N00014-15-R-0005 Contractor Q&A dated 10 Sep 2015

Document Page # Question

Solicitation 5 Section G.1: Is paragraph (b) necessary? It is an exact replica of the nd paragraph under F.2 – Distribution of Invention Disclosures and

Reports, and seems more appropriate within F.2.

RESPONSE: This is an ONR local provision/clause and will remain in the solicitation.

Solicitation 11 H.1: Enterprise-Wide Contractor Manpower Reporting Application

(ECMRA) requires annual reporting of all contractor labor hours

(including subcontractor labor hours). Please confirm this requirement is applicable to this R&D effort.

RESPONSE: Confirmed - This requirement applies to this effort.

The PSC for this effort is not part of the PSC exclusions listed on the ECMR website.

Offerors can visit the website included in the RFP for PSC exclusion listing.

Solicitation 18 Given that the design, development, or operation of a system of records on individuals is not anticipated in the SOW, FAR 52.224-2 does not appear applicable to this effort.

RESPONSE: Concur. This will be removed from the solicitation.

Solicitation 20 Given that contractor performance of information assurance functions is not anticipated in the SOW, DFARS 252.239-7001 does not appear applicable to this effort.

RESPONSE: Non-Concur. The Contracting Officer, along with the Navy ManTech Program Office, has determined that this does apply since CoE contractors do have access to systems for providing ManTech data in to DoD databases and uploading documents into DoD systems.

Solicitation 27, 31 On page 27, Section L.2(E)(3) states that “Each page will be counted except the following: Cover pages, page separators/tabs, glossaries, table of contents/indexes, past performance questionnaires and resumes.” There is no mention of letters of commitment or appendices, yet on page 31, Section L.3(C)(1)(b)(2)(iii) states that

“The Offeror must also submit letters of commitment for all of its proposed team members, agencies, or companies to provide the support outlined in the above (1) and (2), (letters can be placed in an appendix and are not included in the page limitation).” Please confirm that letters of commitment/support will not count against the 50-page limitation for the Technical Proposal.

RESPONSE: Confirmed. Please note the RFP expressly states on page 31 as follows (underlined for emphasis):

(iii) The Offeror must also submit letters of commitment for all of its proposed team members, agencies, or companies to provide the support outlined in the above (1) and (2), (letters can be placed in an appendix and are not included in the page limitation) and;

Solicitation 33 Section L.3(C)(3)(a) states that “Past Performance information shall be submitted on preferably three (3) recent contracts that the Offeror considers most relevant in demonstrating its ability to perform the proposed effort.” Can an Offeror submit more than three (3) recent contracts, and will that be viewed unfavorably during evaluation?

RESPONSE: This is a business decision that should be made on the part of the offeror. ONR cannot advise on this matter.

Solicitation 37 Given that FAR 52.204-7 is included, FAR 52.204-6 is not applicable.

RESPONSE: Concur. This will be removed from the solicitation.

1 – SOW

11 Task 3.2 – Project Management ends with “or Fee Determining

Official”. Please confirm this language was included in error and will be removed in any resulting award document, as indicated in the Q&A released 20 August 2015.

RESPONSE: Removed. An amendment with this document will be posted to FBO.

1 – SOW

11 Task 3.3 – Project Management of Existing NMC Projects is included, despite guidance in the Q&A released 20 August 2015 that this task would be removed. Also, while assumptions for pricing were provided in Section L.4(C)(1) of the Solicitation for Delivery Order 0001 and

Delivery Order 0002, no such information was provided for assuming existing projects. Please confirm that Task 3.3 will be removed in any resulting award document.

RESPONSE: Existing NMC projects will be completed by the incumbent. This will be removed in the amendment.

7 – Cost

Element

Summary n/a The spreadsheets provided include columns and tabs for Option IV and Option V, yet the ordering period is defined as 60 months – a two-year base period plus three one-year options per Solicitation Section

L.3(C)(4)(c)(1). Please confirm there are no Option Periods IV and V.

RESPONSE: The cost proposal in the solicitation is the cost proposal format found on the ONR website and is a template.

Offerors should use the template and can adjust it to the solicitation period of performance.

Section, Page Question

H, ONR-Consent to

Subcontract and/or Hire

Consultants, page 13

Section H, ONR- Consent to Subcontract and/or Hire Consultants, on page

13 states: “To be completed when projects are awarded and will be in included in the applicable task orders. Each Identified Consultant and/or

Subcontractor will include their Estimated Time; Rate per day; and estimated cost.”

As written, Consultants/Subcontractors would have to identify a daily rate. If a contractor teams with non-traditional subcontractors, providing a daily rate presents a number of challenges. Would the Government consider amending the language to remove the reference to daily rate and instead include an approved dollar amount?

RESPONSE: No changes will be made.

Section I, Page 17 and

Section L, Page 43

The solicitation includes clause 52.215-21(Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost Or Pricing Data-

Modifications) and 52.215-20(Requirements for Certified Cost or Pricing

Data or Data Other Than Cost or Pricing Data (Oct 2010)).

Per the answers released to the draft solicitation, certified cost or pricing data is not required; however, could the Government confirm if the instructions contained in Table 15-2 of FAR 15.408 are to be followed for

Data other than Certified Cost or Pricing Data? Our understanding is that

Data other than Certified cost or pricing data is to be provided only in accordance with Section L4 (Instructions for Preparation of Cost Proposal) and Attachment 7. We would like to confirm the requirements within Table

15-2 (such as time phased breakdown of direct labor, CLIN pricing, copies of non-labor vendor quotations, etc.) are not to be initially supplied but available upon request?

As stated in the response regarding the draft RFP, the clauses apply to the solicitation and resultant contract award.

A determination as to if a certificate is needed will be made prior to award.

Should the data from Table 15-2 be needed, it will be requested IAW source selection procedures noted in FAR 15 and applicable supplements.

Section J, Attachment 7 Are offerors allowed to make edits to Attachment 7 (i.e., add/delete rows and columns) to account for how a contractor builds costs in accordance with its approved cost estimating system, disclosure statement, etc.?

RESPONSE: This is allowable in order to best represent the offeror’s cost element. For example, if an offeror has multiple overhead rates, the file can be edited to show all overhead rates.

Section J, Attachment 7 Some of the formulas within the spreadsheet are rounding to the nearest whole dollar. Are those formulas to round to whole dollars or should they round to two decimal places?

RESPONSE: ONR will round to the nearest dollar.

Page 1, SF33 Are offerors required to return a signed SF33 with its offer? If so what

Volume should it go in?

RESPONSE: To be considered by award, the offeror must evidence an intent to be bound to the terms and conditions in the RFP and any amendments. This is evidenced by signature on the SF 33 (see block

17). In addition, the offeror must also acknowledge amendments.

Paragraph (c) Instructions to Offerors Competitive Acquisitions (FAR

52.215-1) states that a signature is required from someone authorized to bind the company.

Offerors may place the signed SF 33 at the front of the cost volume.

This will be noted in the amendment in revision to paragraph L2.

Section K What Volume should offerors put their completed Section K –

Representations, Certifications, and Other Statements of Bidders in?

RESPONSE: Please place these documents in the cost volume. This will be noted in the amendment in revision to paragraph L2

Note: The file path to the original solicitation on FBO was incorrectly titled. Please note the RFP is N00014-15-R-0005.
