MARCORSYSCOM contractually binds these companies with respect to proprietary information by organizational conflict of interest and non-disclosure clauses. Supporting contractor personnel are procurement officials within the meaning of the Office of Procurement Policy Act (41 U.S.C.

423) and as implemented in the FAR.

Section L: Instruction to Offerors

L.1 GENERAL INSTRUCTIONS.

To be considered for award, each Offeror shall submit the quote(s) in accordance with these

Section L instructions. Failing to adhere to these instructions may result in the Government removing the quote from further consideration. If Offerors propose multiple fabrics, each fabric must be a standalone quote and Offerors are limited to three quote submissions. Quotes shall not contain classified information.

L.2 QUOTE SUBMISSION.

Quotes shall be delivered electronically via the DoD Secure Access File Exchange (SAFE) site -https://safe.apps.mil. Offerors shall send an email to the Contract Specialist at anthony.fennell@usmc.mil, with a courtesy copy to the Contracting Officer at

Elizabeth.Colvin@usmc.mil for a drop-off request. Once the Contract Specialist creates a drop-off, the Offeror will receive a notification to access the SAFE site and drop-off its quote. Drop-off requests are valid for 14 days. Offerors are reminded that the Contract Specialist must receive its quote by the date and time listed below in Section L.2.2.

The solicitation requires the submission of fabric samples. The samples shall be in compliance with the written portion of the quote. Offerors shall provide a quote identifying the proposed material solution that satisfies the requirements in the Statement of Work (SOW) and Section J, Attachment 1.

Fabric Samples shall be delivered to the following address:

Marine Corps Systems Command

Standard Time on 12 June 2023.

L.3 QUOTE PREPARATION INSTRUCTIONS

L.3.1 General Quote Format

a. There is a 10 page limit. Only the first 10 pages of the written portion of the proposal shall be considered. Lab data on salient characteristics and safety data sheets do not apply to the page count.

L.3.2 Specific Quote Instructions

L.3.2.1 Technical Requirements

a. Offerors shall submit Certificates of Conformances for all materials used in the NexGen

MCCUU end item.

b. If awarded a purchase order, before a contractor undertakes performance, the contracting officer shall require written acceptance of the purchase order by the contractor. The Government cannot accept performance by the contractor as a binding agreement.

L.3.2.1.1 Factor 1. Technical Performance

Element 1. Fabric Yardage Sample

Offerors shall provide 10 linear yards (full fabric width of 48 inches minimum (threshold), 60 in

(objective)) of the fabric proposed for NexGen MCCUU in any camouflage print or solid color

(woodland MARPAT preferred if available), and safety data sheets. The sample shall contain a label that includes the solicitation number, unique identifier (e.g., fabric producer, style#), the

Offeror’s Name.

Samples will not be returned to Offerors.

Element 2. Finished Fabric Performance Compliance

Apparent (Near Infrared (NIR) and Short-Wave Infrared (SWIR)) reflectivity target values will be provided once the Offeror completes a Non-Disclosure Agreement (NDA) provided in

Section J, Attachment 3, and signs and returns the NDA to Anthony Fennell at anthony.fennell@usmc.mil. The Offeror must furnish a written statement on their plan to address the ability to achieve apparent spectral reflectivity target values in their quote.

Offerors shall fill Section J, Attachment 2 table with the data they have obtained in testing on the same fabric style as the source selection sample. The offeror shall provide test reports to substantiate data reported in this form.

The pages containing Section J, Attachment 2 table and substantiating test reports do not count against the quote page limit, and shall be submitted as Appendix A and B, respectively, in the submitted quote. The table may be incorporated in the purchase order and be used for quality assurance purposes. The following uniform data is NOT required for submission of performance compliance; Insect Repellant Active Ingredient Level, USDA bite protection, Instrumented

Manikin Burn Test, seam efficiency, seam smoothness, and crease retention. The Government reserves the right to verify any fabric properties during down selection and if awarded, after receipt of the CLIN 0001 test fabric delivery.

