52.215-20 REQUIREMENTS FOR CERTIFIED COST OR PRICING DATA OR INFORMATION
OTHER THAN CERTIFIED COST OR PRICING DATA (OCT 2010)—ALTERNATE IV (OCT 2010)
(a) Submission of certified cost or pricing data is not required.
(b) Provide data described below:
The offeror shall submit data other than certified cost or pricing data and supporting information required to substantiate the cost and price reasonableness of the proposed costs in the Attachment 1 Pricing Model. This information will be used as a mechanism to evaluate cost realism and price reasonableness of the submitted offer.
Any information submitted must support the cost proposed. Include sufficient detail or cross references to clearly establish the relationship of the information provided to the cost proposed. Support any information provided by explanations or supporting rationale, as needed to permit the Contracting Officer and authorized representatives to evaluate the documentation.
PART I--COST LABOR INFORMATION:
(1) Current, actual unloaded rates are to be submitted for any "proposed individual." A "proposed individual" is defined as a current employee specifically proposed to perform an estimated number of hours for a labor category.
In accordance with the offeror's disclosed estimating system practices, average unloaded direct labor rates may be submitted for all remaining labor categories/hours, i.e. those labor categories/hours not accounted for under the proposed individual’s data. Do not submit composite rates encompassing more than one labor category. This cost information shall include, as a minimum, the cost data elements contained in Attachment 1, Pricing Model used by both the Prime and proposed Subcontractors. Offerors should include additional elements such as overtime rates/hours, premium time rates/hours, etc. as applicable.
All labor categories shall be escalated, as applicable, for rates crossing the offeror’s calendar year during the period of performance identified in Attachment 1, Pricing Model. For the labor categories identified in Attachment 1, Pricing Model, offerors shall use actuals, if known, or rates based on historical data, standard practice, or those accepted by DCAA for proposal purposes. The narrative to the Cost/Price Proposal must include supporting rationale for the escalation rate proposed.
(2) As discussed in the FAR 52.237-10 “Identification of Uncompensated Overtime” provision, hourly rates submitted shall be derived by dividing the proposed individual’s actual annual salary by 2080 hours, which is based on a 40-hour work week. Any uncompensated overtime proposed shall be clearly identified by labor category within your cost proposal. If uncompensated overtime is proposed, the adjusted hourly rate shall be applied to all proposed hours. Uncompensated overtime will be evaluated in accordance with the FAR 52.237-10 “Identification of Uncompensated Overtime” provision in Section L of this solicitation.
(3) All labor categories to be used in the performance of the proposed contract shall be included in the Attachment 1, Pricing Model.
PART II--REQUIREMENT FOR DATA OTHER THAN CERTIFIED COST OR PRICING DATA:
In accordance with FAR 15.403-3(b), the following information as prescribed below is required for the purposes of assisting the Contracting Officer in determining the cost realism and price reasonableness of competing offers. The terms “Cost Realism” and “Data Other Than Certified Cost or Pricing Data” are defined in FAR 2.101.
Offerors shall provide copies of correspondence from DCAA or DCMA regarding the most recent approval of rates and/or systems, such as Forward Pricing Rate Agreements (FPRAs), Forward Pricing Rate Recommendations (FPRRs), Provisional Billing Rates (PBRs), and Accounting System Approval (if applicable). If available, provide any updated forward pricing rate information submitted to DCAA/DCMA for review. The correspondence and all attachments (FPRAs, FPRRs, etc.) should be provided in the Cost/Price Proposal submission.
DIRECT LABOR - The labor categories intended for use under this contract (also reference PWS paragraph 3.1.2 Personnel Requirements and Position Descriptions) are provided in Attachment 1, Pricing Model. Identify the labor rates and total cost for each labor category proposed for the period of performance identified in Attachment 1, Pricing Model. The labor specified under this category shall only be for both the prime contractor’s direct labor costs and any proposed subcontractor efforts as illustrated in the Attachment 1 Pricing Model. Since this solicitation requires work to be performed at both the contractor and Government sites, the proposal must include your company policy concerning any stipulations as to when Government site / contractor site rates are effective.
Supporting data for the proposed direct labor rates, for both the prime and any subcontractor efforts, may be recent actual direct labor rates evidenced by payroll records, and/or paystubs, Letters of Intent (LOIs), forward pricing proposals/agreements, or salary survey data. If providing LOIs, the offeror and/or its subcontractor(s) shall include the direct hourly labor rate for the proposed employee, identify the position, submit the LOI on the offeror’s letterhead with both the prospective employee's and the employer signatures, and state that the LOI is for N00030- 20-R-0015. If providing a salary survey, offerors shall at a minimum, include for each applicable labor category the salary survey information in support of the proposed rates. The supporting salary survey data shall include at a minimum: screen shots that display the source of data used to develop the salary ranges, the job title and description (including education and experience) being surveyed, the geographic location the survey data is valid for, and a range of salary amounts with reference to applicability of amounts. In addition, if providing a salary survey, offerors shall utilize the 50th percentile at a minimum, and include the specific rationale utilized by the offeror in selecting the applicable percentile(s). Regardless of the basis used by the offeror in estimating direct labor costs, proposed labor categories should be mapped to the solicitation labor categories based on the job descriptions, education, and experience specified in PWS paragraph 3.1.2 Personnel Requirements and Position Descriptions.
(1) FRINGE BENEFITS - If applicable and in accordance with your normal accounting procedures, identify the fringe benefit rate(s) and total fringe benefit cost being proposed and identify the cost elements for which the fringe benefit rate is being applied.

