About this file
This document is a Non-Competitive Procurement Justification Memo from Naval Surface Warfare Center Carderock Division (NSWCCD), dated 24 July 2025. Code 635 is requesting thirteen modified and five unmodified MIL-PRF compliant military Li6T batteries from BREN-TRONICS for lab testing, with delivery expected by September 11th. The procurement is being conducted under the simplified acquisition threshold, with justification based on brand name and exclusive licensing agreements, as Bren-tronics has established proprietary design and processes required to satisfy stringent military requirements.
The USMC is specifically fielding the Bren-tronics Li6T battery for their LVSR Anti-Idle retrofit kit (ARK), and requires a uniquely developed battery variant that will be tested and qualified. The battery has a National Stock Number (NSN) but cannot be obtained through the Defense Logistics Agency (DLA) due to the need for modified batteries. The procurement is being conducted as a sole source action, with the contracting officer certifying the facts and representations are complete and accurate to the best of their knowledge.

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025
MEMORANDUM FOR FILE
FROM:
CODE: 635
TO: Code 02 DATE: 24 July 2025 SUBJECT: Non-Competitive Procurement Justification Memo for Actions Under SAT
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. FAR 8.405-6 allows for limiting sources for orders or BPAs under Federal Supply Schedules under certain circumstances or for items peculiar to one manufacturer
3. As required by FAR 13.106-3(b)(3)(i), FAR 8.405-6(a)(1), or FAR 8.405-6(b)(2), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE (Include manufacture/sole source name and address.)
Code 635 requires thirteen modified and five unmodified MIL-PRF compliant military Li6T batteries from BREN-TRONICS intended for use in lab testing, costing $ including shipping costs. They are expected to be delivered by September 11th.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
A. BRAND NAME. The item required must be a brand name product, or feature of a product, particular to one manufacturer.
