Motorcycle Safety Training Combo

Combined Synopsis/Solicitation ‘Combo’:

Motorcycle Safety Training

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with (IAW) the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;

quotes are being requested and a written solicitation will not be issued.

(ii) Solicitation no. FA5000-22-Q-0019 is issued as a Request for Quotation (RFQ) IAW FAR Part 13.106-1(b)(1)(i).

(iii) This solicitation document and its incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-03 Item I, effective 1 January 2022. All incorporated DFARS provisions and clauses are those in effect through DPN 20211230, effective 30 December 2021. All incorporated AFFARS provisions and clauses are those in effect through AFAC 2021-0726, effective 26 July 2021.

(iv) This is a full and open requirement under the North America Industrial Classification System (NAICS) code –611692 Automobile Driving Schools with a small business size standard of $7.5 million and Product Service Code (PSC) U099 Education/Training

(v) The government intends to award a firm-fixed price contract for Motorcycle Safety Training. Please see Attachment 1, Price Schedule, and Attachment 2, Performance Work Statement for a full description of the Government’s requirement. The following table represents the proposed Line items, quantities, and unit of measure.

(vi) This requirement is for 673ABW/SE for Motorcycle Safety Training. Under the authority of FAR Part 13.106-1, the Contractor shall provide all management, personnel, equipment, supplies, facilities, transportation, tools, materials (instructional and non-instructional), supervision, and other items and non-personal services necessary to perform Motorcycle Safety Training as defined in the Performance Work Statement (PWS) except for those items specified in paragraph 2.6. as Government or student furnished property and/or services.

The Contractor shall plan, coordinate, and conduct a non-personal services contract to provide Basic Rider’s Course (BRC/BRCu), Basic Rider’s Course 2 (BRC2/BRC2u), and Advanced Rider’s Course (ARC/ARCu) motorcycle trainings for Joint Base Elmendorf-Richardson (JBER), AK personnel. The training will follow Motorcycle Safety Foundation (MSF), Department of Defense Instruction (DoDI) 6055.04 including Air Force Instruction (AFI) 91-207 and Army Regulation (AR) 385-10 guidelines. During all aspects of the course, the instructors must possess the appropriate MSF certifications - IAW Attachment 2 –Performance Work Statement (PWS).

(vii) All items shall be delivered FOB destination and the Period of Performance will be from 1 Mar 2022 to 28 Feb 2025.

(viii) FAR 52.212-1 Instructions to Offerors -- Commercial Items (Nov 2021) is hereby incorporated by reference, with the same force and effect as if it were given in full text. In addition to the following addendum, all terms and conditions of FAR 52.212-1 remain in effect. The following have been tailored to this procurement and are hereby added via addendum:

1. To assure timely and equitable evaluation of the quote, the Offerors must follow the instructions contained herein. The quote must be complete, self-sufficient, and respond directly to the requirements of this solicitation. If awarded the contract the contractor is required to submit a signed copy of the contract confirming receipt of the contractual document within one (1) business days.

2. Specific Instructions: The response shall consist of the following:

a. Part 1 - Technical Acceptability - Submit one (1) copy of technical acceptability narrative as specified in the Performance Work Statement (Paragraph 2)

b. Part 2 – Price - Submit one (1) completed copy of price schedule (Attachment 1)

c. Complete all required checked boxes in the following FAR provisions and clauses: 52.204-24, 52.204-26, 52.209-11, and DFAR provision 252.204-7017 AND any other clause that requires the contractor to complete that is not covered in the SAM.

3. FAR 52.212-2 Evaluation -- Commercial Items (Nov 2021) this provision has been tailored to this procurement and is provided in full-text below:

(a) The Government will award a purchase order resulting from this solicitation to the responsible offeror whose proposal conforming to this solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate each proposal:

(1) Price: The Government will select the proposal with the lowest evaluated price which meets or exceeds the acceptability standards for non-price factors.

(2) Technical acceptability: The Government will evaluate the technical proposal for acceptability based on the requirements within the Performance Work Statement (PWS).

The Government will rank the proposals from lowest price to highest price.

The price of a six month extension authorized by 52.217-8, Option to Extend Services, will be added to the total proposed price. Option to Extend Services formula calculation is discussed below:

The Total Evaluated Price (TEP) is a two-part computation. First, the offerors total proposed price will be determined by adding the total of the base year and each option year identified in the Pricing Schedule. The sum will be the offerors total proposed price. Second, the proposed price plus the sum of Option to Extend Services clause 52.217-8 formula (shown below) will constitute the TEP.

The formula for the Option to Extend Services amount is as follows:

CLIN unit price for Option Year 2 multiplied by .5 = Option to Extend Services amount Evaluating the Option CLINs does not obligate the Government to exercise the Options.

