The bid solicits sealed proposals for milk and juice products to be delivered to 19 participating school districts, including Brighton CSD, Brockport CSD, Churchville-Chili CSD, and others. Bidders must provide detailed information including customer references, company details, nutritional specifications, health inspection reports, and complete various certifications.
The bid includes specific requirements for milk and juice products, emphasizing the Buy American provision, which mandates that over 51% of agricultural commodities must be produced in the United States. Pricing is categorized into two groups: Category A items (drinking milk carton products) with an escalator clause based on the Class I milk price, and Category B items (non-drinking milk, yogurt, cheese, and juice products) with fixed pricing for the contract term. Bidders must provide comprehensive documentation, including nutritional information, ingredient lists, insurance certificates, and Workers' Compensation forms. The contract allows for potential additional participants under NYS General Municipal Law, and BOCES reserves the right to award the bid on an aggregate basis or by individual line items to ensure the best value for participants.

OBLIGATION OF BIDDERS
At the time of the opening of the bids, each bidder will be presumed to have read and be thoroughly familiar with the contract documents. The failure or omission of any bidder to receive or examine any form, instrument, or document shall in no way relieve any bidder from any obligation in respect to the submitted bid or to conform to all specifications including all addenda issued.
RESPONSIBILITIES
Bidder Responsibility - The Bidder shall be responsible for providing, delivering, and inspecting all materials ordered because of this bid. The Bidder is responsible for following all instructions as described in this document.
BOCES' Responsibility - Although this bid was issued, evaluated, and awarded by the Monroe 2 – Orleans BOCES at the request of itself and participants, BOCES' liability under contract is limited to coordination and BOCES issued purchase orders only.
Districts’ Responsibility - Purchase Orders will be issued to the designated vendor(s) by the districts listed, authorized in accordance with established General Municipal Laws and Accounting Practices. Those participants are solely responsible in contract for obligations entered into with the vendors.
QUANTITIES
This contract does not allow for minimum order/maximum delivery amounts. The quantities indicated in the specifications represent estimated total requirements for the contract term.
The totals are estimates ONLY and should not be construed to represent either the maximum or minimum amounts to be purchased during the contract term.
OTHER CONTRACTS
The Participant(s) reserves the right to purchase goods and services from any avenue legally available by NYS law throughout the duration of any contract resulting from this bid.
BIDDER QUALIFICATIONS
To be considered responsive, the Bidder must demonstrate that, immediately upon award of contract, the Bidder can meet the terms and conditions of this contract. By submitting a bid, a Bidder acknowledges and accepts the right of the BOCES, at their sole discretion, to apply whatever criteria they deem to be reasonable in determining whether a Bidder has demonstrated its capability of meeting the terms and conditions of this contract.
In addition to the requirements of the General Conditions, each successful Bidder must be able to provide the districts, upon request, sufficient evidence that the Bidder can be reasonably expected to meet the requirements of this contract. Specifically, any Bidder must provide evidence of a multi-year track record of having met the needs of customers of the size and complexity of the districts.
The awarded Bidder must be able to demonstrate the experience, financial stability, personnel, stock, plan capacity and systems requirements to perform this contract. Major criteria to be considered in evaluating these factors are:

BUY AMERICAN REQUIREMENT
Section 104(d) of the William F. Goodling Child Nutrition Reauthorization Act of 1998 (Public Law 105- 336) added a provision, Section 12(n) to the NSLA (42 USC 1760(n)), requiring school food authorities (SFA’s) to purchase, to the maximum extent practicable, domestic commodity of products.
Section 12(n) of the NSLA defines “domestic commodity or product” as an agricultural commodity that is produced in the United States and a food product that is processed in the United States using substantial agricultural commodities that are produced in the United States. “Substantial” means that over 51 percent of the final product consists of agricultural commodities that were grown domestically. Products from Guam, America Samoa, Virgin Islands, Puerto Rico and Northern Mariana Islands are allowed under this provision as territories of the United States. The Buy American provision (7 CFR Part 210.21(d)) is one of the procurement standards SFA’s must comply with when purchasing commercial food products served in the school meal programs.
