Post Final RFP Questions
| N00019-13-R-0044 Kuwait KC-130J Aircraft Maintenance and Logistics Support | ||
| Post Final RFP Questions & Answers 6/19/13 | ||
| Question # | Question | Answer |
| 1 | Penalties/Reduced Payments Calculation |
References: 1. PWS page 17 (Section 6.14.2). 2. SF33 page 23 (Section H1) Discussion: In prior questions and answers, it was established that the fleet average method depicted in Reference “1” above (PWS) would be utilized to determine readiness and aircraft availability applicable to reduced payments. In the SF33, the language still penalizes the contractor for “per aircraft” occurrences.
| Question/Request: Please correct the SF33 to reflect the fleet average method. | We concur; remove “per aircraft” from the SF 33, Section H. | |
| 2 | Common Hand Tools |
References: 1. PWS. 2. SF33 Discussion: In prior questions and answers, it was established that the contractor would be provided all tools, etc. including common hand tools.
| Question/Request: Please update the PWS/SF33 to reflect the same. | In prior questions/answers it was established that Kuwait will provide all Tools & Equipment required to Support Aircraft. | |
| 3 | Executive Summary Organization (appendices) |
References: 1. SF33 Section L and Section M Discussion: The SF33 Calls for the Executive Summary to include the “Offeror Summary Table”, “Offeror Representation and Information”, “Government Agency Information” and System Compliances”. It also asks for the “Offeror Summary Table” to be submitted 3 weeks prior to the proposal due date.
| Question/Request: May the contractor include the 4 elements requested above at the “back” of the Executive Summary? | Follow instructions as indicated on pg. 64, 4.0 Proposal Submission (Section L) of the Solicitation. Do NOT include in the back of the Executive Summary. | |
| 4 | Due date of the “Offeror Summary Table” |
References: SF 33, Section “L” page 62; 4.0 Proposal Submission Discussion: The “Offeror Summary Table” requires the contractor to include the sub-contractor’s relevant % of proposed price. Accordingly it would seem premature to ask the offeror to validate that number prior to completing their cost proposal.
| Question/Request: Will the government please reconsider this request and permit the contractor to submit the “Offeror Summary Table” from the Executive Summary in the complete proposal submission by the final due date? | Follow instructions as indicated on pg. 62 (Section L) of the Solicitation. | |
| 5 | Arrival date of Aircraft at MCAS Cherry Point |
References: 1. PWS Page 4, 1.1. 2. SF33 Page 35 Discussion: The PWS speaks to 3 aircraft being accepted in June and July. The SF33 requires the contractor to price specific periods of performance for implementation at Cherry Point and in Kuwait that are dependent upon when the aircraft are received and then transferred to Kuwait.
| Question/Request: Please provide the anticipated aircraft transition schedule. | Cherry Point Overview Attachment provides this information. | |
| 6 | QASP |
Reference: The Quality Assurance Surveillance Plan (QASP) paragraph 1.3.1, attachment (3) dated 25 March 2013.
Discussion: The QASP references the QCP (Quality Control Plan), though numerous references throughout the solicitation make reference to the Quality Assurance Program Plan to include exhibit “A” CDRL A00F.
| Question: Is the Contractor correct by using the nomenclature Quality Assurance Program Plan vice the Quality Control Plan? | Yes, the QCP and Quality Assurance Program Plan are synonymous. | |
| 7 | AQLs |
Reference: QASP paragraph 4.3 Acceptable Quality Levels (AQLs), dated 25 March 2013.
Discussion: Paragraph 4.3 Acceptable Quality Levels states that (AQLs) are included in Exhibit “A” of the contract. Paragraph 3 Identification of Required Performance Standards/Quality Levels also references quality levels (are included in the PWS and Exhibit “A” of the contract).
| Question: AQL’s are mentioned within the QASP dated 25 March 2013 as being located in the PWS and Exhibit “A”. Contractor could not locate AQL levels. Would the USG please provide AQLs in-order-to ensure the contractor is aware of the required service/performance level required by the customer? | Government is reviewing and will provide an update as needed. | |
| 8 | Navy Maintenance Training Management and Evaluation Program |
Reference: PWS paragraphs 3.5.2.3 (Quality Assurance Supervisor), and 3.5.2.4 (Aviation Maintenance Supervisor).
