HURLBURT FIELD FLORIDA
MEMORANDUM FOR RECORD
SUBJECT: Justification for Use of Lowest Price Technically Acceptable (LPTA) – FA441721QC099, Security Camera Upgrade
1. The subject solicitation is being issued to upgrade security camera system.
2. This acquisition is being procured under FAR Part 13, Simplified Acquisition Procedures and FAR Part 12, Acquisition of Commercial Items.
3. In accordance with DFARS 213.106-1(a)(ii), DFARS 215.101-2-70 regarding limitations and prohibitions on the use of the lowest price technically acceptance “source selection” processes are applicable to simplified acquisitions.
4. This procurement is not for any goods or services listed in Section 813(c)(1-3) of the 2017 National Defense Authorization Act (NDAA).
5. LPTA is the most appropriate evaluation method given the factors enumerated in Section 813(b)(1-6) of the 2017 NDAA and DFARS 215.101-2-70(a)(1):
a. Minimum requirements can be described clearly and comprehensively and expressed in terms of performance objectives, measures, and standards that will be used to determine the acceptability of offers;
b. No, or minimal, value will be realized from a proposal that exceeds the minimum technical or performance requirements.
c. The proposed technical approaches will require no, or minimal, subjective judgment by the technical evaluators as to the desirability of one offeror’s proposal versus a competing proposal;
d. The contracting officer has a high degree of confidence that reviewing the technical proposals of all offerors would not result in the identification of characteristics that could provide value or benefit;
e. No, or minimal, additional innovation or future technological advantage will be realized by using a different evaluation and selection process;
f. Goods to be procured are predominantly expendable in nature, are nontechnical, or have a short shelf life.
g. This determination is included in the contract file describing the circumstances justifying the use of the lowest priced technically acceptable evaluation process.
6. I, the Contracting Officer, find that use of lowest price technically acceptable for this acquisition is consistent with Section 813 of the 2017 NDAA as amended by Section 822 of the 2018 NDAA.
