Environmental Sampling and Analysis
This is a combined synopsis/solicitation for commercial items prepared in accordance with (IAW) the Format in FAR Part 12, 13.5 and 16.5 as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation; quotes are being requested and a written Solicitation will not be issued.
This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-12 and Defense Federal Acquisition Regulations Supplement Publication Notice
(DPN) . THIS NOTICE CONSTITUTES THE ONLY SOLICITATION.
The Request for Quotation (RFQ) number M67400-23-Q-0012 Environmental Sampling and Analysis Service shall be used to reference any written quote provided under this RFQ.
ADDENDUM TO FAR 52.212-1
52.212-1 ADDENDUM FOR INSTRUCTIONS TO OFFERORS – Commercial Products and Commercial Services (Nov 2021)
(a) North American Industry Classification System (NAICS) code and small business size standard.
Selected NAICS code is 325998, which is for “All other miscellaneous chemical product and preparation manufacturing”. This is not a small business set aside, services will be performed Outside the Continental United States (OCONUS).
(b) SUBMISSION OF OFFERS.
The Marine Corps Installations Pacific Regional Contracting Office (MCIPAC RCO) intends to solicit and award a Single Award, Indefinite Delivery Contract (IDC), Requirements Contract with Firm – Fixed Price (FFP) task orders.
The contract will have a base year plus four(4) option years from 01 June 2023 through 31 May 2028 with a six (6) month option to extend the services – FAR 52.217-8.
Submit signed and dated offers to MCIPAC RCO via email at or before the exact time specified in FAR 52.252-1 (c) of this solicitation.
*Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
* Due to Government computer firewall security and file size limitations, please be advised that it is the prospective contractor’s responsibility to ensure that the Contracting Office receives ALL required documents on time, including acknowledgment of receipt from the Government, and in strict accordance with FAR 52.212-1(f).
Offerors shall prepare and submit their quotes as set forth in Table 1. The titles and contents of the sections are defined in Table 1 of this document, all of which shall be within the required page limits (including all attachments, figures, etc.) specified in the table. An electronic copy of all documents (technical and price) shall be submitted. Quotes should be prepared using “Arial” or “Times New Roman” 11-point font style on 8½ x 11 inch or Japanese A4 size. Tables and illustrations may use a reduced font style, not less than 9 points. Margins shall be one (1) inch on all sides. All material submitted may be single-spaced. Offerors should ensure that each page provides identification of the submitting Offeror in the header or footer.

Volume I – Technical Proposal.
The offeror shall submit separate documents for the technical information listed below. The offeror must also submit a redacted copy and a unredacted copy.

The following information must be redacted: company information, headers, contacts, phone numbers, addresses.
(1) Technical Approach/ Task Understanding/ Processes and Procedures/Quality Control The Offeror shall provide the methodology and detail as to how the Offeror intends to perform the tasks as specified in paragraph 3.0 through 4.0 of the Performance Work Statement (PWS). The narrative shall describe the capability to perform all required test in accordance with Appendix I of PWS and method of performance. The narrative shall state how the offeror will ensure timely and effective performance of services that meet the Government’s reqruirement.
(2) Staffing Approach and Labor Mix Qualifications/Certifications/Experience (See FAR 52.212) The Offeror shall provide a summary of its Staffing Approach that details its plans to staff, recruit, and screen qualified personnel in order to satisfy the Government’s performance requirement. The summary should provide a clear understanding of how the Offeror intends to staff this contract in order to meet all the PWS requirements. (The approach shall include a detailed discussion of the roles of any support team, substantiated performance, and appropriate use of staff resources to accomplish the intended work set forth in the PWS). The Offeror shall propose minimum qualifications, certifications, experience, and specialized experience that the individuals will possess for each of the support areas identified in the PWS. The Offeror shall certify that all the individuals to perform services throughout the life of the contract will meet the characteristics proposed.