Discussion: Both listed references refer to the Navy Maintenance Training Management and Evaluation Program Levels IV and III respectively.
| Question: When the USG refers to the Navy Maintenance Training Management and Evaluation Program Levels for experience will the United States Marine Corps Individual Training Standards System Maintenance Training Management and Evaluation System (MATMEP) be accepted as a satisfactory equivalent for required experience levels concerning key personnel? | Yes, MATMEP is acceptable. | |

Questions:
a) Will there be a Memorandum of Agreement (MOA) established between the Contractor, and Cherry Point to ensure all logistical requirements are met in-order-to ensure aircraft are responded to in a timely fashion i.e. supply, fuel, hangar facilities, I-level (if required) etc?
b) Will the contractor be performing an Acceptance Inspection per the KAF 4790.2G at Cherry Point upon receipt from Lockheed Martin or will this be taking place by the KAF upon acceptance (Form DD250)? a) No, USG/FST has established all necessary support requirements/agreements for MCAS Cherry Point support.
b) The First aircraft arriving at Cherry Point for Training will require an Acceptance Inspection to be performed by the Contractor with the exception of an FCF. The Second and Third aircraft will have their acceptance Inspections done upon arrival in Kuwait.
10 Logbooks and Records Reference: PWS paragraph 6.16.1 Logbooks and Records.
Discussion: Weight and Balance Calculations.
| Question: Who will be performing Weight and Balance Calculations? | The contractor is responsible for maintaining the Weight & Balance records per KAF 4790 Maintenance Control Functions. Specific calculations are not the responsibility of the Contractor. | |
| 11 | QA Records |
Reference: PWS paragraph 5.14.1 Quality Assurance Records.
Discussion: Paragraph 5.14.1 states The Contractor will retain all Quality Assurance Records for the life of the contract. The Quality Assurance data shall be retained on WIS. It is the understanding of the Contractor that only the Inspections/data performed by the QAR/CDQAR and CDI will be retained in WIS. Other records such as Auit reports will be retained by the contractor via their Quality Assurance Plan.
| Question: Is the contractor’s understanding correct? | The PWS has been updated to reflect: "The Contractor shall retain all Quality Assurance records for the life of the contract, including Audits, Inspections and Maintenance Records. | |

| Question: How many pieces of ALSE equipment are required to support Cherry Point operations? Will an ALSE mechanic be required to support Cherry Point operations or will the host training unit support this requirement? | The contractor needs to be prepared to support two complete KC-130J aircrew in Cherry Point. | |
| 13 | Support Equipment at Cherry Point, NC |
Reference: PWS Paragraph 5.3. Contractor shall inspect and maintain all support equipment (SE) IAW applicable technical manuals listed in Appendix A.
Discussion: First aircraft will remain at Cherry Point, NC for approximately 45 consecutive days for KAF aircrew training conducted by a third party contractor.
| Question: How many pieces of SE equipment are required to support Cherry Point operations? Will an SE mechanic be required to support Cherry Point operations or will the host training unit support this requirement? | All required SE in Cherry Point will be provided and maintained by USG. | |
| 14 | Sorties per day and ASD while at Cherry Point |
Reference: PWS Paragraph 5.2. First aircraft will remain at Cherry Point, NC for approximately 45 consecutive days for KAF aircrew training conducted by a third party contractor.
