About this file
This is a Memorandum for Record documenting a brand name justification for limiting competition on a federal contract action below the simplified acquisition threshold.
The 1st Special Forces Command (1st SOCOM) at Fort Bragg, NC, seeks to procure five Clearview AI software licenses through a fixed-price purchase order using Operations & Maintenance, Army (OMA) funding in Fiscal Year 26. The requirement is a follow-on acquisition for Clearview AI, a facial recognition software platform that parses social media photos to identify potential subjects and victims from diverse social media sources. The contract action is authorized under FAR 16.505(a)(4) (Brand Name) and is being restricted to a single source due to claimed technical superiority and sole-source capabilities. The base period runs from March 20, 2026, to March 19, 2027, with three optional one-year renewal periods extending through March 19, 2030. The total contract value is redacted in the document. The contracting activity determined that Clearview AI possesses a 99.85% accuracy rating confirmed by the National Institute of Standards and Technology (NIST), making it the only AI software capable of meeting 1st SOCOM's requirements for rapidly analyzing vast amounts of facial data and identifying high-value targets with the required accuracy rate. No other comparable sources were identified during market research; alternative platforms such as Faceck.ID and Pimeyes.com were evaluated but deemed insufficient. The justification will be redacted and posted with the solicitation in accordance with federal posting requirements for brand name restrictions exceeding $25,000.

6. Reasons for Authority Cited:
a. Clearview AI is sole source facial recognition software that parses through social media photos and enables users to positively identify potential subjects and victims from diverse social media sources. This content is not readily available from any other AI source.
b. The U.S. government’s National Institute of Standards and Technology (NIST) have confirmed the superior accuracy and reliability of Clearview AI’s platform with a 99.85% accuracy rating. This platform allows us to stay ahead of our foreign competitors.
Currently this is the only AI software that can meet the requirements for the 1st Special Forces Command.
c. Without Clearview AI, DoD cannot rapidly analyze vast amounts of facial data, which makes it challenging to identify high-value targets with the required rate of accuracy needed for 1st Special Forces Group
7. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 ☐ do not apply due to the $ threshold, ☐ apply and will be followed, or ☐ do not apply due to an exception at FAR 5.202(a)(6).
Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A) unless:
☐ Action is NOT a brand name restriction and is under $250K, no posting required.