The Technical proposal shall NOT include any pricing data. Each Offeror’s Technical Information shall clearly and concisely describe its response to the solicitation’s requirements. Offerors are cautioned against general, vague, or unsubstantiated statements which prevent or render difficult the Government’s evaluation of the proposal. Statements such as “we understand” “will comply” “standard procedures will be used” or “noted and understood” without supporting narrative to define compliance are generally insufficient responses. A proposal that merely re-states the objectives of the solicitation but fails to provide the required approach to meeting the solicitation’s objectives, is not acceptable. Moreover, the Government will generally not assume that an Offeror possesses a capability, understanding or commitment that is not specifically delineated and supported in its proposal. The Offeror shall prepare a technical offer with their best efforts to demonstrate their abilities to satisfy or exceed the Government’s technical requirements.
Volume II Price.
Offerors shall contain all the pricing information. Price list shall be prepared using an excel worksheet. This worksheet is required to be submitted electronically and shall not be locked. Failure to provide pricing for all line items will result in quotes being determined non-responsive.
The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
All price/cost and price/cost supporting information shall be contained in Appendix and the price/cost proposal. No price or pricing information shall be included in any other technical volume including cover letters. Offeror are responsible for submitting sufficient information to enable the Government to fully evaluate their price/cost proposal.
Volume III- Validation of Representations and Certifications.
(a) Reps/certs completed electrically and registered as current via SAM per 52.212-3 need not be re-submitted.
However, the following information MUST be provided with this quotation. Submitting the information affirms that the offeror is registered and current in the SAM database.

Volume IV Past performance information
Past performance information, to include identification of recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information). See Attachment 1, Past Performance Information List.
The Contractor will provide Attachment 2, Past Performance Questionnaire, to all past performance references to complete and return via e-mail to the point of contact below, to be received no later than the closing date of this solicitation. Acceptance of late submissions is at the discretion of the Contracting Officer.
The Government may contact some or all of the references provided, as appropriate, and may collect information through questionnaires, telephone interviews and existing data sources to include but be not limited to Contractor Performance Assessment Reporting (CPARS)
(c) Period for acceptance of quotes: Quotes shall be submitted directly via email to Kyoko Shomita at kyoko.shomita.ja@usmc.mil, no later than 22 May, 2023 10:00am, Japan Standard Time (JST). Offeror(s) shall comply with the detailed instructions for the format and content of the quotes contained herein; quotes that do not comply may be considered unacceptable and may render the quote ineligible for award.
(d) Correspondence: All and any communications/questions pertaining to this solicitation must be submitted in writing to the Points of Contact below, no later than 27 April, 2023 10:00AM Japan Standard Time (JST). If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the Contract Specialist in writing with supporting rationale.

ADDENDEM TO 52.212-2
Addendum to 52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021)
(a) This is a commercial item requirement using Simplified Acquisition Procedures under FAR 12, 13.5 and 16.5, respectively. Evaluation will be conducted using simplified procedures in accordance with FAR 13.106. The 6-month extension period will be evaluated for award purposes as a part of the offeror's proposal in accordance with FAR 52.217-8.
(b) The Government will award to the responsible offeror whose quote, conforming to the solicitation will be most advantageous to the Government, price and other factors considered. To receive consideration for award, the Offeror must, at a minimum, be rated ‘Acceptable’ under technical evaluation and “Neutral Past performance” under Past Performance evaluation review. The following factors shall be used to evaluate quotes:
1) Technical Factor
2) Past Performance
3) Price
*In determining the most advantageous quote, Technical and Past Performance when combined are more important that Price.
(c) The Technical proposal evaluation will be based upon the offerors submissions described in the “Technical Capability” section of FAR 52.212-1 ADDENDUM TO INSTRUCTIONS TO OFFERORS--COMMERCIAL
ITEMS (NOV 2021).
Offerors will be evaluated on the suitability of their written plan, and ability to convey a clear, comprehensive approach to meeting the requirement as described in Para. 3.0 through Para. 4.0 of PWS.
In accordance with the Instructions to Offerors, Technical Proposal will be evaluated on their written narrative describing the method of how to perform the sampling and analysis service and capability to perform all required test in accordance with Appendix I of PWS. The Government will also verify if the valid certificate, licenses, or permit is available to provide service.
The quotes will be evaluated using the combined technical/Risk rating method as Table 3:

Red Unacceptable Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is not awardable, and/or risk of performance is unacceptably high.
(d) For purposes of evaluation of Past Performance determination of responsibility, and in accordance with FAR 13.106-2(b)(3), this assessment will primarily be conducted through Contractor Performance Assessment Reporting System (CPARS) but may include other authorized methods described. Past performance, for purposes of this evaluation, will be assessed using the Performance Confidence Assessment Rating Method.