In addition, School Food Authorities must assure that all procurements using federal funds comply with the “Buy American” provision of Section 104(d) of the William F. Goodling Child Nutrition Act of 1998, requiring to the maximum extent practicable, to purchase products produced in the U.S. Bidders should submit U.S. produced items wherever possible. Only items which are not produced in the U.S., (i.e., mandarin oranges, pineapple, and tuna) may be bid noting the country of origin as a variance.
BOCES 2 COOP MILK&JUICE SUPPLY RFB-2128-25 23
LIMITED EXCEPTIONS TO THE BUY AMERICA PROVISION
There are limited exceptions to the Buy American provision which allow for the purchase of foods not meeting the “domestic” standard as described above (i.e., “non-domestic”) in circumstances when use of domestic foods is truly not practicable. These exceptions, as determined by the SFA, are:
• The product is not produced or manufactured in the U.S. in sufficient and reasonably available quantities of a satisfactory quality; or
• A competitive bid reveals the costs of a U.S. product are significantly higher than the non- domestic product.
Should the awarded Bidder request an exception to the buy America provision, it is the awarded Bidder’s responsibility to provide sufficient evidence that the product in question does not exist in any form that would comply with the provision. Should the BOCES determine that the evidence supplied by the Bidder does not meet the requirements for an exception, the vendor will be required to supply the appropriate produce or be deemed nonresponsive to the bid or contract.
ESTIMATED QUANTITIES
The bid form price sheets provide estimated quantities for all items bid. Details of the quantities by district can be found on the distribution spreadsheet. These estimates do not guarantee maximum or minimum quantities for the contract period; this is noted as an exception to the General Conditions. Each district will issue purchase orders for actual quantities needed. Bid participants will notify the awarded bidder if estimated quantities are significantly under or overestimated. All items awarded are available to be purchased by all participants, whether quantities were estimated by a district for any item. The participants reserve the right to purchase items from any other bids allowable under NYS General Municipal Law, including but not limited to NY State and Monroe County contracts should doing so result in savings. There cannot be any minimum order requirements or splits. The awarded bidder will not mandate any minimum requirements per item.
NUTRITIONAL AND INGREDIENT INFORMATION
All the nutritional ingredient spec sheets are to be provided with the bid submittal for review of the products prior to an award being made. In addition, within 30 days of award notification, the awarded vendor will provide to each Food Service Director the nutritional information and an ingredient list for each item awarded. No orders will be placed prior to receiving this required information.
FOOD SAFETY
Vendors must ensure food safety during storage, handling, and transportation. Compliance with all local, state, and federal laws, regulations, practices and guidance regarding sanitary practices, temperature control, prevention of cross-contamination and all other food safety related matters is mandatory. Food received that is deemed not to be fresh and/or is unusable or unsatisfactory will immediately (same or next day) be replaced or credited at the participant’s discretion. Non-compliance of food safety laws and regulations may result in contract termination and revert to the next lowest bidder.
BOCES 2 COOP MILK&JUICE SUPPLY RFB-2128-25 24
SAMPLES
Samples may be requested at the discretion of the Monroe 2-Orleans BOCES, Director of Procurement and the samples must be received by the requested date.
DELIVERIES
All milk is to be delivered in clean, sterilized crates. Leaking cartons or pouches are not acceptable. The awarded vendor will contact the Food Service Director in each participating district, (within one week after award notification) to plan delivery schedules for the year. The Food Service Director will advise the awarded bidder of all scheduled school closings and make alternate delivery arrangements should any of the closings take place on a regularly scheduled delivery day. Additionally, a contingency plan for unscheduled closings will be developed. These alternate delivery agreements may vary by district. It shall be understood that deliveries shall not be left outside of buildings. The awarded vendor(s) must be able to make weekly deliveries to the participants.
Deliveries must be made between 7:00 a.m. and 1:00 p.m. unless agreed upon differently in advance between the district and the vendor. Every delivery must provide a packing list indicating the purchase order number, name of item, item number, quantity, and any other pertinent information necessary to identify the items shipped.
