(14) Prior to using an appointed agent to communicate with the Government on matters concerning this RFP or any resulting contract, the Offeror shall send written notification to the Contracting Officer outlining the time period and conditions when the appointed agent is authorized to act or communicate on the offeror's behalf. ii. For all commercial technical data and computer software to be delivered under the contract, the Offeror shall complete and submit Attachment 7 (fill in “None” if it is not applicable).
Note: The intent of the Technical Data Rights assertions is to determine the degree to which the proposal provides the required level of technical data rights (commercial and noncommercial) and rights in computer software that will enable the Navy to adequately sustain the boats over their life cycle to include maintainability and repairability.
If the Offeror is awarded any resulting contract, the proposed Data Rights specified in section C.1.i and C.1.ii above will be incorporated into the contract.
2. Boat Design, Production and Delivery: To support Government evaluation of the Offeror’s ability to design and produce the proposed boat to meet the required delivery schedule in Section F, Offeror shall provide the build schedule. The build schedule shall be in the Offeror’s desired format outlining major events of the build process, and including builder trials, PDIT, and delivery dates for the base order and option years in Days After Receipt of Order (DARO). The delivery dates provided in SECTION F of the Request for Proposals are notional delivery dates. Should the Offeror provide an alternative delivery schedule it shall complete Attachment 9 to submit proposed delivery schedules for each boat in DARO. The Vendor shall include Attachment 9 with the submitted proposal and any supporting documentation justifying an alternative proposed schedule than the notional schedule provided in SECTION F of the Request for Quotation.
3. Warranty: To support Government evaluation of the Offeror’s ability to provide the minimum acceptable warranties for the proposed boats as specified in the SOW, Offeror shall provide a description of the proposed builder’s warranty in Vol. I Factor 1(C).
Factor 2: Past Performance and Experience (PP&E):
Offerors shall provide three (3) past performance references on same or similar work as required by this RFP, completed within the past five (5) years. Offerors shall use Attachment 5 to list these references and explain the relevance of each contract to the current requirement. If the offeror will not be the Builder for the proposed boat (more than 50% of the boat will be built by a subcontractor or more than 50% of the boat will be built at a subcontractor’s facility), the offeror shall include one (1) past performance reference for the Subcontractor and shall state the Subcontractor’s name, project manager’s name, street address, phone number, and e-mail address on a separate attachment to be included with the offeror’s proposal. The Subcontractor’s past performance reference will be included in the three (3) past performance references. Offerors are responsible to submit the Past Performance Form as part of the technical proposal. The Government will utilize Past Performance Reference Forms received and other resources to gather Past Performance and Experience information on the Offerors.
VOLUME II: Price Proposal
Factor 3: Price: The following items shall be completed and included in the Price Volume of the offeror's proposal:
A. Standard Form 33 Blocks 12-18 and any amendment.
B. Offeror shall complete the attached Spares Parts Lists (included in Attachment 3) and submit with price quote in Vol. II, indicating the capability of the Offeror to provide the minimum spare parts identified for each boat, engine, and generator configuration listed. Response to Attachment 3 shall include specific subsystem OEM part numbers to the maximum extent practicable.
Attachment 3 is intended to convey the minimum Spare Parts required for each boat configuration covered by this solicitation. Exceptions to any of the specific spare parts identified shall be noted at the bottom of each list in the ‘Offeror’s Notes’ section for Government consideration.
C. Offerors are required to propose a Step Ladder pricing structure up to the maximum quantity boats in Section B for each CLIN. This is applicable to all CLINs in Section B of the solicitation with exceptions as noted in Attachment 9, CLIN List. Offerors should price the out year optional CLINs using the step ladder structure accordingly as this contract is Firm Fixed Price (FFP).
Offerors should use Attachment 9 to develop the step ladder pricing structure (an example is provided below). CLINs that are excluded from step ladder pricing shall be included in the total price. Please insert the applicable CLIN prices in the “Total Per CLIN” column in Attachment 9.
Offerors are NOT required to complete Section B of the solicitation.
D. Provide general pricing information or other basis for which proposed pricing was derived.
E. Offerors must complete Section K of the solicitation (Certifications, Representations, and Other
Statements). The reps and certs are in addition to the information in SAM.gov.
Offerors are required to provide sufficient supporting data to enable the Government to understand how the proposed FFP step ladder amounts were developed and to determine the reasonableness of the proposed price. In regard to pricing the CDRLs, the Government does not expect the configuration of the boat to change much from the base year to the option years. Only minor updates to the technical data are required to capture the changes throughout the life of the contract. Therefore, Offerors shall price the TDP accordingly for the base year and the cost for the anticipated changes for option years.
Clarity and completeness of the Price volume are of the utmost importance. Offerors should check for calculation errors to ensure the total prices are derived from the units and unit prices in Section B of the solicitation. The Price volume must be internally consistent or the price proposal will be considered unreasonable and may be considered unacceptable.
Attachment 9, CLIN and Stepladder Pricing spreadsheet includes a number of various configurations of:
delivery locations, TDP, UID, and PDIT. It should be understood that the Government intends to purchase boat configurations in general as a set, with the intention being to purchase complete boats utilizing various configurations.
For planning purposes, the Government intends to award Delivery Orders at the Priced CLIN level
