Paragraph 4.2.5 states “Upgrades or modifications shall never compromise the original safety/security requirements.”

Given that the paragraph is titled “Safety Program”, is the word “security” in this requirement referring to security requirements for the weapon system (i.e. cybersecurity and other security measures under program protection) or just those that were derived from safety requirements?

Section C paragraph 4.2.5 will be updated to remove the reference to security requirements.

Set 2 - 69 RFP * Pg 165, Section L, Paragraph 1.4

* Pg 204, Section L, Clause HQ L-2-0012 Use of Non-Developmentatl Items

In the answer to Draft RFP Question #49, the USG indicated that proposals including documents classified above the SECRET level would not be accepted and section 1.4 of the formal RFP states that the Government will not accept proposal documents that are classified above the SECRET level. On Page 204, in NAVSEA clause HQ L-2-0012, Use of Non-Developmental Items (NDI), the Navy has indicated a preference for NDIs in response to this solicitation. Due to existing USG requirements for these NDI weapons systems and derivative systems, there are classification constraints that are higher than the SECRET level. In an effort to allow the USG to capitalize on previous investments and consider those systems in response to the OTH-WS solicitation, and to avoid the imposition of overly-restrictive RFP terms, we respectfully request that the Government reconsider the allowance of classified document submission higher than the SECRET level and to allow offerors to coordinate this submission with the appropriate USG personnel.

Please see the Government's response to Question Set 1 - 55.

Set 2 - 70 RFP * Pg 204, Section L, Clause HQ L-2-0012 Use of Non-Developmentatl Items

If components of the Offeror's OTH NDI item meet TLRD 3.3.1 NDI requirements and are currently fielded and operational on USN ships with previous waivers for some Insensitive Munition requirements, will these previous waivers be adequate for acceptance of Initial Encanistered Missile (EM) deliveries, if Improved EMs developed under the OTH-WS Improvement CLIN meet all Insensitive Munition requirements without requiring waivers?

In accordance with Section L.3.1.2 paragraph 2.1,Offerors shall provide a narrative demonstrating that its OTH-WS complies with TLRD paragraph 3.3.1. In demonstrating that its proposed OTH-WS complies with TLRD paragraph 3.3.1 Offeror's shall include in their narrative, if applicable, a discussion related to any existing USN waivers. Further, the Government does not have a requirement for Insensitive Munitions compliance. An insensitive munitions assessment will be performed in accordance with MIL-STD-2105D during performance of the contract; therefore the Government cannot determine whether or not waivers will be provided for any Insensitive Munitions requirements.

Set 2 - 71 RFP Pg 127-153, Section I Request that the USG add FAR 52.245-1, Government Property, and Navy Clause 5252.245-9500, Government Property for the Performance of this Contract, to Section I. Offerors may have Government-Owned tooling, factory test equipment, and/or facilities in use on current production lines that would be beneficial to the USG.

Please see the Government's response to Question Set 1 - 27.

Set 2 - 72 RFP * Pg 80-81, Section C, Paragraph 4.1.7 Training Courses

* Pg 80-81, Section C, Paragraph 4.1.8 User Manuals

Training Courses and User Manuals are required by SOW paragraphs 4.1.7 and 4.1.8 respectively. The Improvement CLIN 0110, does not include tasks for updates to these items. How would the government like us to propose required updates to Training Courses and User Manuals as a result of the Improvement CLIN?

The DID for CDRL AA0026 will be updated to replace DI-TMSS-81675 with DI-TMSS-81723.

Set 2 - 107 RFP Page 17, para 3.1 The OTH-WS Improved system timing will result in an overlap between the initial order for improved systems and the final 12 months of the development of the improved system. Is this an oversight or is the plan to potentially order the parts at risk, ahead of the completion of development?

The delivery of the Improved hardware for live fire demonstration shall be delivered no later than seven-hundred thirty days after option exercise of CLIN 0110. Offerors are permitted to propose a delivery of earlier than seven-hundred thirty days in their Integrated Master Schedule in accordance with Section M paragraph 3.2.4. In the event that an Offeror can delivery its Improved hardware sooner, the Government has the option to exercise the Improved Encanistered Missile, Improved Fire Control Suite and Improved Launching Mechanisms CLINs as applicable.

Set 2 - 108 SOW Page 78 , SOW, para 3.1 Some of the reference documents called out in the SOW are not referred to in the text of the SOW. Are these documents not applicable? All of the documents listed in Section C paragraph 3.1 form a basis for the work to be performed under the Statement of Work, regardless of if the document is listed in the text of the Statement of Work.

Set 2 - 109 RFP Pg 2-74, Section B, CLIN Structure In Section B, each of the Training CLINs (0210, 0310, 0410, 0510, 0610) is broken out into 3 SubCLINs (AA, AB, AC). The descriptions for all of the SubCLINs are exactly the same. What is the offeror supposed to price for each SubCLIN? Is it different training classes (there are 5 classes but only 3 SubCLINs)? Is it to provide all 5 training classes on 3 separate dates? Where would the training classes be conducted?