Discussion: Number of personnel required to support flight operations at Cherry Point is heavily dependent on sorties per day and average sortie duration (ASD).
| Question: What are the anticipated sorties per day and ASD while at Cherry Point? | Daily flight operations are unknown at this time. | |
| 15 | O-Level Maintenance at Cherry Point |
Reference: PWS para 5.2 Discussion: PWS para 5.2 discusses organizational maintenance at Cherry Point. No mention is noted as to the who will provide the spares/consumables required to support the Cherry Point operations Questions:

Reference: PWS para 6.3.4 Discussion: PWS para 6.3.4 discusses logistics support functions but does not address when the support is required, i.e. 5 days 40 hours per week, 24/7 or something in between.
| Question: What work schedule is anticipated for normal operations at Al Mubarak Air Base? | Refer to Para 6.12 in the PWS. | |
| 18 | CLIN 0X04 |
Reference: CLIN 0X04, Over & Above Rate Discussion: The rate required for the Over & Above CLIN is a composite rate of all labor skills required.
| Question: Is this an average hourly rate (by those labor categories that might be required) for 1 hour of service that will be charged per hour per person working the Over & Above requirement? Example, Hourly rate is $75.00 per hour and 5 employees work 5 hours each. The invoice would be $75.00 * 5 employees * 5 hours = $1,875.00. | A composite rate is a group of labor categories added together and divided by the number of categories to equal the composite rate. Example: 3 different categories; Category 1 = $50, Category 2 = $60, Category 3 = $70. All three equal $180, divided by 3 = $60. $60 would be the composite rate. | |

| Question: Will hours outside the standard workweek in support of TDY requirements be considered Over & Above? For example, a flight crew travels with an aircraft to France over a weekend. How will the weekend hours be invoiced? | No, The Contractor shall provide personnel to support deployments per PWS Para 6.4. | |
| 21 | Section H |
Reference: Section H, 5252.237-9501 subparagraph (g) Discussion: Subparagraph (g) identifies that the Government may equitable adjust (downward) the contractor price for any delay, loss or damage as a result of the contractor’s untimely replacement of personnel.
Questions:
a) If the suitable and timely replacement of personnel does not impact the Aircraft availability, why would there be a need to terminate or equitably adjust (downward) the contract?
| b) If the suitable and timely replacement of personnel does impact the Aircraft availability, why would the Government impose 2 reductions (reduced payments per H-1 and 5252.237-9501 (g))? | The two clauses address two separate circumstances. | |
| 22 | Reference: PWS Paragraph 6.1.1. Authorized I-Level Maintenance consists of tires, wheels, brakes, in-flight refueling system, battery support capabilities and airframe components that are common to those installed on existing legacy L-100 aircraft. |
Discussion: Tires, wheels and brakes will require NDI.
| Question: Who will perform NDI for tires, wheels and brakes? | The contractor will be expected to do complete tire and wheel maintenance, including wheel build-up/tear down, rubber replacement and NDI as required. | |
| 23 | References: PWS Paragraphs 6.16.2.1 Web-Based Information System. "The Contractor shall provide, implement, and maintain a licensable commercial WIS to track maintenance and material management.". "..to facilitate effective management and decision support across the maintenance and material management enterprise." |
PWS Paragraphs: 6.16.2.4 "The Contractor shall ensure the WIS has: A method for accountability of warehouse inventory parts; A means to establish and maintain tracking of parts order (stock repair, estimated delivery date); Fields to maintain information on repaired parts, work load, orders, material cost per flight hour and warranties in the aircraft database for the life of the contract; Provisions to record/track history (data indicating number of times a particular part has been requested for repair or replacement on a per-one hundred (100) flight hour and monthly basis and aggregated on a quarterly basis).
Discussion: The answers to questions 13 thru 18 in the Post Final RFP Questions & Answers (5/31/13) contradict PWS paragraphs 6.16.2.1 and 6.16.2.4 quoted above.
| Question: Does the WIS require supply chain/material management functionality? If not, then please change the PWS. If yes, please explain how the answers to questions 13-18 fit with the referenced PWS paragraphs. | The WIS does not require supply chain material management functionality. The PWS has been updated to reflect this answer. | |

a) PWS paragraph 10.0, titled Base Relocation (CLIN 0208), states "The Contractor shall provide all operations and services necessary to perform the Base Relocation to include supporting the movement of materials (e .g. packing, unpacking, set-up}, information technology, SE, and other logistics support from the AI Mubarak airbase to the designated permanent airbase. The KAF will provide all equipment (e.g. trucks, packing material) necessary for base relocation. The Contractor shall deliver a Base Relocation Schedule in accordance with CDRL A00K."
