SECTION M - EVALUATION FACTORS FOR AWARD

CNIN-M-0011 BEST VALUE EVALUATION – PAST PERFORMANCE (APR 2014)

a) The contract resulting from this solicitation will be awarded to that offeror whose offer, conforming to the solicitation requirements, is determined to be technically acceptable and provide the “best value” to the Government. The “best value” determination will be based on the merits of the offer and the offeror’s capability. The “best value” may not necessarily be the proposal offering the lowest cost, nor receiving the highest past performance rating. As specified in the FAR 52.215-1 “Instructions to Offerors--Competitive Acquisition” provision, the Government intends to evaluate proposals and award a contract without discussions.

An offer must be acceptable for the offeror to be eligible for award. OFFERS THAT DO NOT CONFORM

TO THE REQUIREMENTS STATED HEREIN MAY BE DETERMINED UNACCEPTABLE AND

MAY BE REJECTED WITHOUT FURTHER EVALUATION.

b) Proposals will be evaluated for technical acceptability/unacceptability and rated and ranked on past performance and price as listed in the factors below. It should be noted that cost/price does not have a finite numerical weight. Evaluation factors (other than cost/price) are more important than cost/price. However, cost is an important factor and should be considered when preparing proposals. The Government reserves the right to award to a lower cost offeror when the offers are considered essentially equal in terms of past performance or when specific past performance associated with a superior offer do not support any associated cost or price premium. In summary, cost/price/past performance tradeoffs will be made.

c) The offeror’s proposal shall be in the format prescribed by, and shall contain a response to, each of the areas identified in Section L. The order of relative importance for the evaluation factors is established as follows:

FACTOR I – PAST PERFORMANCE

FACTOR II – PRICE

d) Factor I (Past Performance) is more important than Factor II (Price). Factor II, Price will not be rated but will be considered in determining the “Best Value” to the Government. Past Performance information may be evaluated upon receipt prior to the closing date of the solicitation.

e) Offerors must meet the standard for FAR 9.104 for responsibility to be eligible for award. The Government may conduct a Pre-Award Survey as part of this source selection. Results of any survey will be evaluated to determine each Offeror’s capability to meet the requirements of the solicitation. Any such survey may also be used to verify statements and representations made in the Offeror’s proposal. The purpose of a pre-award survey is to obtain information not available to the contracting officer to make a responsibility determination prior to contract award.

STANDARDS FOR EVALUATION:

Technical Acceptability:

a. The technical information submitted as Volume I in accordance with CNIN-L-0011 will be reviewed to determine the technical acceptable/unacceptable rating based on the technical and delivery requirements of the solicitation.

b. The following ratings for Technical Evaluation will apply as set forth below.

Technically Acceptable – Proposal clearly meets the minimum requirements of the solicitation.

Technically Unacceptable – Proposal does not clearly meet the minimum requirements of the solicitation.

FACTOR I: PAST PERFORMANCE

The Government will assess each offeror’s and proposed significant subcontractor’s past performance. The assessment will be an unbiased judgment about the quality of an offeror’s past performance. The Government will use its subjective assessment to make a comparative assessment of an offeror’s capability. Past performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with the Specification, Drawings, Statement of Work, Performance Work Statement, contract schedule and contract terms and conditions.

Past performance is also a measure of the risk of performance associated with the offeror.

The Government will assess the offeror's past performance in the areas of:

(1) Quality of Product or Service

(2) Schedule

(3) Customer Satisfaction

The Government may base its judgment about the quality of an offeror’s past performance on:

(1) Records of objective measurements and subjective ratings of specified performance attributes, if available, and

(2) Statements of opinion about the quality of specific aspects of an offeror’s performance, or about the quality of an offeror’s overall performance.

The Government may solicit information from an offeror’s customers and business associates; Federal, state and local government agencies and databases; and from other persons and organizations. The Government reserves the right to limit the number of references it decides to contact and to contact references other than those provided by the offeror. The evaluation will take in account the same type of information regarding significant subcontractors proposed in the offeror’s proposal.

The Contracting Officer is not responsible for locating or securing any information not furnished with the offer.

The SSA/Contracting Officer may, however, utilize all available information, including information not provided by the offeror, in the past performance evaluation. The Government reserves the right to review less than all information submitted, and to only analyze sufficient information to make a reasonable determination of each offeror’s past performance rating. If insufficient information regarding the offeror’s corporate history is available, the offeror is encouraged to submit for evaluation, evidence of relevant past performance on the part of the offeror’s key/principal employees, as either a prime- or sub-contractor.