(e) Price evaluation will be conducted as described in FAR 13.106-3 and FAR 13.5. Price analysis may be further substantiated using market research results. In case where price competition is not evident, and/or only one quote is received, conduct price analysis in accordance with FAR 13.106-3(a)(2), and prescribed DFARS techniques at 215.371-1 through 215.371.3.
(f) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall require written (see FAR 2.101) acceptance of the purchase order by the offeror. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

MARINE CORPS BASE (MCB) CAMP SMEDLEY D. BUTLER
OKINAWA, JAPAN
SECTION I
DESCRIPTION OF SERVICES
1.0 BACKGROUND. Marine Corps Installations Pacific (MCIPAC), Marine Corps Bases (MCB) Camp Butler and MCAS Futenma must ensure that the standards established in the Japan Environmental Governing Standards (JEGS) are meeting the requirements of JEGS Chapters on Hazardous Waste, PCBs, asbestos, and solid waste.
1.1 Objective. The objective is for the Contractor to provide technical services and support of the collection and analysis of environmental samples to MCIPAC MCB Camp Butler and MCAS Futenma in order to be in compliance with applicable regulations.
1.2 Scope of Work/Contractor Requirements. The Contractor shall furnish all labor, supervision, tools, materials, equipment, and transportation, and other items and services necessary for the collection and analysis of environmental samples as listed in Appendix I through VI.
1.3 Period of Performance. The period of performance for this contract is a base plus four option years from 01 June 2023 through 31 May 2028 with a six-month option to extend their services – FAR 52.217-8.
1.3.1 Federal Holidays. The contractor shall not be required to provide services on U.S. federal holidays unless the holiday is particularly specified otherwise in the PWS except for emergencies.
* When a federal holiday falls on Sunday, the following Monday will be observed as a holiday by the U.S. government.
When a federal holiday falls on a Saturday, the preceding Friday will be observed as a holiday.
In addition to these federal holidays, if the President of the United States issues an executive order closing the federal government, that date shall also be considered a recognized federal holiday (Reference Executive Order 11582 of February 11, 1971, and 5 U.S.C. 5546 and 6103(b) and other similar statues insofar as they relate to the pay and leave of employees of the United States).