Next the Government will evaluate the technical proposal on an acceptable or unacceptable basis, starting with the lowest priced proposal. The Acceptable and unacceptable definitions are as follows:

Acceptable: Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable: Proposal does not clearly meet the minimum requirements of the solicitation.

Any factor that is “unacceptable” will render the entire proposal unacceptable and, therefore not awardable. The next lowest priced proposal will then be technically evaluated.

If the lowest priced evaluated proposal is judged to have an “acceptable” technical rating and is determined to be responsible, that offeror represents the best value for the Government and the evaluation process stops at this point.

Price: The offeror’s separately priced line items or subline items shall be analyzed to determine if the prices are unbalanced in accordance with FAR 15.404-1(g). The Government reserves the right to perform price realism analysis. If the Government elects to perform a price realism analysis, the Government reserves discretion over the method within which it performs its price realism analysis. If the Government elects to perform a price realism analysis and finds a quote unrealistic, the Government may withhold award to that offeror.

Offerors are cautioned to submit sufficient information and in the format specified in 52.212-1, Instructions to Offerors – Commercial Items, of this solicitation. Offerors may be asked to clarify certain aspects of their proposals. Exchanges conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision. The Government intends to award a contract without discussions with respective offerors, however, will reserve the right to conduct them if deemed in its best interest.

Award will be made once price fair and reasonable has been determined IAW FAR Part 13.106-3(a). The proposal may also be evaluated for price reasonableness IAW FAR Part 15.404-1.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs

(c) through (u) of this provision.

(xi) FAR 52.212-4, Contract Terms and Conditions—Commercial Items (Nov 2021) is hereby incorporated by reference with the same force and effect as if it were given in full text.

The Government may require continued performance of any services within the limits and at the rates specified in the contract.

These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor not later than 15 days prior to contract expiration.

(a) The Government may extend the term of this contract by written notice to the Contractor within not later than 15 days prior to contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months.

DFARS 252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (DEC 2018)

(a) Definitions. As used in this clause—

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide AreaWorkFlow (WAWF).

Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall—

(1) Have a designated electronic business POC in the System for Award Management at https://www.sam.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:

(1) Document type. The Contractor shall use the following document type(s). 2-in-1 Services

(2) Inspection/acceptance location. The Contractor shall select the following inspection/acceptance location(s) in WAWF, as specified by the contracting officer. Destination/Destination

(3) Document routing. The Contractor shall use the information in the Routing Data Table below only to fill in applicable fields in WAWF when creating payment requests and receiving reports in the system.

(4) Payment request and supporting documentation. The Contractor shall ensure a payment request includes appropriate contract line item and subline item descriptions of the work performed or supplies delivered, unit price/cost per unit, fee (if applicable), and all relevant back-up documentation, as defined in DFARS Appendix F, (e.g. timesheets) in support of each payment request.

(5) WAWF email notifications. The Contractor shall enter the email address identified below in the “Send Additional Email Notifications” field of WAWF once a document is submitted in the system.

AFFARS 5352.201-9101 OMBUDSMAN (OCT 2019) is hereby incorporated by full text below:

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern.

The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of quotes, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, AFICA/ KH (Chief Enlisted Manager), 25 E. Street, Suite B-100, JBPH-H, HI 96853-5427, Phone: (808) 449-8569 or FAX: (808)449-8571.

Concerns, issues, disagreements, and recommendations that cannot be resolved at the Center/MAJCOM/DRU/HQ AFICA/AFISRA/SMC ombudsman level, may be brought by the interested party for further consideration to the Air Force Ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (571) 256-2395, facsimile number (571) 256-2431.

(d) The ombudsman has no authority to render a decision that binds the agency.

(a) The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation.

(b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or Security Forces for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver s license, current vehicle registration, valid vehicle insurance certificate, and Entry Authorization Letter to obtain a vehicle pass.

(c) During performance of the contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site.

(d) When work under this contract requires unescorted entry to controlled or restricted areas, the contractor shall comply with AFI 31-101, Integrated Defense, and DODMAN5200.02_AFMAN 16-1405, Air Force Personnel Security Program. Contractors requiring access to any area on Joint Base Elmendorf-Richardson (JBER) shall comply with installation,COVID-19 policies and mandates and the current revision of the DoD Force Health Protection Guidance (FHPG) Supplement 23. These policies and mandates frequently change. COVID-19 policies and mandates are found at https://www.jber.jb.mil/Coronavirus/ for JBER COVID-19 Policy Memo and https://www.defense.gov/News/Publications/ for FHPG Supplement 23. Failure to comply with the guidelines or restrictions may result in suspended access to JBER or debarment. Contractors shall comply with the above-referenced documents.

(e) Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office.

(f) Failure to comply with these requirements may result in withholding of final payment.