Include the basis for the proposed amount. The decision as to whether costs are handled as direct or indirect costs rests with the offeror, but shall be consistent with the offeror’s approved cost accounting practices as disclosed in the Offeror’s Disclosure Statement, or consistent with the Offeror’s established accounting practices if the Offeror is not required to submit a Disclosure Statement.
B. INDIRECT COST - Identify any other indirect cost element (e.g., Facilities Capital Cost of Money) being proposed which has not been included above and identify the various cost elements for which the rate is applied.

(2) All representations and certifications executed as required by Section K for prime offerors (System for Award Management (SAM) will be used to obtain FAR representations and certifications).
Completion of annual representations and certifications via SAM is a requirement of solicitation provision 52.204-8, but it is not a sufficient response to Section K of the solicitation. All representations and certifications included in Section K must be completed, including DFARS provision 252.227-7017 which requires completion and signature even for a negative response. If any subcontractors are asserting data rights, those assertions should be included with the data assertions submitted by the prime contractor;

(4) Small Business Subcontracting Plan (only required from the prime large businesses- see paragraph below);

Offerors submitted analysis shall be based on their evaluation of their proposed subcontractor’s pricing data obtained as necessary to comply with the requirements of FAR 52.244-2. The Government will evaluate the FAR 52.244-2 submitted data to determine the viability for inclusion of these subcontractors in the contract award under FAR clause 52.244-2 only for offerors selected for award.
(7) OCI Mitigation Plan, as applicable. (Reference L-13). If included, please identify in your cover letter the inclusion of the OCI Plan.
L-8 SMALL BUSINESS SUBCONTRACTING PLAN
In accordance with FAR 19.7, large business prime offerors shall submit a “Small Business Subcontracting Plan” with the proposal. A subcontracting plan is not required from small business concerns. A copy of the current approved Master Plan with individual goals for this procurement, or an Individual Contract Plan with individual goals for this procurement shall be submitted as part of the Cost/Price Proposal for approval. The plan shall be submitted in accordance with the FAR 52.219-9 “Small Business Subcontracting Plan” clause and it’s Alternate II which outlines the information to be contained in the plan (i.e., separate goals for Small Business, HUBZone Small Business, Small Disadvantaged Business, Women-Owned Small Business, and Service-Disabled Veteran-Owned Small Businesses projected for each year of performance, etc.). If an offeror is a participant in the Test Program for Negotiation of Comprehensive Small Business Subcontracting Plans, submit a copy of your participant letter that identifies your effective date of participation.
In addition to the standard format as required by FAR 19.704, offerors are required to fill out the Subcontracting Plan Matrix included as Attachment 6 which is a supplement to the subcontracting plan requirements as set forth in FAR Part 19.7.
L-9 ESTIMATED LABOR HOURS
The quantities of labor hours for each Key and Non-key personnel labor category shown in the Attachment 1, Pricing Model, which are to be used by the offeror for computing total labor costs, represent the Government’s baseline estimate for evaluation of cost realism and price reasonableness. It is recognized that some of the labor category titles used in the solicitation may not exactly match the titles normally used in a particular company operation. Accordingly, in order to permit a rapid comparison, each proposal must provide the following:
(1) Attachment 1 Pricing Model, including labor rates and offeror’s normally used labor category title.
(2) A statement of any additional labor categories, estimated hours and related qualifications for labor cost that will be a direct cost based on the offeror’s accounting procedures (e.g. management and administrative labor costs). Offerors should include rationale explaining the basis for the number of labor hours per additional labor category. The offeror’s failure to identify or cost such additional labor categories shall result in those labor categories being deemed as mutually agreed upon unallowable costs pursuant to the provisions of FAR 31.201-6(a).
L-10 OTHER DIRECT COST (Travel Plug Number)
The Attachment 1 Pricing Model includes the Government's plug number for anticipated travel for the base and all option year efforts. This amount does not include any provision for G&A expense or other loading factors. Offerors shall use the stated amounts for Travel in the preparation of their cost proposals with no variation.
a. Consistent with Provision 52.215-20, Part II (5)A, the offeror shall identify and propose cost for additional elements of direct cost (i.e. computer usage, reproduction cost, etc.) to be incurred during the performance of the proposed contract consistent with the offeror’s Disclosure Statement or the offeror’s established accounting practices (if not required to submit a Disclosure Statement) and modify the Attachment 1 Pricing Model accordingly. The offeror’s failure to identify and cost such additional cost elements shall result in those cost elements being deemed as mutually agreed upon unallowable cost pursuant to the provisions of FAR 31.201-6(a).
L-11 UNCOMPENSATED OVERTIME AND PROFESSIONAL EMPLOYEES
Proposals that include hourly rates for exempt employees which are based on more than a 2,080 work-year shall be identified as Uncompensated Overtime as defined in the FAR 52.237-10 “Identification of Uncompensated Overtime” provision in this solicitation and evaluated in accordance with the “Uncompensated Overtime Evaluation” provision in Section M. Offerors are advised that the above plan will be used regardless of the methodology proposed or name given to the compensation plan (i.e., Total Time Accounting, Competitive Time Accounting, Compensated Overtime, or Standard Workweek). If an offeror decides to include uncompensated effort in their proposal, the following requirements shall be met and reflected in the proposal:
(a) As required by FAR 16.301-3 contractors must have an accounting system adequate for determining costs applicable to the contract that records all hours worked, including uncompensated hours, for all employees, and regardless of contract type. Failure to meet this requirement may result in the proposal being removed from consideration for contract award.
(b) Uncompensated hours, for all employees and regardless of contract type, shall be included in the offeror’s base for allocation of indirect costs and meet the requirements of Cost Accounting Standard (CAS) 418 “Allocation of Direct and Indirect Costs.”
(c) The proposed shall clearly identify hours of uncompensated effort proposed by labor category.
(d) The proposal shall clearly identify the amount of uncompensated effort that will be performed without supervision and without support personnel and shall assess the productivity of such effort. Additionally, clearly identify the means by which the offeror controls or schedules uncompensated overtime for its employees as well as where the uncompensated effort will be accomplished.
(e) The proposal shall describe the extent to which employees are required or encouraged to perform uncompensated effort and the impact the use of uncompensated effort has on work effectiveness.
(f) The proposal shall include a copy on the corporate policy addressing the uncompensated effort.
(g) The proposal shall include a separate, complete, cost breakdown, to the same level of detail as the breakdown supporting the cost proposal. The breakdown shall include direct labor rates for all direct labor categories based on the division by 2,080 of exempt employees actual annual salary, to represent a standard (as deemed by Fair Labor Standards Act) 40-hour week or 2,080 hour standard year. In addition, the breakdown shall include overhead rates and other costs based on employees working a standard 40-hour workweek or a 2,080 hour standard year. IT IS
THIS COST BREAKDOWN THAT WILL BE USED TO PERFORM THE COST REALISM PORTION OF THE
PROPOSAL EVALUATION.
(h) The requirements stated in paragraph (a) through (g) above shall be met for each subcontract which has uncompensated effort included in the proposal.
L-12 ESTIMATED EFFECTIVE AWARD DATE
For proposal purposes the estimated effective date of contract award is 1 October 2020. Offerors are requested to allow their offeror acceptance period to read at least 180 days.
L-13 NOTICE OF ORGANIZATIONAL CONFLICT OF INTEREST