Past performance is assessed by the SSA/Contracting Officer and is assigned adjectival ratings in the evaluation.

There are two aspects to the past performance evaluation:

The first is to evaluate the offeror’s past performance to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. The criteria to establish what is recent and relevant shall be unique to each source selection and shall be stated in the solicitation. In establishing what is relevant for the acquisition, consideration should be given to those aspects of an offeror’s contract history that would give the greatest ability to measure whether the offeror will satisfy the current procurement. Common aspects of relevancy include similarity of service/support, complexity, dollar value, contract type, and degree of subcontract/teaming. Each offeror will be given an adjectival rating on past performance relevance: relevant or not relevant.

The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation gathers information from customers on how well the offeror performed those past contracts. The Past Performance information will be reviewed to determine the quality and usefulness as it applies to performance confidence assessment. Each offeror will be given an adjectival rating on past performance confidence: substantial confidence, satisfactory confidence, limited confidence, no confidence, unknown confidence. Offerors who do not have recent/relevant performance record available to the Contracting Officer will be rated Unknown Confidence (Neutral).

Offerors that have no record of past performance (i.e., new businesses) must submit a signed and dated statement to that effect. If an offer submits a certification statement and the Government has no information available regarding the offeror’s past performance, that offeror will receive a neutral rating (i.e., the offeror is evaluated neither favorably nor unfavorably) for past performance. If offerors (prime and significant subcontractors) provide reference information that is deemed not relevant and current as defined in Section L, the offeror will receive a neutral past performance rating for those contracts.

FACTOR II: COST/PRICE

A Cost/Price Proposal shall be submitted for the supplies/services set forth in Section B of this solicitation.

Evaluation of an offeror’s proposal shall be based on the information presented in the proposal and information available to the Contracting Office from sources deemed appropriate. Sources typically considered include Defense Contract Audit Agency office, Defense Contract Management Command, other contracts with the same firms for similar items or services, known commercial sources such as Global Insight Inc. (formally Data Resources, Inc.), Standard and Poor, etc. Proposals which are unrealistic in terms of technical or schedule commitments, or unrealistically high or low in terms of cost/price, may be deemed reflective of an inherent lack of technical competence, or indicative of a failure to comprehend the complexity of risks of the proposed work and may be grounds for rejection of the proposal. The quality of organization and attention to detail reflected in the business proposal will be considered to be an indication of the quality of organization and level of capability during contract performance. Subjective judgment on the part of the government evaluators is implicit in the entire process.

a) Proposals will be evaluated for price reasonableness. Cost/Price evaluation will be based on the total cost offered for all line items. Estimated ordering quantities will be used to develop an evaluated total price for the comparison to the government estimate, when applicable, and other offers in the competitive range.

b) Price: CLINS 0001 – 0002 and CLINs 0005 – 0006 pricing will be evaluated for price reasonableness. Price (CLINS 0005 & 0006) will be evaluated by finding the total evaluated price (TEP) for each CLIN. The TEP for each CLIN will be determined by applying proposed unit prices against estimated ordering quantities for each item over the five year ordering period. The total evaluated prices for each CLIN will then be added to the First Article totals (CLINS 0001 & 0002) to determine an overall evaluated price for the proposal. The overall evaluated price will be used for the comparison to other offers.

INDUSTRY QUESTIONS

QUESTION 1:

Seems to be a conflict between "max lot size" and "required deliveries." Max lot size includes test units. For an LAT 80 each is required which would leave 9,920 for delivery. This is less than the required 10,000 every 120 days.

It would require two lots, with associated testing, to achieve the 10,000 unit delivery. Should the delivery lot size be 9,920 or should require test units be in excess of the 10,000 units needed for a Lot delivery, increasing max lot size allowance?

ANSWER:

The maximum lot size is dictated by WS 25510E, paragraph 4.4. The maximum lot size of 10,000 units does include the 80 signals for LAT, leaving a deliverable qty of 9,920 ea. for each lot. Each follow-on lot will also require LAT and will be a maximum of 10,000 units including 80 signals for LAT testing. Each lot will have a maximum deliverable qty of 9,920 units.

QUESTION 2:

Please clarify the MK 79 FAT requirements. Isn't it a duplication of the MK 80 FAT for the same MK 80 portion of the requirement as specified?

ANSWER:

The MK 79 FAT requirements will consist of verifying packaging and marking of the units and containers as well as the functional requirements set forth in WS 25510E for the MK 80 Signal. It is different from the MK 80 requirements from the packaging and marking standpoint.

