TITLE: Home Mortgage Disclosure Act (HMDA) Disbursement To Board of Governors Federal Reserve System (FRB)

(2) Nature and/or description ofthe action being approveL

The scope and purpose of this agreement is to satisfy the requirements of the Home Mortgage Disclosure Act, 12 Usc Section 2801 and to reimburse the Federal Financial Institutions Examination Council (FfIEC) and federal Reserve Board (FRB) for the corresponding share of the cost of collecting and publishing mortgage loan data. Under the HMDA Act the Department of Housing and Urban Development (HUD) is liable for the collection of data, processing and publication of HMDA related books, posters, software, and data compilations

(3) A description ofthe supplies or services required to meet the agency’s needs (including the estimated value).

Under the Home Mortgage Disclosure Act the Department of Housing and Urban Development (HUD) is liable for the collection of data, processing and publication of HMDA related books, posters, software, and data compilations. HMDA requires HUD to conduct annual surveys of both federal Housing Administration lenders and unregulated mortgage companies and to make the public portions of this information available to the public. The Federal Reserve Board (fRB) compiles HMDA required data from these lending institutions and issues annual disclosure statements as to asset size, net worth and status of loan applications. The total value is $645,833.00.

JUSTIHCATION FOR OTHER THAN FULL & OPEN COMPETITION:

The statutory authority permitting the sole sourcing of services is (see FAR 13.501(a)(2).

Only one source is capable of responding due to the unique or specialized nature of the work.

(5) A demonstration that the proposed contractor’s unique qualifications or the natztre of the acquisition requires use of the authority cited.

The purpose of the Home Mortgage Disclosure Act (HMDA) is to provide the citizens and public officials of the United States with sufficient information to enable them to determine whether depository institutions are filling their obligations to serve the housing needs of the communities and neighborhoods in which they are located and to assist public officials in their determination of the distribution of public sector investments in a manner designed to improve the private investment environment.

The HMDA tasked the Federal Financial Institutions Examination Council to implement a system to facilitate access to data required to be disclosed under this section. The Federal Financial Institutions Examination Council (FFIEC), is comprised from a group of Federal entities including the Office of the Comptroller of the Currency (0CC), the Federal Deposit Insurance Corporation (FDIC), the Board of Governors of the Federal Reserve System (Board), the Office of Thrift Supervision (OTS), and the National Credit Union Administration (NCUA), and the U.S. Department of Housing and Urban Development, or, collectively, the Agencies. The Agencies comprise the federal Financial Institutions Examination Council (FfIEC). In accordance with the HDMA, 12 USC § 2801 et seq., the Agencies collect certain HMDA data that reporter institutions are required to file.

The FRB board is the contracting activity and it relies on Section 10 of the Federal Reserve Act as the authority to enter into this agreement. The FRB is performing administrative responsibilities for the FFIEC in accordance with 12 U.S.C. Section 3307(b) and Sections 10 and 11 of the federal Reserve Act, 12 U.S.C. 244 and 248.

(6) A description ofefforts made to ensure that offers are solicitedfrom as manypotential sources as is practicable, including whether a notice was or wilt be publicized as required by Subpart 5.2 and, tf not, which exception under 5.202 applies.

A Notice of Intent to Sole Source to the Board of Governors of the Federal Reserve System was posted on November 29, 2018 on the Federal Business Opportunity website that closed December 14, 2018. Once the award is issued, this justification will be publicized on the Federal Business Opportunity website.

(7) A determination by the contracting officer that the anticipated cost to the Government will befair and reasonable.

Prior to the issuance of any contract award, the Contracting Officer will obtain pricing information and a price analysis will be conducted to sufficiently determine that the overall price represents a fair and reasonable price to meet the Government’s needs. Information will be obtained to evaluate the reasonableness of the price in accordance with FAR 13.5.

JUSTIFICATION FOR OTHER THAN FULL & OPEN COMPETmON:

(8) A description ofthe market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

Market research was conducted to fulfill FAR, Part 10, to determine if there was a contractor or agency in the marketplace that could provide disbursement to the Board of Governors Federal Reserve Board (FEE) for providing Home Mortgage Disclosure Act (FIMDA) services. A Notice of Intent was issued November 29, 2018 (FBO) no responses were received. Based on the Memorandum of Understanding (MOU) between HUB, the Board and other FFIEC members disbursements from HUB and other participating agencies have been paid as mandated by law from 20016—2019. Therefore, the market research outcome for the 2019 period showed that there is no other vendor that can provide these services except FFIEC. Disbursement in the amount of $645,833.00 is being made to the Board of Governors Federal Reserve Board as a proxy, because FFIEC is not a federal government agency.
