SIMPLIFIED ACQUISITION SOLE SOURCE JUSTIFICATION
FOR ACQUISITIONS UNDER $250K
Activity: The Department of Health and Human Services, IHS, proposes to enter into a purchase order on a basis of other than full and open competition for the following acquisition as implemented by FAR Subpart 13.106.
1. PR#: __TBD__
2. Description of Supplies or Services:
Orientation/briefing on recommendations from Integritas Creative Solutions, LLC (ICS) Medical QA Review. The performance work statement at the end of this document details the requirement IHS intends to request from ICS.
3. Estimated Value of Procurement:
Redacted
4. Recommended Sources:
Integritas Creative Solutions, LLC
5. Reason for Sole Source/Limited Sources/Expedited Processing:
[X] Only one source (unique capabilities) [ ] Proprietary drawings, specifications, and/or engineering data, patents, copyrights.
[ ] Brand Name essential to the Government’s needs.
[ ] Standardization Program supported by Agency Head Determination and Findings (D&F).
[ ] Unusual and Compelling Urgency (limited sources) [ ] Authorized or required by statute
6. Briefly Explain why this is the only source that can meet the requirement:
The findings of the MQA Review were presented to limited HHS and IHS senior staff on January 31, 2020.
The primary purpose of the MQA was to learn from the reporting failures regarding sexual abuse of the past 20 years regarding a recently convicted IHS physician. The purpose of this acquisition is to enable IHS to maximize benefit from the work completed by ICS in the MQA Review.
This follow-on work needs to be conducted by the incumbent contractor as the sole source work is to use the information and data off of the investigatory report (FAR 27.405-1(a)(7)) ICS produced under the expired contract terms.
7. Impact to the Government if not awarded in accordance with the above:
Awarding a contract to other than ICS will hinder the Agency’s ability to conduct Quality Assurance of the deliverables to be produced by the contractor.IHS commissioned the MQA Review to address historical reporting failures cross the agency – in 3 Area Offices and in IHS HQ related to the highest priority of ensuring patient safety of Indian children. IHS is required by law to ensure safety of children in P.L. 101-
630, and this important MQA Review recently completed, requires successful implementation throughout the agency. This requirement is intended to further that objective.