QUESTION 3:

The MK 31 specification references a FAT for the MK 31. The solicitation / contract specifies a MK 79 FAT and a MK 80 Signal FAT with no mention of a MK 31. Is there an independent FAT required for the MK 31 Projector (launcher)?

ANSWER:

Yes, the MK 31 Projector must be subjected the FAT requirements set forth in WS 1903F. The MK 31 projectors for FAT have been added to the MK 79 FAT units CLIN descriptions.

QUESTION 4:

Specification WS25510E (Prime Item Fabrication Specification Signal, Hand Fired, Mark 80 Mod 2), , Table 1.

shows no candle power sample for LAT, although the note located under 4.4b states to "note the inclusion of flare cup assemblies for candle power testing".. but there are none so noted. Can you confirm there is no candle power testing required in the LAT? Is there a specific color requirement (measurement) for FAT?

ANSWER:

There is no candlepower requirement for LAT, only FAT. There is no specific color requirement for FAT, just that the performance requirements of paragraph 3.5.1 are met.

QUESTION 5:

Drawing 6136000 Rev J (Signal, Hand Fired (Red) MK 80 MOD 2) - (C1) Note 9 - [Color coding shall be applied in accordance with MIL-STD-709], USING Item 8. Ink shall withstand 14 day Temperature and Humidity test per MIL-STD-331, Test 105, be legible and hold color after test. Question: How often is a T&H test required? As a critical, is it required of every signal? Or, is this requirement fulfilled during First Article and A Plan T&H testing?

ANSWER:

Typically, contractors would verify prior to submission of FAT and/or LAT that this requirement can be fulfilled, however this requirement is officially tested/verified during FAT and/or LAT. Each signal is not required to go through T&H, just the sample IAW the specification.

QUESTION 6:

Drawing 2112951 Rev V (Projector, Signal, Surface MK 31 MOD 0) - Note 7 - Ink shall withstand 14 day Temperature and Humidity test per MIL-STD-331, Test C1, be legible and hold color after test. Question: How often is a T&H test required? Is this requirement fulfilled during First Article and A Plan T&H testing?

ANSWER:

Typically, contractors would verify prior to submission of FAT and/or LAT that this requirement can be fulfilled, however this requirement is officially tested/verified during FAT and/or LAT. Each signal is not required to go

QUESTION 7:

Drawing 6136006 Rev F (Bag, Re-sealable)- Note 5 - Marking shall withstand 14 Day Temperature and Humidity Test per MIL-STD-331, Test C1, be legible and hold color after test. Question: How often is a T&H test required?

Typically, contractors would verify prior to submission of FAT and/or LAT that this requirement can be fulfilled, however this requirement is officially tested/verified during FAT and/or LAT. Each signal is not required to go

QUESTION 8:

Drawing SA-2522956 (Test Plug For Projector, Signal, Surface MK 31 MOD 1) is included in the ADL for MK 31 MOD 0. This is the drawing for the MK 31 MOD 1. Question: Shouldn't Drawing SA-2522955 (Test Plug For Projector, Signal, Surface MK 31 MOD 0) be in the ADL/Drawing package rather than SA-2522956?

ANSWER:

You are correct. SA2522956 is for use on the MK 31 MOD 1 Projector only and those were never produced. The correct reference is SA 2522955 (for the MK 31 MOD 0 Projector should be used in lieu of SA 2522956).

QUESTION 9:

WS 1903 Rev F (Prime Item Fabrication Specification Projector, Signal, Surface MK 31 MOD 0 MK 31 MOD 1) -

4.5.1.1 Four test plugs shall be tested with each projector. Question: Does the contractor supply the Test Plugs (per SA-2522955) for FAT (800 each) and LAT's (1,260 or 1,156 each)?

No, the Government has test plugs available. The contractor will only need to furnish projectors for FAT and LAT.

QUESTION 10:

Page 13 of Solicitation, HQ-C-2-0027 FIRST ARTICLE (GOVERNMENT TESTING) (NAVSEA) (SEP 1990) states "until after the Contractor has fully tested it, at its expense, to determine compliance with said requirements and it has been preliminarily accepted by the Contract Administration Office." Does this imply the full conducting of a FAT event at the Contractors facility (including all dimensional and functional testing) prior to sending the FAT sample for Government testing? Or, is does this statement just represent the standard dimensional inspection requirements associated with FAT (DCMA covered) prior to shipping to the Government for functional testing?

ANSWER:

The latter is correct. Preliminary inspection (dimensions, processes, etc.) will be performed by DCMA and functional testing will be performed by the Government at the Government facility.
