About this file
This is a Sole Source Justification (SSJ) document under FAR 13.501 for a commercial procurement exceeding the simplified acquisition threshold but not exceeding $7.5 million.
The Drug Enforcement Administration (DEA), through its Office of Acquisition and Relocation, is procuring Software Defined Radio (SDR) systems and cellular drive test analysis tools from Motorola Solutions Inc. The procurement is identified as purchase request/solicitation number D-26-ST-0139 and originates from the Office of Investigative Technology (ST). The contract will be a new award on a firm-fixed-price (FFP) basis with a final delivery date of December 31, 2026. The SDR systems are designed for operation in the HF/VHF/UHF/SHF bands and will support DEA field investigations of Drug Trafficking Organizations (DTOs) and Foreign Terrorist Organizations (FTOs). Motorola Solutions Inc. is identified as the sole source due to proprietary technology and unique features not available from other vendors, including SIM-free attached mode drive test survey capability, ability to probe 5G networks, and seamless integration with existing hardware. The justification cites Motorola's sole proprietary ownership of the technology and market research confirming no alternative vendors offer products meeting the necessary specifications and performance capabilities. All appropriate approval levels were obtained to waive synopsis requirements under FAR Part 5.202(a)(1) and 5.301(a)(3). The procurement authority is based on 41 U.S.C. 1901 and FAR 13.501(a) for acquisitions exceeding the simplified acquisition threshold.

FAR 13.501
May 2025 1
Sole source procurements should only be used when competitive solicitation procedures are not applicable to the requirement or are impracticable. Please remember, that contracting without promoting competition to the maximum extent practicable cannot be justified due to a lack of advance planning by the requiring activity or concerns related to the amount of funds available.
This document shall not be used for Federal Supply Schedule acquisitions.
1. Identification of the agency and the contracting activity, and specific identification of the document as a Justification for Other than Full and Open Competition.
Agency: Drug Enforcement Administration (DEA)
Contracting Activity Processing the Requirement:
Name of Organization Originating the Requirement:
Identification Number (purchase request/solicitation number):
2. The nature and description of the action being approved (e.g., new award, modification, follow-on to previous procurement, et.al.).
3. A description of the supplies or services required to meet the agency's needs.
Total estimated value inclusive of all options:
Period of performance or final delivery date:
May 2025 2
4. An identification of the statutory authority permitting other than competition to the maximum extent practicable.
The simplified acquisition threshold is defined in FAR 2.101. Per FAR 6.001, acquisitions of certain commercial items exceeding the simplified acquisition threshold and conducted using simplified acquisition procedures as authorized by FAR 13.501 are exempt from the requirement to promote full and open competition. Such acquisitions must promote competition to the maximum extent practicable as required by 41 U.S.C. 1901 and FAR 13.104. Because this acquisition will be conducted without promoting competition to the maximum extent practicable, this justification is prepared for review and approval in accordance with FAR 13.106-1(b)(2) and 13.501(a).

Text10: The unique nature of Motorola's products provide the US government capabilities not available to the general public. This equipment will be utilized in support of DEA field investigations of DTOs and FTOs. The features present are not included in any other vendor's products and allow improved risk mitigation, enhanced performance, and consolidated products solely distributed through Motorola.

Text12: Government will determine costs fair and reasonable per FAR 13.106-3(a)(2)
Text13: Motorola Solutions Inc. is the only company that sells these devices, which incorporate proprietary technology essential for the Government's operational requirements. Market research has confirmed that no other vendors offer products with the necessary specifications and performance capabilities. The device's unique features, such as the SIM-free attached mode drive test survey is proprietary to Motorola and crucial to being able to conduct technical analysis of signal environments for current and emergent technologies. Also, the ability to probe 5G networks and integrate with existing hardware seamlessly and directly from the survey tool on the spot is critical for operational needs, and no alternative products meet these criteria. Failure to procure this device from Motorola Solutions Inc. would result in an inability and reduced capacity to provide accurate analysis and successfully conduct technical surveillance, i.e., precision geolocation and target development in the field against 4G and 5G networks and, thereby compromising the Government's ability to compete mission objectives.

Text19: Currently, the only course of action to overcome barriers to competition is if Motorola sells its rights to another entity. The Government does not foresee Motorola selling its fore sought products in the near future.
