About this file
This is a clearance and acknowledgment form issued by the Massachusetts Department of Correction (DOC) for employees, contractors, and volunteers. The form serves as both a background investigation authorization and a mandatory training acknowledgment regarding the Prison Rape Elimination Act (PREA) of 2003. The clearance section requires personal information including name, residential address, driver's license number, date of birth, and place of birth, and authorizes the DOC to conduct comprehensive background investigations including checks with past employers, local and state police departments, the FBI, the Massachusetts Board of Probation, neighborhood inquiries, and character reference interviews. Contractors and volunteers must acknowledge understanding of federal and state laws prohibiting all forms of sexual contact between staff and inmates, including conversations, gestures, or correspondence of a sexual nature, and must recognize the DOC's zero-tolerance policy toward sexual abuse and harassment as outlined in 103 DOC 519.
The form establishes that sexual misconduct violations may result in discipline up to and including termination and criminal prosecution, and imposes a mandatory duty on all employees, contractors, and volunteers to report any observed or suspected sexual misconduct to the Shift Commander, with failure to report potentially resulting in disciplinary action up to termination and criminal charges. The document is presented in both English and Spanish to ensure comprehension across language groups. Signature and date fields are required to confirm acknowledgment and agreement with all stated policies and investigation procedures.
