SECTION 3.0 - CLAUSES BY REFERENCE

The following have been added by reference:

52.225-1 Buy American Act--Supplies MAY 2014

SECTION 5.0 - INSTRUCTIONS & PROVISIONS

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The evaluation process will consist of two parts; Go/No Go evaluation of Product Samples and then full proposal (including Product Samples) evaluation for those offerors who’s Product Samples pass the Go/No Go criteria evaluation (PS/14/JXQR/126 paragraph 3.2.1.1, Image Intensifier Assemblies;

P/S paragraph 3.2.1.7, Helmet Mount Interface; P/S paragraph 3.3.1, Weight; P/S paragraph 3.3.2, Configuration; P/S paragraph 3.3.3, Interoperability with Modular Integrated Communications Helmet (MICH), AN/PAS-29 (COTI), and SOF Dovetail Helmet Mounts; P/S paragraph 3.3.4, Compatibility with Protective Gear). As part of the technical evaluation, laboratory measurements and field tests may be used to determine product compliance with the performance specifications. An offeror whose proposal that has either product sample fail to meet any of the performance specifications Go/ No Go requirements will be rejected and both the product samples and the written technical proposals will not be further evaluated or considered for award. The proposal(s) whose product samples pass all Go/No Go requirements tests will be subjected to an evaluation of the entire proposal in accordance with (IAW) the requirements of the solicitation.

1. GO/NO-GO CRITERIA

Offerors shall ensure that the two product samples submitted are functional working units and are the exact units being proposed by the offeror to satisfy the requirements in the solicitation. If an offeror submits a defective product sample or the product sample malfunctions during testing it will not be returned to the offeror for rework or replacement.

Resubmission of product sample(s) will not be allowed after the closing date of the solicitation. Failure to meet all Go/No-Go criteria will render the offer technically unacceptable, the offer will not be further evaluated and the offer will be ineligible for award.

The following items are the specification requirements which are considered Go/No-Go criteria:

**The annotated PS paragraph for each item below refers to PS/14/JXQR/127**

IMAGE INTENSIFIER ASSEMBLIES (PS 3.2.1.1)

The BNVD shall utilize, at a minimum, two 16 or 18 mm image intensifier tubes that comply with the BNVD Image Intensifier Tube Assembly Performance Specification, PS/14/JXQR/126.

HELMET MOUNT INTERFACE (PS 3.2.1.7)

The BNVD shall include a dovetail style helmet mount interface as illustrated in drawing NVG001.

WEIGHT (PS 3.3.1)

The weight of the BNVD with internal battery, lens covers (see 3.2.5), sacrificial filters (see 3.2.3), demist shields (see 3.2.2) and/or screw-on eyepiece diopter attachments, if applicable (see 3.3.25), installed shall be no more than: 500 g (T); 450 g (O).

CONFIGURATION (PS 3.3.2)

The BNVD shall be a binocular device with independent Near Infrared (NIR) sensor channels for the SOF Operator’s left and right eye to provide optimal depth perception capability.

INTEROPERABILITY WITH MODULAR INTEGRATED COMMUNICATIONS HELMET

(MICH), AN/PAS-29 (COTI), AND SOF DOVETAIL HELMET MOUNTS (PS 3.3.3)

The BNVD shall be interoperable and non-interfering with the AN/PAS-29 (COTI), and existing SOF dovetail helmet mounts, when installed on the MICH helmet. This applies to any cables, mounts, and battery packs required to operate either the BNVD or the COTI. The interface between the BNVD and the COTI shall not display any mechanical interferences and the BNVD and COTI shall remain fully functional and operationally effective while installed on the helmet mount interface.

NOTE: The offeror may utilize the existing AN/PVS-15A bracket interface (Refer to the COTI mounting bracket drawing; 12712-5500) or may design their own bracket that will interface the BNVD to the currently fielded AN/PAS-29 (Refer to the COTI mounting shoe drawing; 12712-5501).

COMPATIBILITY WITH PROTECTIVE GEAR (PS 3.3.4)

The BNVD switches and controls shall be functional while wearing gloves and must accommodate all hand sizes and will be conducted at ambient temperature. The specified glove for use with this requirement is Flyers Summer Glove, NSN: 8415-01-029-0113.

2. PROPOSAL EVALUATION

In addition to the product samples, the offerors shall submit a written proposal in response to the factors and subfactors described in the solicitation in such detail to allow the Government to evaluate the proposal and the image tube data sheets for each of the product samples. The following factors shall be used to evaluate offers:

FACTOR I – Technical/Risk Capability SUBFACTORS

A. Product Sample Evaluation B. Written Performance & Specification Compliance Matrix C. Statement of Work Compliance D. Small Business Participation

FACTOR II – Price

FACTOR III – Past Performance

The evaluation factors and associated subfactors for the award decision are listed in descending order of importance below. Factor I is significantly more important than Factor II, and Factor I is significantly more important than Factor III. Factor II is significantly more important than Factor III. Factor I and Factor III when combined, are significantly more important than Factor II (Price). The price factor becomes more important as the degree of equality of Factors Other Than Price increases, or when the price is so significantly high as to diminish the value of the technical superiority to the Government.

Under Factor I, Technical/Risk Capability, Subfactor A is significantly more important than Subfactor B, Subfactor B is significantly more important than Subfactor C. Subfactor C is significantly more important than Subfactor D.

Pricing will be evaluated based upon both an examination of the unit pricing proposed and the estimated delivery order quantities per year, multiplied by the offered price for that quantity range, all years summed, to arrive at an evaluated total price.

Price will not be rated, but will be considered in determining the "best value" to the Government. Under Factor III, Past Performance information may be evaluated upon receipt prior to the closing date of the solicitation. The Government may use past performance information obtained from other than the sources identified by the offeror and that the information obtained will be used for both the responsibility determination and the best value decision. The best value determination may result in the Government being willing to pay more for higher technical capability.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
