good with that.

Additionally, we have previously accepted Type I, Class I, Grade C, coated with anti static solution per drawing #2645188 to meet grade D of A-A-59136. Color of material available at the time was black not blue/grey as stated in the drawing. This alternative solution doesn’t need to be pursued in this case, but thought to share for sake of general knowledge and exchanging ‘learned lessons’ with the vendor.

Question 5: For this solicitation, what are the base and option years? Also, is it a definite quantity solicitation?

Answer 5: The base and all option years are for 12-month periods; therefore if all options are exercised, this would be a five (5) year contract. Quantities in the RFP are Maximum quantities that would be ordered per year as noted in Section B.

As of the date of this Amendment issuance, there are additional questions that have been asked to which we are still awaiting technical feedback. Therefore, another amendment is forthcoming.

2. The solicitation closing date is extended

FROM:

4 March 2024 3:00pm EST

TO:

12 March 2024, 3:00pm EST.

3. All other terms remain unchanged.

4. Direct questions to Diane Hicks at diane.d.hicks.civ@us.navy.mil.