Further clarification on the use of the SubCLINs is requested.

The Government may require up to three rounds of training (reflected as SLINs AA/AB/AC) within the 12 month period of performance.

Each SLIN shall be priced to include the time and material needed to teach the five courses required under Section C paragraph 4.1.7.

The training classes will be conducted at a US Navy school house.

Set 2 - 110 RFP * Pg 76, Section C, Paragraph 1.8 Option Items 0008 0108, 0208, 0308, 0408, 0508 and 0608 - Test Support Services

* Pg 82, Section C, Paragraph 4.2.5 Safety Program

The TLRD does not specify a requirement for Insensitive Munitions (IM). SOW paragraph 1.8 (p. 76) requires technical support for WSESRB.

SOW paragraph 4.2.5 (p. 82) states that OTH-WS hardware "shall meet the General Navy Safety Requirements of NAVSEA OP 4 Rev 11... and OP-5, Volumes 1 and 2." Based on the RFP requirements above, will the Offeror's OTH-WS hardware be required to "Pass" ALL IM tests including Fast Cook Off, Slow Cook Off, Bullet Impact, Fragment Impact, Sympathetic Reaction, and Shaped Charged Jet? Or will the USN and WSESRB provide waivers for some IM requirements?

The Government does not have a requirement for Insensitive Munitions compliance. An insensitive munitions assessment will be performed in accordance with MIL-STD-2105D during performance of the contract; therefore the Government cannot determine whether or not waivers will be provided for any Insensitive Munitions requirements.

Set 2 - 111 RFP Page 134., 52.217-9 NAVSEA, Para ( c) How will the RFP be corrected for options CLIN in the 500 and 600 series that extend the contract duration beyond the 5 year period stated in paragraph (c)?

Please see the Government's response to Question Set 1 - 11.

Set 2 - 112 RFP Page 183, paragraph 2.2.4 Page 192, paragraph 2 Page 211, paragraph 2

Page 183 states that for purposes of developing the IMS Offerors shall assume CLIN 0110 will be exercised on 30 Sep 2020. Page 192 states that for the purposes of the price proposal, Offerors shall assume that FY19 Option CLINs award is 1 Jan 2019, including the first Improved Production CLIN 0111. Page 211 states the Government begins ordering Improved systems in the FY following the delivery of its live fire demonstration hardware under CLIN 0110. Please clarify when the option will be exercised for the initial production of Improved systems in relationship to the option for improved system NRE.

The option exercise date listed in Section L Factor 2 for CLIN 0110 is for purposes of developing the Integrated Master Schedule. The option exercise dates listed in Section L Factor 6 are for the purposes of developing the price proposal. The Government will not exercise the CLINs for the Improved Encanistered Missiles, Improved Fire Control Suites or Improved Launching Mechanisms until after successful completion of all exit criteria listed in Section C paragraph 4.4.3.3. All option exercise dates are subject to FAR 52.217-7 and 52.217-9 and the availability of funds.

Set 2 - 113 RFP Page 183, 192 If option CLIN 0111 is exercised 1 Jan 2019 as stated and Option CLIN 0110 (to be exercised 30 Sep 2020) is not exercised or is not exercised concurrent with CLIN 0111, will the Contractor be relieved of completing CLIN 0111 within the required period of performance (interdependency of design and production)?

Please see the Government's response to Question Set 2-112.

Set 2 - 114 Govt Response to Questions for Final RFP and Govt Response to Questions for Draft RFP

Final RFP Question Response 1-1 and Draft RFP Question Response 58

Offeror is proceeding with its bid under the assumption that the response to question 1-1 and Draft RFP response 58 are not in conflict, and as such, proposing the use of Government property under this contract is not allowed. Is this assumption incorrect?

There is no conflict between the Government responses provided for Draft RFP-58 and Set 1-1, as the responses address separate issues. The response to Draft RFP-58 addresses the use of Government furnished property which will be consumed under the contract.

The response to Question Set 1-1 addresses the use of other than virgin material, to include former Government surplus property that a Contractor has acquired from a Government agency in accordance with FAR 52.211-5. Use of Government property will be governed in accordance with all applicable clauses to include FAR 52.245-9, 5252.245-9115 and Sections L and M as amended through Amendment 0001.

Set 2 - 115 Govt Response to Questions for Final RFP and Govt Response to Questions for Draft RFP

Final RFP Question Response 1-1 and Draft RFP Question Response 58

If the above assumption in 21(a) is incorrect, please advise how the use of Government property, consumable or otherwise, will be valued when determining an Offeror’s total evaluated price.

Please see the Government's response to Question Set 2-114.