Element 3. Manufacturing Plan, Capacity, and Delivery

The Offeror shall describe the fabric make up, processes, steps, and rationale for the proposed

NexGen MCCUU fabric to accomplish the integrated performance properties reported in Factor

2 performance compliance. The Offeror shall identify any risks associated with the fabric and scale up to meet fabric delivery of up to 700 linear yards of NexGen MCCUU fabric in

Woodland MARPAT camouflage pattern, no more than 150 days after receipt of order (ARO).

The Offeror shall also identify, though a written statement, if and how the supply chain could be scaled up to meet a demand of 1,350,000 yards annually (+/- 10%) if adopted as the fabric to the

Marine Corps seabag combat uniform and sustained through DLA under a multi-year contract award. The Offeror shall identify the risk of producing CLIN 0001 fabric as low, moderate, or high and how risk will be mitigated and shall also identify the same for the potential scale up to

DLA procurement.

If the offeror submits a non-Berry Amendment Compliant fabric, the offeror first shall identify any components and/or processes that are non-Berry and furnish a written plan including a detailed timeline to transition the submitted fabric to meet Berry Amendment Compliance. This written plan will not count against the page limit requirement.

L.3.2.2 Factor 2. Past Performance

The Government will review Federal Awardee Performance Integrity Information System

(FAPIIS). In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance. Below is the link to the tool used for the evaluation of past performance:

CPARS: https://cpars.cpars.gov/cpars/app/home_input.action

L.3.2.3.1 Quote (Evaluated in Section M.3.2.2 Factor 3. Price)

The Quote shall include a completed, signed copy of the entire solicitation with all appropriate

“fill-in” sections completed as follows:

• Section A: An official having the authority to bind the Offeror contractually must sign the SF18. If the individual is not an officer of the company, the quote should include written evidence of the individual’s authority to bind the Offeror under contract to a particular course of action, such as a written delegation of authority signed by an officer of the company.

• Section B: Follow the below instructions for Contract Line Item Number (CLIN) pricing:

o Offerors shall propose a single unit price for the single CLIN.

o Offerors shall include their overall proposed price at the end of the Schedule of

Supplies/Services section. The overall proposed price will be the sum the single amount. Failing to fill in the total price for CLIN 0001 or failing to provide an overall proposed price may render the Offeror’s quote non-responsive and maybe grounds for disqualification. Electronic copies in Microsoft Excel format shall include all applicable calculations in the individual cells.

o The pricing for the single CLIN shall remain valid for the duration of the 6 months contract ordering period.

• Section I: Complete all required fill-ins.

• Section K: Complete all required certifications, representations, and acknowledgments for the prime contractor and subcontractors, as applicable.

• Amendments: Offerors shall acknowledge amendments to this solicitation with signature upon a completed SF30, or appropriate annotation on the SF18, from an official having the authority to bind the Offeror contractually.

L.4 INCORPATION OF QUOTE

The Government may incorporate all or part of the successful Offeror’s quote in any contract resulting from this solicitation. Additionally, the NexGen MCCUU Salient Characteristic table

(Section J, Attachment 1) in the ultimately awarded contract will reflect all above-minimum performance levels or capabilities for which the Government gave evaluation credit during selection. Nothing contained in the successful Offeror’s quote shall constitute a waiver to any other requirement within the purchase order. The Order of Precedence clause governs in instances of conflicts between the successful Offeror’s quote and any other requirement of the contract.

L.6 QUESTIONS REGARDIING THE SOLICITATION

Offerors should carefully read this solicitation’s terms and conditions and refer any questions in writing to the Contract Specialist, Anthony Fennell, via email at anthony.fennell@usmc.mil with

Elizabeth Colvin at elizabeth.colvin@usmc.mil copied no later than 12:00 PM Eastern

Standard Time on 29 May 2023. The Government may not address any questions, comments, concerns it receives after that time. The Government will post responses via published amendment to the solicitation.

L.7 OFFEROR ACCEPTANCE PERIOD

Offerors must hold prices firm for a period of six months from the date of this solicitation.
