About this file
This is a Memorandum for Record documenting the response to a Notice of Intent (NOI) regarding contract FA300223R0016/FA300225D0003, dated January 7, 2025, from the 338th Enterprise Sourcing Squadron at JBSA-Randolph, Texas.
The memorandum addresses the government's intent to award a sole-source Indefinite Delivery/Indefinite Quantity (IDIQ) contract to Lockheed Martin Corporation for C-130J training services, with an anticipated award date of January 8, 2025. It specifically documents the response of Simuladores Hornero, an Argentine company, to the NOI and explains why they were deemed ineligible for the contract. The key disqualifying factors were that Simuladores Hornero is a foreign-owned corporation without the required waiver for offshore procurement, and they lack access to a C-130J class "D" simulator with six degrees of freedom, specific courseware materials, and experienced C-130J instructors. The NOI was posted on SAM.gov on December 19, 2024, with responses due by January 3, 2025.

CONTRACT/SOLICITATION: FA300223R0016/FA300225D0003
DATE: 07 January 2025 SUBJECT: Response to Notice of Intent posted 19 December 2024
In accordance with the Justification and Approval document for Other Than Full and Open Competition approved on 27 March 2023, paragraph V states that a Notice of Intent (NOI) will be issued fifteen (15) days prior to contract award. As a result, a NOI to sole source was posted through the government point of entry (https://www.sam.gov) on 19 December 2024 with a suspense date of 03 January 2025. The NOI stated that the 338th Enterprise Sourcing Squadron intends to award a single firm fixed price (FFP) Indefinite Delivery/ Indefinite Quantity (IDIQ) contract to Lockheed Martin Corporation with an anticipated effective award date of 08 January 2025. Furthermore, the NOI stated that the notice was not a request for competitive proposals nor a solicitation. The Government’s determination not to compete the C130J requirement is at the Government’s discretion.
On 26 December 2024 Simuladores Hornero responded to the NOI requesting additional information regarding the C130J contract opportunity. Simuladores Hornero stated that their company specialized in the manufacturing of aircraft simulators, including Flight Training Devices, mock-ups and training manuals. Additionally, Simuladores Hornero stated that the simulators are installed in a flight training center certified by ANAC Argentina.
Based on the email provided by Simuladores Hornero market research was accomplished through a combination of a search in SAM.gov and an online search of their website. A search of Simuladores Hornero in Sam.gov was accomplished on 6 January 2025. The search did not return any results for active records. Furthermore, based on the online search of the company website it appears that Simuladores Hornero is a foreign owned corporation located in Argentina.
The C130J acquisition does not have a waiver approval to allow for offshore procurement making a foreign owned company unawardable for this C130J training requirement.
Additionally, based on the online search it does not appear that Simuladores Hornero currently has access to a C130J class “D” simulator with six degrees of freedom, C130J specific courseware material or instructors experienced in the C130J model.
As a result of the above statement Simuladores Hornero was determined to be ineligible for consideration of the C130J contract award.