1.3.2 Typhoon Conditions. Japan-based military installations close when Tropical Cyclone Condition of Readiness 1C (TCCOR 1C or TC-1C) is declared by Military Weather Station authorities. The Contractor will be required to depart military bases, remain indoors, and monitor radio/television to determine when the TCCOR changes to TCCOR SW (Storm Watch) or TCCOR AC (All Clear). When TCCOR SW is declared by Military Weather Station authorities, the Contractor shall restart the service within 2 hours. If that occurs after normal business hours, services shall begin the next normal workday at 7:30am.
2.0 PLACE OF PERFORMANCE. The use of government facilities is not authorized. Laboratory testing shall be accomplished at vendor operated facilities.
3.0 TECHNICAL REQUIREMENTS
3.1 Analysis Quantity. The quantities of sampling and analysis are only quantities from historical testing and shall not obligate the Government to order the quantities shown. At the end of each month, the Government and the Contractor shall reconcile actual quantities expended and reflect this on the monthly Statement of Delivery (SOD).
3.1.1 Regulatory Requirements. The contract requirements shall be performed in accordance with the following regulations. The Contractor shall be knowledgeable of and in compliance with the following documents, as well as all applicable U.S., Government of Japan, Okinawa Prefecture Government, Okinawa municipality laws, regulations and policies to perform required services regarding environmental protection and sampling analysis. In the event that environmental laws or regulations change during the term of the contract, the Contractor shall comply with such laws as they may come into effect.
A. 29 CFR 1910, Occupational Safety and Health Administration (OSHA) Standards, Department of Labor B. Japan Environmental Governing Standards (JEGS), HQ USFJ, Japan, Current Edition C. EMSP 9.8 Contractor-Vendor Training Packet, MCB Butler, Current Edition
3.1.2 Laboratory Requirements. All services performed under this contract shall be conducted by a qualified laboratory. The Contractor shall submit Laboratory Certificates from the appropriate agencies to the Government indicating that the laboratories are validated/certified to conduct the United States Environmental Protection Agency (US EPA) methods and/or the Japanese methods for sampling and environmental analysis. US analytical laboratories must be certified and/or accredited by US EPA or a State Laboratory Certification Program. Japanese analytical laboratories must be a laboratory registered/certified to conduct analyses by the Japanese national, prefectural and/or local government (Kankyo Keiryo Jigyosho with Kankyou Keiryoushi). For Soil Pollution Analysis Laboratory (Shitei Cyosa Kikan) certification by the Ministry of Environment (MOE), GOJ is required. The lists of approved methods are contained in Appendix I. In the event the Contractor changes laboratories or sub-contracts with another laboratory, the contractor shall submit certifications to the Contracting Officer prior to use of the laboratory.
3.1.3 Per the Assistant Secretary of Defense Memo consistent with PFAS Analytical Methods (22 Nov 2019); When analyzing for PFAS contaminants, the PFAS analytical methods must meet the preparation and analysis criteria contained in the DoD/Department of Energy Quality Systems Manual (QSM) for Environmental Laboratories (current version 5.3), Appendix B, Table B-15 (www.denix.osd.mil/edqw/documents/<http://www.denix.osd.mil/edqw/documents/> ).
Laboratories capable of meeting the Table B-15 criteria can be found at www.denix.osd.mil/edqw/accreditation/accreditedlabs<http://www.denix.osd.mil/edqw/accreditation/accredited labs>, and by choosing “PFAS by LCMSMS Compliant with Table B-15 of QSM Version 5.1 or Latest Version” from the method dropdown box. The analysis method on every “Certificate of Test Results” document will read verbatim:
“Method: QSM B15 PFAS for QSM 5.3, Table B-15” under the analysis method section. Deviation from this verbiage shall deem the sample null and void.
4.0 TASKS AND DELIVERABLES
4.1 Sample Collection. In most cases, the Government will collect samples as indicated under Para 4.1.1 below using contractor furnished disposable containers ordered under Reimbursable Consumable Supply CLINS. In the event the contractor is required to collect samples as indicated in Para 4.1.2, the Contractor shall furnish the appropriately preserved sample containers. The only sample collection the contractor will be requested to collect will be for asbestos.
4.1.1 Government Collection. MCIPAC Camp Butler personnel will collect and submit environmental samples for pick up by the Contractor at the following location or deliver to contractor laboratory.

4.1.2 Contractor Collection. At the Government’s request, the Contractor shall collect requested samples at the following USMC locations listed below (reference Appendix VI, Map of USMC Camps on Okinawa: MCB Camp S.D. Butler) consisting of the following camp locations:
1. Camp Kinser 2. Camp Foster 3. Camp Lester 4. Camp McTureous
5. Camp Courtney 6. Camp Hansen 7. Camp Schwab 8. Ie-shima Auxiliary Airfield
9. Camp Gonsalves in JWTC 10. Marine Corps Air Station (MCAS) Futenma
4.2 Sample Identification and Protection
4.2.1 Identification. The Contractor must verify sample labels and Chain-of-Custody forms (reference Appendix III) to prevent sample misidentification. At a minimum, the following information shall be included on the label and corresponding Chain of custody:
A. Sample Identification Number B. Name of Collector C. Date and Time of Collection D. Location of Collection E. Media Type F. Analytes for testing G. Preservative Added (if any) H. Serial Number of equipment (if applicable)
4.2.2 Packaging. The Contractor shall package each sample in such a way that it will be protected from damage during transport and will arrive at the lab at the recommended temperature, dependent upon the analytical method to be used (reference Appendix I, List of Analytical Items and holding time Tables). The Contractor shall ensure all containers and required forms are correctly labeled and properly filled out. The Contractor shall secure required forms in a waterproof bag.
4.2.3 Shipping. The Contractor shall transport all samples to the designated laboratory for analysis within the holding time established for each test sample (reference Appendix I). The Contractor shall be responsible for the transportation of samples that require refrigeration (iced cooler provided by the Contractor). The Contractor will be responsible for compliance with all international or local shipping requirements and laws.
4.3 Sample Analysis
4.3.1 Analytical Method. The Contractor shall analyze all samples using "JPN methods" approved by the Ministry of Environment (MOE), unless the US government requested analysis with US EPA methodology. TCLP samples will be shipped to an approved lab in the United States for analysis. Proposed analysis methods are provided in Appendix I, with a listing of Analytical Items and holding time tables in the test requirements column.
4.3.2 Sample Disposal. Once analysis is complete, the Contractor shall dispose of the samples appropriately and in accordance with applicable Host Nation laws and regulations.
4.3.3 Sample Replacement. When the Contractor does not start the analysis within the holding time period, the contractor shall be required to collect and analyze replacement samples at no extra cost to the Government.
4.3.4 Sample Analysis Processing Time. As a standard practice, the Contractor shall process and submit reports to the Government for samples collected within 10 working days after the lab receives the samples. This time period will be excused for analyte methods that require the sample media to be naturally dried prior to the analysis process.
4.3.5 Expedited Sample Analysis. Expedited samples may be required throughout the year. These samples are required as a result of unexpected or critical events that occur and need immediate analysis. The Contractor shall expedite processing and submit reports to the Government within 48 hours after the lab receives the samples except for samples with extended run times or requiring shipment of samples back to the states for analysis.
4.4 Sample Records and Reporting
4.4.1 Chain-of-Custody Record. When the Government requests sample analysis from the Contractor, a Chain-of- Custody Record (referance Appendix III) will be initiated and provided to the Contractor with the sample(s). The Contractor and Contracting Officer Representative (COR) will complete this form throughout the process of sample collection, analysis, and reporting. This form is intended to record and document each stage of the sample’s life cycle (i.e., collection, transport, and delivery). The Government will maintain the hard copy form and provide the Contractor with a photocopy version during transfer.
4.4.2 Analysis Report. The Contractor shall prepare a written bilingual analytical report (English & Japanese) in duplicate (2 each) that contains the results of the analysis performed (Example is provided in Appendix IV). Reports shall be submitted to:

