About this file

This document is a protest letter submitted by Maximus US Services, Inc. to the Georgia Department of Administrative Services (DOAS) regarding the intended award of eRFP No. 40800-DOI0000016 to VIMO Inc. d/b/a GetInsured. Maximus has concerns about GetInsured's ability to perform the required services, which include providing a Contact Center and inbound Mailroom for the Georgia Office of Commissioner of Insurance and Safety Fire. Maximus requests that DOAS extend the protest period, as DOAS has not yet provided requested procurement records or a debriefing, as required. Maximus reserves the right to file an amended protest once the additional information is provided.

The letter indicates that Maximus values its relationship with the State of Georgia and believes its solution and experience provide the best value. However, due to the limited information released about the procurement process, Maximus has no choice but to file this protective protest to preserve its legal rights. Maximus remains available to discuss the matter further with DOAS.

Re: Maximus US Services, Inc.’s Protest of Intended Award In eRFP No. 40800- DOI0000016 and Request to Extend the Protest Period

Dear Deputy Commissioner:

Maximus US Services, Inc. 1 (“Maximus”) respectfully submits this timely Protest of Intended Award to VIMO Inc. d/b/a GetInsured (“GetInsured”) under eRFP No. 40800- DOI0000016 (the “RFP”) and Request to Extend the Protest Period. On May 3, 2024, the Department of Administrative Services (“DOAS” or the “agency”) posted a notice of intended award to VIMO Inc. d/b/a GetInsured (“GetInsured”). Maximus has concerns regarding the intended award decision and GetInsured’s ability to perform and provide a Contact Center and inbound Mailroom for Georgia Access to the Office of Commissioner of Insurance and Safety Fire (“OCI”). But at this time, DOAS has released only a single scoring tabulation sheet and the notice of intent to award and has released no procurement records in response to Maximus’s public records requests. Further, despite a request for a prompt debriefing, the agency has indicated a debriefing will not take place until May 16 (several days after the protest period has expired).

Maximus requests that DOAS extend the protest period given that DOAS has not yet made mandatory disclosures of procurement information, has not responded to Maximus’s public records requests, and has not afforded Maximus a debriefing. See Georgia Procurement Manual (“GPM”) at 6.5.7 (extending the period of protest by the number of “days that it takes for the state entity to produce the records beyond the first business day”). Further, Maximus is “reserving the right to file an amended protest” until at least ten calendar days after the agency’s release of procurement records. Id. Further, DOAS should stay further procurement activities during the extended protest period and until resolution of any amended and supplemental protest Maximus

1 Maximus’s address is 1600 Tysons Boulevard, Suite 1400, McLean VA 22102.

Alex Hontos May 13, 2024 submits. See GPM at 6.5.8 (requiring the agency to stay procurement activities absent a written determination to the contrary).

Maximus values its relationship with the State of Georgia, and while it believes its solution and experience provide best value for the State, it can respect the results of a fair, compliant, and transparent competitive process. At this time, given the paucity of information released about this process, Maximus has no choice but to file this protective protest to preserve its legal rights.

Maximus invites further discussion with the agency, and is available to speak at your convenience.

Cordially yours, DORSEY & WHITNEY LLP
