PERFORMANCE WORK STATEMENT

MCAGCC Portable Toilet Delivery and Cleaning Service

1. GENERAL

0. General: This is a non-personnel services contract to provide “Portable Toilet Delivery and Cleaning Services”. The government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the contractor who, in turn is responsible to the Government.

0. Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform “Portable Toilet Delivery and Cleaning Services” as defined in this PWS. The contractor shall perform to the standards in this contract.

0. Background: The MAGTFTC/MCAGCC is a vast training center located in the lower Mojave Desert, approximately 70 miles north of Palms Springs, California. The installation is primarily utilized for desert warfighting training, and contains numerous ranges covering approximately 1200 sq. miles where military exercises are held at varying times throughout the year. Many of the ranges are accessible only by passing through rough terrain, requiring the use of 4WD vehicles.

Some ranges are accessible by direct routes; however, if live-fire exercises are occurring, Range Control may close down certain routes requiring the use of alternative routes with significantly longer travel times. If alternate routes are required to be used it will be at no additional cost to the Government.

The amount of portable toilet usage varies with the size, number, and frequency of exercises. Typically, the Integrated Training Exercises (ITX) training evolutions last a month and half and have required up to 800 to 1,000 toilets. There are 5 ITXs scheduled per fiscal year, and 2 LSEs. An order for portable toilets can be as small as one toilet with no scheduled cleanings and a period of performance of one day. It is not unusual to receive an order for fewer than twenty toilets.

0. Objectives: The main objectives of this contract are as follows:

3. Deliver portable toilets to the prescribed location within 72 hrs. after issuance of task order.

3. Perform cleaning services on portable toilets as specified in the task order.

3. Provide emergency deliveries and/ or cleanings 24 hrs. after issuance of task order.

0. Scope: Services under this contract include delivery and pick-up of portable toilets, and the cleaning of portable toilets in support of operations aboard MCAGCC. Not covered under the scope of this contract are portable toilets for construction projects and/ or Marine Corps Community Services (MCCS) events funded using non-appropriated funds.

0. Period of Performance: The period of performance shall be for 1 Base Year of 12 months and four 12-month option periods. The Period of Performance reads as follows:

Option Year IMarch 4th, 2025 to March 3rd, 2026
Option Year IIMarch 4th, 2026 to March 3rd, 2027

NOTE: The clause FAR 52.217-8 “Option to Extend Services” is included in the contract and as such the government has the unilateral right to extend the period of performance currently in effect by up to 6 months. The contractor will receive a notification letter from the RCO in accordance with the timeline prescribed in clause FAR 52.217-8 “Option to Extend Services”.

0. Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program (QCP) is the means by which the contractor assures itself that its work complies with the requirement of the contract. As part of their response to the solicitation, 1 copy of a comprehensive written QCP shall be submitted to the KO within 5 working days of contract award. After acceptance of the initial quality control plan, the contractor must receive the KO’s acceptance in writing and the contractor must acknowlede any proposed change to its QCP..

0. Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the QASP. This plan is primarily focused on what the government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

0. Type of Contract: The government will award an indefinite-delivery, indefinite-quantity firm-fixed-price contract.

0. Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured and remain in control of the government.

0. Post Award Conference/Periodic Progress Meetings: The contractor agrees to attend any post award conference convened by the contracting office in accordance with Federal Acquisition Regulation Subpart 42.5. The KO, COR, and other government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the KO will appraise the contractor of how the government views the contractor's performance and the contractor will appraise the government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

0. Contracting Officer’s Representative: The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the contractor concerning technical aspects of the contract; issue written interpretations of technical requirement; monitor Contractor's performance and notify both the KO and contractor of any deficiencies; coordinate site entry of contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

0. On-site supervisor and alternate: The contractor shall provide an on-site supervisor who will be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the supervisor is absent shall be designated in writing to the contracting officer. The on-site supervisor or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The on-site supervisor or alternate shall be available between 8:00 a.m. to 4:30 p.m. (PT), Monday through Friday except when the government facility is closed for administrative reasons.