4.4.3 Analysis Reports. The Contractor shall submit analysis reports within 10 working days after the lab receives routine samples. In the event the analysis requires processing and reporting time of more than 10 working days (such as with Dioxins and similar substances), the Contractor shall notify the Government of the required processing time and receive concurrence from the Government of the extended report date requirement.
4.4.3.1: If the original report contains any errors or omits any of the required information, the Contractor must submit a corrected written report, at no additional charge to the Government. The corrected report will be delivered within two (2) working days of notification or discovery of the error or omission.
4.4.4 Report Format. All reports and other submittal documents must be printed on recycled paper, size 8.5-inch x 11 inches, leaving a one (1) inch top, bottom, left and right margin. Text font type must be Times New Roman and/or MS Mincho and font size shall be 12 point.
4.4.5 Statement of Delivery. The Contractor shall provide a Statement of Delivery (SOD), in English the first week following all analytical reports conducted for the previous month (Example is provided in Appendix V). The (SOD) will be provided to the COR at the address listed in section 4.4.2, the SOD shall include:

5.0 APPLICABLE DOCUMENTS / GOVERNING REFERENCES. In addition, requirements of regulations and policies applicable to this contract/order by virtue of clauses contained herein, the contractor shall, in the performance of this contract/order, also comply with all references applicable to the specific tasks of this Performance Work Statement, as listed below, including any amendments or subsequent issuance.

