About this file

This document is an amendment to an Invitation for Bids (IFB) issued by the State of Maryland Military Department (MMD) for the conservation and installation of a World War II mural. The IFB seeks a contractor to provide services to conserve and reinstall the 20-foot by 40-foot mural, which was rescued from condemned buildings and needs cleaning, minor restoration, and sealing before being installed on a floating wall at the Maryland Museum of Military History in the Fifth Regiment Armory. The bid due date has been extended to June 8, 2023, and the bid opening is scheduled for June 9, 2023. The contract term is for one year, with a possible six-month extension.

The amendment provides updated details on the scope of work, which no longer includes installing the mural on a floating wall, and revises the invoicing schedule to allow for progress payments. Insurance requirements have also been updated, with Errors and Omissions and Crime/Employee Theft coverage no longer required. Bidders are now only required to submit one copy of the required documents through the eMMA eProcurement system.

Additional Questions for World War II Mural

1. Question: Who attended the walkthrough (in person and remotely)?

MMD/MMMH’s Response: Please see the Pre-Bid Conference Summary.

2. Question: What is the purpose of the floating wall? Would you be willing to entertain an alternative installation support to the floating wall?

MMD/MMMH’s Response: The installation of the mural to the floating wall has been removed from the solicitation. See Amendment #3.

3. Question: Will drawings and construction/finish details be provided for the support wall?

When will these be available?

MMD/MMMH’s Response: Please see the response to Question #2.

4. Question: Why is a floating wall necessary rather than attaching directly to the existing wall?

What is the timeline for the project, including major milestones?

If attached to the wall directly that would increase the expansion and contraction as that wall has marked temperature fluctuation.

MMD/MMMH’s Response: Please see the response to Question #2.

5. Question: Is there a preferred mural installation methodology or any constraints/restrictions on installation methodology?

MMD/MMMH’s Response: There is no preferred mural installation methodology; however, a restraint is for nothing to be done that is not easily reversible. Small nails and/or screws would facilitate the ability to reinstall/move the installation to another location should the Maryland Museum of Military History be moved to an alternate location. (This is not anticipated at this time). Glues should not be considered an easily reversible manner of installation for this project.

Nails and screws will not be inpainted.

6. Question: Would you be willing to display an alternate format of installation that does not require cutting the mural, such as installing a smaller selection of panels or a printed reproduction?

MMD/MMMH’s Response: No, but this no longer applies to this solicitation. Please see response to Question #2.

7. Question: Will the installation location be climate controlled?

MMD/MMMH’s Response: Yes, there are plans to locate the installation within proper museum grade climate control. An architectural study is being conducted later this year. Until then, improved smaller units will be purchased for the WWII room for air purification and humidifying/dehumidifying.

8. Question: What is the intended access for installation (lifts or scaffolding)?

MMD/MMMH’s Response: Please see response to Question #2.

9. Question: You have not included a project start date, or completion deadline in your bid specifications other than the contract will be made for one (1) year with possible extension of an additional six (6) months. What is the anticipated start and end date of this contract?

MMD/MMMH’s Response: We anticipate awarding this contract June, 2023. The duration of this contract will be one year from the award date, and a unilateral option of six months may be exercised by the Department, if needed.

10. Question: If we complete the conservation of the mural before the floating support wall is built, can we return it to your facility for you to store ahead of an installation date?

MMD/MMMH’s Response: Please see response to Question #2.

11. Question: What is your anticipated completion date for the floating mural support wall?

MMD/MMMH’s Response: Please see the Response to Question #2.

12. Question: The materials specified for the floating wall construction, and how it is to be built could greatly affect how we structure our bid for the installation portion of this project. There is no way to give you an accurate cost for installation of the mural without this information. Can you send us a copy of the project specifications for the floating wall?

MMD/MMMH’s Response: Please see the Response to Question #2.

13. Question: Is it your intention to build a floating wall that is the exact shape and size of mural, or will it be a complete wall (floor to ceiling and extend from the right side of the exterior windows to the left side of the double doors exiting the room)? Or will it be some dimension in between? Please specify.

MMD/MMMH’s Response: Please see the Response to Question #2.

14. Question: If we finish conservation of the mural prior to your ability to receive delivery of the mural, can we invoice you for the completion of the conservation work at that time?

MMD/MMMH’s Response: Please see the Response to Question #2.

15. Question: Most conservation contracts for projects as large as this one, allow for percentage completion invoicing on at least a monthly basis frequently corresponding to finishing stages of the process (i.e. pick up and preliminary report, cleaning, consolidation, and inpainting/varnishing). Would you entertain a different invoicing proposal in our bid submission similar to the one noted above?

MMD/MMMH’s Response: Yes. Please see the revised bid form and the updated Invoicing Section in this Amendment (Page 6).