The on-site supervisor and alternate must meet the following qualifications:

Permanently reside within 50 miles of the area of performance Five (5) years of management and supervision experience Five (5) years of industry experience pertaining to NAICS code 562991

0. Contractor Personnel: Contractor personnel shall be well trained and proficient in their assigned tasks, present a neat appearance, and be easily recognized by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges. No item of military clothing or clothing resembling military clothing may be worn. All employees of the contractor must be able to read, write, and understand English.

The contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest nor shall the contractor employ any person who is an employee of the United States Marine Corps, either military or civilian, unless such person seeks and receives approval in accordance with Joint Ethics Regulations (DoD 5500.7-R).

The contractor shall submit the number and labor category of personnel that will be employed to perform work on this contract as outlined in Technical Exhibit 2 – Deliverables Schedule.

0. Identification of Contractor Employees: All contract personnel attending meetings, answering government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. The contractor’s personnel shall be identified with personnel badges to be worn at all times while aboard MCAGCC. Badges shall include at a minimum a picture of the employee, first name, last name, company name.

0. Organizational Conflict of Interest (OCI): The contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO and in the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may affect other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.

0. Transition Period: To minimize any decreases in productivity and to prevent possible negative impacts on additional services, the contractor shall have personnel available, during the thirty (30) day transition period beginning on the first day of the period of performance. During the transition period, the contractor shall become familiar with performance requirements in order to commence full performance of services on the contract start date.

1. DEFINITIONS AND ACRONYMS:

1. DEFINITIONS:

CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the key personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

PHYSICAL SECURITY. Actions that prevent the loss or damage of government property.

QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

QUALITY CONTROL. All necessary measures taken by the contractor to assure that the quality of an end product or service shall meet contract requirements.

SUBCONTRACTOR. One that enters into a contract with a prime contractor. The government does not have privity of contract with the subcontractor.

WORK DAY. The number of hours per day the contractor provides services in accordance with the contract.

WORK WEEK. Monday through Friday, unless specified otherwise.

1. GOVERNMENT PROVIDED ITEMS AND UTILITIES:

2. Facilities: The government will provide one storage area approximately 150’ x 150’. The area is located in Camp Wilson off the MSR, grid 77079 96321 in the Range Training and Maintenance Section (RTAMS) area near the Rifle Range. Prior to storing equipment, vehicles, and/or supplies, the contractor will be required to install a permanent or temporary fence at no cost to the government. The contractor shall submit plans for any planned fences to the KO for written approval prior to installation. Fencing installed without written approval by the KO is subject to removal at the government’s discretion. Only vehicles and equipment used on MAGTFTC/MCAGCC contracts are to be staged/stored in the storage area provided under this contract. The contractor shall empty all storage tanks on contractor owned equipment prior to storing vehicles and/or equipment overnight. All contractor equipment, supplies and fencing shall be removed from the Base within 30 days after contract end date. The contractor may request written approval from the KO to abandon in place the contractor installed fencing.

0. Dumping Stations: One government owned dump station located aboard MAGTFTC/MCAGCC, is available for use under this contract. The primary dump station is located at Bldg. 5001, Lift station 6, on Camp Wilson (3850D). The contractor will be notified by the KO or the PWD when the primary dumping station is not available and an alternate dumping station must be used at the contractor’s own expense. The contractor is STRICTLY PROHIBITED from dumping wastes from portable toilets other than those serviced under this contract in government owned dumping stations.

0. Spill reporting: All spills shall be reported to the COR immediately. The contractor shall be responsible for the reporting and appropriate clean-up and associated costs, to include applicable laboratory testing as required by the government. The contractor is responsible for all associated costs of clean-up.

2. Utilities: The government will make available the use of WIP and fire hydrants (to be used for the purpose of resupplying water) aboard MCAGCC for the contractor’s use in performance of tasks outlined in this PWS. Contractor trucks receiving government-provided water must be equipped with the appropriate backflow or air gap devices according to California State regulations. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount.