(b) If applicable, prospective offerors are requested to furnish with their proposals information which may have a bearing on any existing or potential conflict of interest.

SECTION M - EVALUATION FACTORS FOR AWARD
M1. CLAUSES INCORPORATED BY FULL TEXT
52.217-5 EVALUATION OF OPTIONS (JUL 1990) (Variation)
The Government will evaluate offers for award purposes by adding the total cost and fixed fee for the options to the total cost and fixed fee for the basic requirement. Evaluation of the options will not obligate the Government to exercise the option.
M2. GENERAL INSTRUCTIONS
(a) The contract resulting from this solicitation will be awarded to the offeror whose proposal, conforming to the solicitation requirements, is determined to provide the “best value” to the Government. The “best value” determination will be based on the merits of the offeror’s proposal. The “best value” may not necessarily be the proposal offering the lowest cost, nor receiving the highest technical rating. The Government may reject any or all offers if such action is in the public interest and waive informalities and minor irregularities in offers received. The Government’s award decision will take into account the funding limitations that are applicable to this procurement.
PROPOSALS THAT DO NOT CONFORM TO THE REQUIREMENTS STATED HEREIN MAY BE
DETERMINED UNACCEPTABLE AND MAY BE REJECTED WITHOUT FURTHER EVALUATION.
(b) This is a subjective tradeoff source selection conducted in accordance with FAR Part 15. The Subjective Tradeoff Factors are listed in Section M-2. Award will not be made to an offeror whose proposal is rated Unacceptable for any of the subjective tradeoff factors.
(c) The Mandatory Requirements (Solicitation Compliance (Section M-3.1), Past Performance (Section M-3.2), Small Business Participation (Section M-3.3), and Key Personnel (Section M-3.4)) are not part of the subjective tradeoff and will be evaluated on an Acceptable/Unacceptable basis. Award will not be made to an offeror whose proposal is rated Unacceptable for any of the non-tradeoff Mandatory Requirements.
(d) The offeror’s proposal shall be in the format prescribed by, and shall contain a response to, each of the areas identified in Section L.
(e) The Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. The Government will not entertain alternate proposals.
M-3 SUBJECTIVE TRADEOFF FACTORS