6.0 GOVERNMENT FURNISHED FACILITIES, EQUIPMENT, SERVICES, AND/ OR INFORMATION:

7.0 SPECIAL INSTURCTIONS AND ADMINISTRATIVE INFORMATION
7.1 Non-Personal Services. This is a non-personal service, performance-based contract. The contractor bears responsibility to manage its employees and guard against any actions that could be characterized as personal services as defined in FAR 37.104, or which convey the perception that personal services are being delivered. No provisions are implied nor provided in this contract for any benefits such as medical care, retirement, or worker’s compensation, other than those incorporated through enumerated clauses.
7.2 Identification of Contractor Personnel and Equipment. In accordance with DFARS 211.106, contractor personnel performing non-personal services on DoD installations or other government facilities shall ensure that they are readily identifiable as contractor employees (including subcontractors and consultants). All contractor employees shall comply with the following at all times:
7.2.1 Telephone Identification. Identify themselves as contractor personnel at the onset of every telephone call made from a government telephone or any other phone if the call is made in support of Government-related requirements and activities.
7.2.2 Recorded Messages. Identify themselves as contractor personnel in all recorded messages including those, which are heard by callers attempting to contact contractor employees via answering machines or voicemail.
7.2.3 Meetings, Conferences and Events. Identify themselves as contractor personnel at the onset of every meeting, conference or any other gathering attended in support of any Government related requirements or activities.
7.2.4 Correspondence. Identify themselves as contractor personnel on any correspondence, documents, or reports accomplished or sent in support of any service provision to the Government, including, but not limited to, correspondence sent via the U.S. Mail, facsimile, or electronic mail (email) inclusive of out-of-office replies.
7.2.5 Personal and Corporate Identification: Wear or display contractor provided nametags, badges or attire which display, at a minimum, the name of the contractor and their respective company.
7.3 Persons from certain countries are considered (DTCN) and are generally restricted from entering Marine Corps Bases Japan (MCBJ) Camps, Air Stations, or facilities. A listing of DTCN countries and other related information regarding this policy can be found in USFJ Instruction 31-204 (Designated Third Country Nationals), which can be made available upon request.
7.4 Exemption from Japanese Taxes. Pursuant to the U.S. – Japan Status of Forces Agreement and the Joint Committee, the governments of the United States and Japan have agreed that the procurement in Japan of materials, supplies, equipment, and services for official purposes may be except from certain Japanese taxes. When incorporated, paragraph c. of the clause FAR 52.229-6, “TAXES – FOREIGN FIXED PRICE CONTRACTS” and/or DFARS 225.229-7001 ‘TAX RELIEF’ stipulate that contract/order pricing shall not include the Consumption Tax.
Submission of, and/or incorporation into the contract of, your offer, certifies that pricing does not contain any cost related to the Consumption Tax. Questions concerning this matter should be directed to your local Japanese Tax Office.
7.5 Subcontract Management. The contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime contractor will manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations. Contractors may add subcontractors to their team after notification to the Procuring Contracting Officer (PCO) or Contracting Officer Representative (COR). Cross teaming may or may not be permitted.
7.6 Mission Essential Personnel / Tasks. Unless specified otherwise in this Performance Work Statement, contractors supporting this contract/order are not considered “Mission Essential” personnel (as defined in DFARS 237.76) who would be required during crisis or emergency operations.
7.7 Hazardous Materials and Safety. The Contractor and its subcontractors shall comply with all applicable laws, including Public Law 91-596 (Occupational Safety and Health Administration (OSHA)) and DOD Directive 4715.1E, Environmental, Safety, and Occupational Health (ESOH)). Contractor personnel performing services on a DOD installation shall participate in local Voluntary Protection Programs (VPP). 7.8 Installation Access and Personnel Credentialing
7.8.1 Motor Vehicles. Vehicle licensing, registration, and insurance requirements must all be conducted in accordance with host nation law, USFJ Instruction 31-205, and applicable local installation policies.
7.8.1.1 Registration/Permits. Vehicle registration on Okinawa, Japan is conducted with the Provost Marshal via the Joint Services Vehicle Registration Office (JSVRO) at Bldg. 5638, Marine Corps Base, Camp Butler. 7.8.1.2 Registration Termination. Vehicle permits will expire upon termination date of this contract/order, expiration of an individual base pass or DBIDS ID, expiration of vehicle inspection sticker, or termination of their employment (whichever occurs first). Permits issued to individuals who overstay any of these authorized dates become void and invalid.
7.8.1.3 Insurance. Vehicle permitting procedures require that all vehicles, personal or corporate, must be properly inspected and insured in accordance with Japanese Compulsory Insurance (JCI) requirements. Additionally, for SOFA status personnel and U.S. corporate vehicles, the Contractor or SOFA status individual is required to procure and maintain, during the entire period of performance under this contract, the following minimum insurance on each vehicle used by the Contactor at the work site:
Automobile Property Damage Insurance Amount: ¥30,000,000 (or U.S. Dollar equivalents) Bodily Injury Insurance Amount: ¥30,000,000 Yen (or U.S. Dollar equivalents)
