About this file

This document contains a justification and approval for a sole source federal contract award and the associated solicitation. The justification and approval is for a $602,250 sole source contract to Pacific Scientific Energetic Materials to produce initiators for the MK 70 Booster and GQM-163A Target Missile Program. It cites 10 U.S.C. 2304(c)(1) and FAR 6.302-1 as the authority for the sole source award, noting that Pacific Scientific is the only approved source and qualifying a second source would impose schedule delays, increased costs, and target delays for Navy customers. The Department of the Navy Naval Sea Systems Command issued a solicitation for MK 70 initiators to fulfill this sole source requirement and support the MK 70 Booster and GQM-163A target program.

J&A Number:FY20-MAY14-60 Code: 022KT

The total estimated cost of the proposed contract action is $602,250. There will be no options.

Estimated Dollar Value1 FY2022 Totals

WPN $602,250.00

Total $602,250.00

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1). As implemented by Federal Acquisition Regulation (FAR) 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

Pacific Scientific Energetic Materials is the only approved source to produce initiators for the MK 70 Booster and GQM- 163A Target Missile Program. Qualifying a second source imposes production schedule delays, increased, unfunded, and duplicative costs, and target delays delivered to the US Navy customer base. In order to qualify a second source it would cost approximately $240k which is not expected to be recovered by competition. Qualifying another source would also involve the cost of consulting with to update their requirements as they hold the configuration management rights for these items.

Initiators are currently required to build the target program inventory. If the Government is unable to provide the required GQM-163A booster inventory, several major ACAT ID programs for both the Navy and Army as well as FMS customers will be unable to perform Developmental and Operational and Live Fire testing of weapon systems against threat representative assets to validate effectiveness or will be unable to provide the necessary assets to meet Fleet training requirements. Shortages in either testing or training will impact Fleet readiness and the ability to execute their mission and acquisition milestone requirements.

Test and Evaluation Fleet customers include: AEGIS, CG, LSD, LCS and DDG Mods, LHA-8, DDG 1000, CVN-78 and 79, SM-2, SM- 6, CIWS, RAM, ESSM, JSF, E-2D and Hyper-velocity Gun Weapons System (HGWS) as well as Army and FMS customers, J&A Number:FY20-MAY14-60 Code: 022KT

Training customers include: Fleet Forces (N7). Given current build inventories we will run out of boosters half way through FY 20. Given contract and manufacturing lead times, there is insufficient time to qualify a new source. Any delays in contracting or production will negatively impact the fleet.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

To further broaden market research and to satisfy the requirements of DFARS PGI 206.302-1(d), a Sources Sought notice was posted on beta.Sam.gov on February 11, 2020. The posting yielded no results.

The proposed action was synopsized on the Federal Business Opportunities (FEDBIZOPS) website 10 June 2020. No companies expressed interest in the requirement.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable by using cost and price analysis techniques described in FAR Part 15.4.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWC IHD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC IHD will assess whether competition for future requirements is feasible.