b) Section B identifies CLIN 0208 as a Firm Fixed Price (FFP} Option.
c) Section M, subsection D, titled PRICE/COST, states "The FFP CLINs (0001, 0002, 0X03, 0201, and 0208}, the LH CLIN (0X04} and the CR CLINs (0X05 and 0X06} shall be evaluated to determine reasonableness, completeness, clear understa nding of the solicitation requirements and to ensure CLINs contain no material imbalances." In addition, it states "The TEP is the sum of the following: The total proposed price for the FFP CLINs 0001, 0002, 0X03, 0201, and 0208. The total proposed price is the proposed unit price multiplied by the Section B Estimated Quantity for that CLIN;"
Discussion: There are a number of unknown variables that can impact offeror's base relocation costs [e.g., relocation destination, relocation of personnel and re-establishment of life support, reestablishment of information technology services (i.e., internet, long distance phone service}, amount of time allowed to accomplish the relocation, and timing of the relocation itself]. Given the fact key base relocation requirements are yet to be defined, this could present the Government difficulty in evaluating the technical acceptability of offeror's approach as well the offeror's reasonableness, completeness, and clear understanding of the solicitation requirements. Furthermore, given the CLIN is factored into the TEP, this will impact the Government's best value selection.
| Question: Would the Government consider changing CLIN 0208 to Not Separately Priced or Cost Reimbursable or eliminating the CLIN from the TEP for the reasons stated above? | The Government will not be changing CLIN 0208 contract type. | |
| 25 | References: |
a) PWS paragraph 5.1, titled Cherry Point, NC Phase-In, states:" ... All maintenance supplies required for supporting each aircraft at Cherry Point, NC will be provided by Kuwait."
b) PWS paragraph 5.5.3 states: "Material in support of AOG will be covered under the Over and Above Parts and Materials line item (CLIN 0X05)."
c) PWS paragraph 5.6.4 states: "Material in support of Crash Recovery/Repairs will be covered under the Over and Above Parts and Materials line item (CLIN 0X05}."
d) PWS paragraph 6.5.4 states: "Material in support of AOG will be covered under the Over and Above Parts and Materials line item (CLIN 0X05)."
e) PWS paragraph 6.6.3 states: "Material in support of Crash Recovery/Repairs will be covered under the Over and Above Parts and Materials line item (CLIN 0X05)."
f) PWS paragraph 8.0, Over and Above Parts and Material (CLIN 0X05).
g) Response to question #18 (8 Mar 13) states "KAF is responsible for pre-positioning repairables and consumables at both Cherry Point and Kuwait (AI Mubarak) prior to contractor arrival
h) Response to question 33 and 38 (8 Mar 13) states "The contractor will not be responsible for material management functions, but will only be responsible for assisting with the day-to-day operations of the warehouse."
| Question: In light of the requirements stated in the above referenced PWS paragraphs, and the Government's responses to Industry Questions 18, 33, and 38; can the Government clarify what material the contractor would be responsible for procuring under CLINs 0X05? | Under CLIN 0X05, the Contractor would be responsible for procuring any material the KAF cannot provide in a reasonable and timely manner when the aircraft is away from home station/base. This material may be consumables or repairables, depending on the requirement and ability of the contractor to procure. However, all procurements would require prior approval through the PCO. | |
| 25 | References: Part B, titled Specific Instructions, Section 3, titled Volume 3-Corporate Experience, Subsection 3.1 states: "3.1 Experience in Managing and Maintaining C-130 Aircraft Describe the extent to which the Offeror and the Offeror's subcontractors/team members have obtained experience in each of the following areas: |
a. Organizational/Intermediate level site maintenance to include airframe, engine, and propeller maintenance and modifications using a mix of Original Equipment Manufacturer (OEM) and Federal Aviation Administration (FAA) commercial maintenance requirements. Managing aircraft at sites including operations in different countries at both military and commercial airfields. This may include remote single aircraft sites with access to limited resources.
b. Worldwide supply chain support, to include dealing with customs, shipment and storage of Hazardous Materials (HAZMATS) and Exp losive Ordnance Disposals (EODs).
c. Support for short notice deployments."