Prior to the commencement of work, the Contractor shall furnish to the Contracting Officer a certificate or written statement of the above required insurance for any and all corporate vehicles to be used. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in the policies adversely affecting the laws of the state in which this contract is to be performed and in no event less than thirty (30) days after written notice thereof to the Contracting Officer.
7.8.1.4 Road Laws. All personnel operating motor vehicles under this contract/order are subject to U.S. military installation regulations and Japanese Road Laws. Failure of the contractor, its employees, or its sub-contractors, to comply, may result in revocation of driving privileges or other legal action.
7.8.1.5 Vehicle Disposal. Personnel protected under the Status of Forces Agreement (SOFA) are required by regulation to properly dispose of vehicles prior to departure from Japan. For individuals performing under this contract, the contractor may be held financially liable for vehicles abandoned, or vehicles not disposed of properly, in accordance with vehicle regulations as agreed with the Government of Japan.
7.8.2 Personnel Access / Credentialing. Access to local installations is inherently required to accomplish specified tasks under this contract/order. The contractor shall therefore ensure all necessary actions are taken to obtain such access by its personnel in time to affect access in accordance with the requirements of the PWS and POP. Failure to complete such actions in a timely manner, some of which may occur prior to the POP or individual mobilization/relocation to the place of performance, shall not constitute excusable delay. Upon request, the Contracting Officer will provide a ‘check-in’ sheet that summarizes required actions.
7.8.2.1 Base Passes and/or Defense Biometrics Identification System (DBIDS) cards. Personnel that do not qualify for CAC require an alternate credential for installation access, as governed by Marine Corps Installations Pacific Order 5512.2, which can be provided upon request. The process to request access requires approval from the Contracting Officer Representative in an access request letter.
7.8.2.2 Return and/or Disposal of Access Credentials. The contractor’s employees shall return to the applicable issuing office all base passes, DBIDS cards, and/or CAC, immediately upon termination of employment or completion of this contract and certification of receipt shall be obtained and submitted to the Contracting Officer Representative.
The Contractor shall submit a listing of employees terminated under this contract to the Contracting Officer Representative within seven (7) days of the effective date of termination.
7.8.2.3 Status of Forces Agreement. Possession of a CAC or other credential does not, alone, determine the legal status of personnel performing under this contract. Additionally, unless specifically identified on the CAC, the credential does not necessarily authorize logistical support privileges such as commissary/exchange access. The individual status of personnel performing under this contract, and the privileges authorized, are governed in accordance with United States Force Japan Instructions (predominantly USFJI 64-100), applicable credentialing regulations, and the information prescribed via DFARS clauses regarding Contractor Personnel in Japan, as contained herein.
7.9 Privacy Act. Pursuant to FAR clause 52.224-3, as incorporated, DoD requires agency-specific Privacy Act training as prescribed in DODM 5400.11-R. DODM 5400.11-R also prescribes required actions regarding information and privacy, which are applicable to the contractor and its personnel performing under this contract/order. The regulation may subject the contractor and/or contractor's personnel to criminal liability under Title 18, Section 793 and 7908 of the United States Code.
7.10 Classified information. Any classified work products shall be handled in accordance with DoD Instruction 5220.22-M. The contractor’s procedures for protecting against unauthorized disclosure of information will not require DoD employees or members of the Armed Forces to relinquish control of their work product, whether classified or not, to the contractor. The contractor may also have access to, and be required to safeguard, For Official Use Only (FOUO), sensitive, confidential, and/or classified information and material.
7.11 Quality Control and Quality Assurance. In accordance with FAR part 46, and the respective enumerated clauses incorporated in this contract/order, the contactor is reminded that the government may conduct Quality Assurance actions, inspect the Contractor’s Quality Control Plan and records, and take remedial actions as necessary, at any time through the duration of this contract/order.
8.0 DEFINITIONS
8.1 Contracting Officer (KO): US Government official authorized to enter into, make changes to, or terminate contracts on behalf of the US Government. Contracting officers are responsible for ensuring performance of all necessary actions for effective contracting, ensuring compliance with the terms of the contract, and safeguarding the interests of the United States in its contractual relationships.
8.2 Contracting Officer Representative (COR): Government liaison appointed in writing by the Contracting Officer and designated in the contract, who functions as the requirements representative monitoring cost/price, delivery, and performance of the contractor. The COR is not authorized to enter into any agreements, obligate the government or direct any changes to the contract.
8.3 Government Furnished Property (GFP): Property in the possession of, or directly acquired by, the Government and subsequently made available to the contractor.
8.4 Quality Assurance (QA): Various functions, including inspection, performed by the Government to determine whether a contractor has fulfilled the contract obligations pertaining to the quality and quantity.
8.5 Quality Control (QC): A complete Quality Control outline that meets the requirements of the contract shall be provided by the contractor to illustrate how the company will ensure they conform to the contract requirements.
