The following are answers to questions submitted to MMCAP Infuse:
1. Question: The document outlines options about working with wholesalers as well as direct sales. Is the supplier allowed to utilize one or the other as opposed to both? Will this impact any mentions of chargebacks should the supplier choose to use direct purchasing options?
Answer: Should a responder win an award, they will have the option for indirect, direct, or both.
Mentions of chargebacks apply to only indirect sales.
2. Question: Are suppliers allowed to negotiate the sample agreement after the RFP has been awarded?
Answer: Responders should provide their initial redlines, if any, in their response. Negotiations would then move forward upon receiving an Intent to Award.
