All projects are funded under 10 USC § 2818 authority from the FY25 National Defense Authorization Act, requiring a 10 percent project contingency set-aside with in-scope modifications funded from contingency and out-of-scope modifications requiring additional funding requests. Project Labor Agreements are anticipated for all acquisitions given their magnitude exceeding the $35 million threshold under Executive Order 14063.

2818 AUTHORITY

• Provided under 10 USC § 2818, FY25 National Defense Authorization Act

• Requires a set-aside of 10% for project contingency

• In-scope contract modifications are funded with available contingency funds

• Out-of-scope contract modifications must be funded with an additional funds request

PROJECT LABOR AGREEMENTS

• Federal Acquisition Regulations require Project Labor Agreements (PLAs) for Federal construction projects over $35 million (Executive Order 14063)

• Construction contractors must “become a party to a project labor agreement [PLA] with one or more appropriate labor organizations.”

• The PLA mandate continues to be in effect but is subject to appeal.

• Given the magnitude of each acquisition package for the MDTF 3200 block, USACE anticipates requiring PLAs for each acquisition.
