Par 1.2. Bullet 7: Maintain appropriate personal and vessel liability insurance in accordance with FAR part 28.3, United States, and applicable host nation rules and regulations in the event of damage to government equipment or mishaps while operating government furnished equipment.
Gov’t Summation of Question: Vessel Liability Insurance is not reasonably available for contractors operating USG-owned uninspected vessels. These vessels are difficult for insurance companies to determine a replacement value. In this case, the USG also has uniformed personnel that operate and train on the USG-owned vessel. Since the contractor is not the owner of the GFP, insurance companies have stated that they cannot quote for vessel liability insurance. Is the government requesting the vendor to obtain vessel liability insurance? There are no issues with the requirement for the vendor to maintain personnel liability insurance.
Gov’t Response: The vendor is not required to maintain Vessel Liability Insurance for this contract. Personal Liability Insurance is required by both USG and GOJ regulations.
