The solicitation seeks qualified contractors to perform TSI operations on two separate compartments totaling 118.2 acres: Compartment 3 (26 acres) and Compartment 4 (92 acres). The services include overstory and understory thinning, selective tree felling, vegetation management, and environmental preservation activities in accordance with detailed specifications and forestry standards. Responses are due by October 22, 2026, at 2:00 PM Central Time, with submission via MissouriBUYS powered by MOVERS preferred. The original contract period shall be from the date of award through one year. Tours of the work areas are available upon request by contacting Tyler Trantham at 417-256-7161. The procurement is structured as a blanket purchase agreement with the Department retaining the option to add or remove work areas and adjust priorities during the contract term.
The Department will award this contract to the lowest and best responsive bid, evaluating suppliers based primarily on cost (200 points maximum), compliance with all mandatory requirements, and adherence to Missouri state procurement laws and preferences. Suppliers must provide firm, fixed prices for each line item measured in acres, with all costs including labor, equipment, materials, and supplies incorporated into the bid. Prior to award, suppliers must demonstrate business compliance including: a "Vendor No Tax Due" certificate from the Missouri Department of Revenue, Secretary of State registration or exemption documentation, E-Verify enrollment if applicable, and conflict of interest certifications. The Department grants a 3% contract award preference goal to Service-Disabled Veteran Business Enterprises (SDVEs) and Honorably Discharged Veteran Enterprises (HDVEs) meeting OEO certification requirements, and a 5-15 bonus point preference for participation by Organizations for the Blind or qualified sheltered workshops. The contract period is subject to annual appropriation by the Missouri General Assembly, and the Department reserves the right to terminate for convenience with 30 days' written notice or for breach with opportunity to cure within 10 state business days.

2.2 Section 2. State of Missouri Tax Compliance
*1. In accordance with Section 34.040.7, RSMo, the Department is precluded from contracting with a supplier or its affiliate who makes sales at retail of tangible personal property or for the purpose of storage, use, or consumption in this state but fails to collect and properly pay the tax as provided in Chapter 144, RSMo.
In order to verify the supplier's State of Missouri tax compliance with the Missouri Department of Revenue (DOR), the supplier must provide a "Vendor No Tax Due" certificate issued by DOR prior to award. By providing the "Vendor No Tax Due" certificate, the supplier is verifying the supplier is either registered to collect sales and/or use tax in Missouri or is not making retail sales of tangible personal property or providing taxable services in Missouri.
The DOR will issue the "Vendor No Tax Due" certificate if the supplier is properly registered to collect and have properly remitted sales and/or use tax or if the supplier is not making retail sales in Missouri.
How to Obtain a "Vendor No Tax Due" Certificate
• A "Vendor No Tax Due" certificate can be obtained from the Missouri Department of Revenue when a business pays all of its sales/use tax in full, up to date, does not have a sales tax delinquency, or does not sell tangible personal property in Missouri.
• If taxes are due, depending on the payment history of the business, a cashier's check or money order may be required for payment before a "Vendor No Tax Due" certificate can be issued.
• A "Vendor No Tax Due" certificate can be obtained by completing and submitting the Request for Tax Clearance, Form 943, to the Missouri Department of Revenue, Division of Taxation & Collection. This form is available at http://dor.mo.gov/forms/943.pdf. Make sure to select the appropriate "Reason for Request' on page 2 of the form.
• For assistance, call (573) 751-9268 or email taxclearance@dor.mo.gov. Additional information regarding Section 34.040.7, RSMo, is available on the Department of Revenue's website at http://dor.mo.
gov/business/sales.
NOTE: Make sure to request a "Vendor No Tax Due" certificate as there are other similar tax clearance forms that do not meet this verification requirement. The steps to obtain a "Vendor No Tax Due" certificate is outlined at https://dor.

Scope of Work
General Requirements
a. The contractor shall provide Timber Stand Improvement (TSI) services on the White Ranch Conservation Area located in Howell County, Missouri, in accordance with the provisions and requirements stated herein and to the sole satisfaction of the Department.
Definitions a.
Acceptable Growing Stock (AGS) – A vigorously growing, single-stemmed, dominant or co-dominant tree that has apical dominance and is generally straight and free of defect.
b.