Discussion: Items a-care specifically tied to experience associated with managing and maintaining C-130 aircraft. Furthermore, the requirement associated with Federal Aviation Administration (FAA) and commercial maintenance requirements does not appear to be applicable to this solicitation since performance will be in accordance with KAF 4790.2G. Given the specificity associated with this requirement, this will sign ificantly restrict competition to Offerors who possess C-130 experience related to items a - c, despite the fact there are Offerors who possess nearly identical experience in managing and maintaining weapon systems other than C-130s equipped with common aircraft systems/sub-systems (i.e., engines, props, avionics, LRUs, parts, etc.) and maintenance and logistics support requirements. Given this, Section 3.1 should be modified to read "Experience in Managing and Maintaining C-130 or Similar Aircraft".
| Question: Will Offeror's possessing experience in managing and maintaining similar aircraft with systems/sub-systems and maintenance and logistic support requirements common to the C-130 be rated equally when assigning a Corporate Experience confidence assessment rating? | Under CLIN 0X05, the Contractor would be responsible for procuring any material the KAF cannot provide in a reasonable and timely manner when the aircraft is away from home station/base. This material may be consumables or repairables, depending on the requirement and ability of the contractor to procure. However, all procurements would require prior approval through the PCO. | |
| 26 | Questions: |
a) Since this solicitation has a value in excess of $ 650,000, what are the provisions and mandates of the solicitation to provide a subcontractor plan.
| b) Who will be the contracting officers to ensure the plan is followed and what reporting methods will be used | a) This is an FMS contract with all of the work being performed in the forgien country. Per FAR 19.702 (b)(3), a subcontracting plan is not required. b) See above answer. | |
| 27 | Reference: Section L-3.0, Proposal Content and Volumes, page 59 of 86, 2nd paragraph, states: suggested page counts for each volume, if any, are also specified in the following table (not included) as follows ( Title and Table of Contents pages do not count towards page count). |
| Question: If an Offeror provides an Acronym List, will the acronym count against the volume page count? | Please read and review Section L, 3.0 proposal Content and Volumes as stated in the Solicitation. | ||
| 28 | Block 9 of the SF33 indicates an original and 4 copies of the sealed offers are to be submitted. The table contained in paragraph 3.0 of Part A in Section L indicates that 1 Original and 2 Paper Copies of each volume and annex are to be submitted. | ||
| Question: Please clarify how many hard copies of the proposals are to be submitted. | The correct number of copies is four. Section L will be updated to reflect the change. | ||
| 29 | Paragraph 7.0, f. of Part B in Section L requires Offerors to include a copy of the Transition Plan in the Volume 7 – Contract Documentation. The Government’s 5/31/13 response to question #8 indicates the Transition Plan and Phase-In Plan are separate requirements. The RFP contains no other details regarding the Transition Plan. | ||
| Question: Please clarify the Government’s expectations of what Offeror’s are to include in the Transition Plan to be submitted with the Contract Documentation volume. | Please review the PWS, specifically section 4.0 Transition. The sub-heading 4.2 as well as the heading 5.0 supply information regarding phase-in. | ||
| 30 | Section H, 5252.232-9501 LIABILITY INSURANCE (MAR 1999) – This clause number is listed as “Liability Insurance” in the new solicitation, but we believe the title is incorrect. This clause number appears to be “Submission of Invoices (Fixed Price).” Please confirm which clause is to be incorporated. | The correct Clause number should be 5252.228-9501 and this will be updated in the RFP via an amendment. |