16. Question: Will the contractor be allowed to operate your scissor lift?

MMD/MMMH’s Response: Please see response to Question #2. This scissor lift is no longer needed.

17. Question: How many people are allowed on the scissor lift you are providing?

MMD/MMMH’s Response: Please see response to Question #2. This scissor lift is no longer needed.

18. Question: What is the fully extended work height of the scissor lift that will be provided?

MMD/MMMH’s Response: Please see response to Question #2. This scissor lift is no longer needed.

19. Question: What is the working platform size of the scissor lift?

MMD/MMMH’s Response: Please see response to Question #2. This scissor lift is no longer needed.

20. Question: How do you want the carpeted floor protected while using your scissor lift?

MMD/MMMH’s Response: Please see response to Question #2. This scissor lift is no longer needed.

21. Question: None of your insurance requirements cover the artwork against catastrophic loss, theft, or vandalism while in transit or at our conservation facility. Fine Arts Insurance covers these issues. Will this be required even though it is not mentioned in the bid specifications regarding insurance?

MMD/MMMH’s Response: No, Fine Art Insurance is not required as part of this solicitation.

22. Question: In order for us to properly insure your mural (Fine Arts Insurance) while in our custody we need to have a current appraisal value for this mural. Could you provide that value?

MMD/MMMH’s Response: Fine Arts Insurance is not required. However, the mural has been valued at approximately $80,000.

23. Question: It is not normal for an art conservation project to require Errors and Omissions insurance, but it does happen on rare occasions. A qualified professional art conservator will be vetted prior to the start of this project, plus guaranteeing/warrantying the work and materials for two (2) years. The cost for this could be as little as $16,000 [for two (2) years since this insurance can only be obtained for yearly increments, covering the one and half (1.5) years of the contract] to as much as $40,000 [for four (4) years including the warranty period]. Since there is no timeline on the floating wall construction, all contractors must assume that they will need the Errors and Omissions insurance through the contract period of one and a half (1.5) years [which means two (2) years with insurance companies]. Is having Errors and Omissions insurance necessary?

MMD/MMMH’s Response: Errors and Omissions Insurance has been removed from the solicitation. In addition, see Response to Question #2 as the floating wall has been removed from the solicitation.

24. Question: If you can guarantee that the floating wall construction will be completed within the first (1st) year of the contract, and allow ample time for the contractor to install the mural during the first (1st) year of the contract, then only one (1) year of Errors and Omissions insurance would be necessary. Providing you do not require this insurance through the two (2) year warranty period, the cost would be closer to $8,000. Can you guarantee that the floating wall will be built within the first (1st) year of the contract so that a contractor can install the mural within the first (1st) year of the contract?

MMD/MMMH’s Response: Please see the responses to Question #2 and Question #23.

25. Question: If having Errors and Omissions insurance is absolutely necessary, does this need to be carried through the two (2) year warranty period, covering four (4) years (since E and O insurance can only be obtained for yearly increments)?

MMD/MMMH’s Response: Please see the response to Question #23.

26. Question: Many conservators do not routinely carry Errors and Omissions insurance.

Obtaining this insurance will be costly. If any other bidders have the required amount of Errors and Omissions insurance because another project has already paid for it, then that would make it an unfair advantage in a low bidding process. Is the Errors and Omissions insurance going to be included in the evaluation of a low bid, since it is a costly addition to the bid?

MMD/MMMH’s Response: Please see the response to Question #23.

27. Question: Under 5.4 Required Bid Submission section in the IFB, 5.4.4 Completed Required Attachments states that we need to “Submit three (3) copies of each with original signatures” which references Attachment B, C, and F-1. However it also states under 5.5 Delivery that bids shall only be accepted through eMMA. Under section 7, IFB Attachments and Appendices it states, “For documents required as part of the Bid: 1. For email submissions, submit one (1) copy of each with signatures. 2. For paper submissions, submit two (2) copies of each with original signatures. All signatures must be clearly visible.” Since bids are only allowed to be submitted through eMMA and not as a hardcopy or email, is there a way to submit three (3) copies of signed originals through eMMA or should the submitted bid include three copies of each of those documents?

MMD/MMMH’s Response: This Bid Submission has been amended. You can submit one copy through eMaryland Maryland Marketplace Advantage.

28. Question: Is the reason for a possible six (6) month extension to the contract because you feel that the contractor may not have enough time to complete both conservation and installation within one (1) year, or because the floating wall may not be completed within one (1) year? If this is the case, this will have serious cost implications to any contractor’s bid due to the insurance requirements.

MMD/MMMH’s Response: Please see the response to Question #2. The 6-month extension was provided for the benefit of the contractor/conservator to ensure completion of the work.