Unacceptable Growing Stock (UGS) – A suppressed, low-vigor tree that has one or more common defects, including poor timber form, excessive branching, sweep, crook, or rot from insects, fungus, or disease.
c.
Timber Stand Improvement (TSI) - is a management practice that improves a stand's species composition, structure, condition, health, and growth. This is achieved through the thoughtful selection and spacing of crop trees (leave trees) and the felling of undesirable trees to provide crop trees with optimum spacing and resources.
d.
Overstory Thinning TSI - is the thinning of immature, even-aged, non-merchantable, pole-sized trees by reducing stocking density and thereby concentrating growth potential on high-quality AGS trees.
e. Understory Thinning TSI - consists of reducing the dominance of suppressed small trees and pole trees in the understory. The understory consists of pole-sized or small trees that are not part of the main canopy. These trees are typically low-vigor and suppressed. Reducing these trees reduces shading of the forest floor and promotes plant diversity and desirable tree regeneration.
Familiarity with Conditions a.
The contractor shall acknowledge that they have taken reasonable steps to tour the work areas and are aware of conditions that could affect productivity and cost, including, but not limited to:
1. The quality and estimated number of trees to cut;
2. Road conditions, including ingress and egress; and
3. Weather and physical conditions at the site.
b.
Failure of the contractor to tour the work areas shall not relieve the contractor from any obligations under the contract.
c. The contractor shall understand and agree that it is their responsibility to become familiar with the conditions that exist prior to award of the contract. The contractor shall not be relieved of performance of the provisions and requirements specified herein.
Contractor's Obligation
Unless otherwise specified herein, the contractor shall provide all tools, equipment, materials, labor, supervision, and supplies necessary to perform the services herein.
Children/Juveniles
The contractor will agree that children or juveniles will not be allowed to accompany the contractor or contractor's employees on the job site.
Use of Subcontractors
The contractor shall not engage or use the services of subcontractors in performing the contract unless the contractor obtains prior written approval from the Department. Any subcontractors used in conjunction with this agreement shall be bound to the same requirements placed on the contractor.
Environmental Preservation Requirements
The contractor shall:
1. Perform TSI operations in a manner that causes the least amount of damage to surrounding crop trees.
2. Not cut or damage trees or markers designating property or management-area boundaries.
3. Repair any damage to fences resulting from the work performed.
4. Not dump or dispose of containers, oil, hydraulic fluid, petroleum products, or litter on Department property.
5. Remove paper, plastic, metal, and other refuse from the work area each day.
6. Ensure public and established roads and parking lots accessible by standard pickup or car remain clear and usable.
7. Remove trees felled into fields, food plots, or other open areas.
8. Keep vehicles, including ATVs and UTVs, on established roadways and trails unless otherwise permitted by the Forester or Forester's designee through a Special Use Permit.
9. Limit vehicle and equipment access to daylight hours and periods when the ground is dry or frozen to minimize rutting.
10. Repair excessive damage to fields or roads. Excessive damage is defined primarily as ruts caused by vehicle traffic that are over eight inches (8") deep.
11. Coordinate use of designated trails and gates for access through the Forester or Forester's designee.
12. Not block the natural flow of water in a drainage or creek.
Additional Instructions a.
The contractor shall understand that stand boundaries are the ridge road and creek drainages. Further marking will be provided upon request.
b.
The contractor shall retain all den, cavity, and standing dead (snag) trees unless they pose a significant danger to the contractor or public.
c. The contractor shall not cut or damage trees marked with blue paint and shall not cut boundary trees.
Hazardous Conditions
The contractor understands that there may be hazardous conditions, and the contractor hereby voluntarily accepts and assumes all risks from these conditions and agrees to incur these risks as a condition of the contract.
Assignment of Contract
This contract may not be assigned in whole or in part by the contractor without written consent of the Department.
Amendments
The contractor shall agree that this agreement shall not be amended or modified except in writing and signed by all parties of the original agreement.
Applicable Laws
The contractor agrees to comply with all applicable laws of the State of Missouri.
This contract shall be interpreted in accordance with the laws of the State of Missouri. It is mutually agreed that the venue for any cause of action regarding this contract shall be the Circuit Court of Cole County, Jefferson City, Missouri.