1. Water Stations: There are two WIPs located on MCAGCC. One is at WIP 1936 at the intersection of 10th Street and Del Valle Road. The second WIP is located at the intersection of Camp Wilson Road and Coyote Valley Road, Camp Wilson. The use of fire hydrants may be requested by the contractor after contract award. The authority for use of fire hydrants will be Mr. Ronald P. Genet, Public Works Division, Facilities Maintenance Department (ronald.genet@usmc.mil). If authorized for such use, the contractor shall use RP UNIT. Failure of the contractor to utilize a RP UNIT will result in the government rescinding WIP privileges. Permission to use fire hydrants is in the sole discretion of the government, and refusal of permission shall not constitute grounds for contractor claim or request for equitable adjustment.

2. Equipment: The government will provide the contractor with radios that are incidental to the performance of delivering, servicing, and/or picking up toilets in training areas. The contractor shall check out the radios from Range Control, utilize them only when performing work on this contract in the training areas and return the radios to Range Control on a daily basis. At no point shall the contractor leave the area of performance in possession of any radios. The government will maintain accountability and control of these radios during the performance of this contract. The contractor shall reimburse the government for any lost or damaged radios.

1. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

3. General: The contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.

3. Portable Toilet Specifications: Portable toilets shall be made with a HIGH-DENSITY POLYETHYLENE construction which are impervious to moisture, have urinals securely fastened to the tank or structure, have adequate drain flow, be of the non-flush type, skid mounted, and shall have a toilet seat, a toilet paper holder designed for that purpose, screened ventilation, an outside door handle, and an inside locking door latch. Toilets provided under this contract need not be new, but are to be in serviceable condition, without holes or chemical leaks, of a material having a nonabsorbent finish, and the doors, hinges, and latches shall operate as intended. COLLAPSIBLE WOOD, FIBERGLASS AND TOILETS WITH OPEN GRID FLOORING ARE NOT ACCEPTABLE. Contractor shall ensure that all portable toilet stations are STAKED OR TIED DOWN to prevent spillage or being tipped over during high wind storms and other weather events. Placement of sand bags, to include inside or on top of, to secure the toilets is NOT ACCEPTABLE. Contractor shall ensure portable toilets are not placed within 20 feet of any storm channel or natural wash. Material safety data sheets shall be delivered for all equipment and chemicals as required by local, state, and federal laws.

1. SPECIFIC TASK:

4. Basic Services. The contractor shall provide delivery/ pick-up services and cleaning services as outlined under each task order under this contract.

4. Portable Toilet Delivery/ Pick-up: The government will require the contractor to deliver, locate, and service portable toilets in rough terrain or unpaved areas. Therefore, delivery to and servicing at these areas might require the contractor to use heavy duty 4WD vehicles. Also, delivery and pick-up charges shall be a combined fee to include one servicing at the time of pick-up, and shall include all costs associated with delivery and pickup. Delivery charges shall be billed at the time delivery is made, regardless of when pickup will occur.

NOTE: Historically, contractors have communicated with government personnel in and around the training areas and, in certain such instances, government employees have been known to request services from the contractor without contacting the RCO. The contractor is advised that no government personnel, except for the KO, have authority to issue task orders or request/change performance of the services in this contract. Therefore, any services rendered without the explicit direction of the KO (whether verbally or in writing) will be considered an UAC and will not be paid by the government.

1. The contractor shall deliver the portable toilets to the provided MGRS grid coordinates as outlined in the task order. Each task order will have a toilet tracker as an attachment with grid coordinates, color zone and service scheduling Toilets that are misplaced as a result of the contractor’s misreading of the map shall be relocated at no additional cost to the government.

1. The contractor shall deliver clean and serviceable toilets to each location at the beginning of each order.

1. The contractor shall upon pick-up, remove all trash, place it in sealed trash bags, and drive it from the site to the nearest trash receptacle. Trash from sites other than MCAGCC shall not be placed in government trash receptacles. Excessive trash will be brought to the attention of the COR and/or the KO.

1. The contractor may delay delivery/pick-up the unit(s) in question if delivery/pick-up of the unit may be harmful to the operators (i.e. live fire in the area, etc.). The COR shall be notified immediately of such situations, and the contractor shall follow the COR’s instructions.

1. The contractor shall remove all portable toilets from training areas within three (3) working days of completion of the order or notification of any early termination of services.

4. Portable Toilet Cleaning Services:

2. The contractor shall restock supplies, when toilets are serviced, with adequate items to maintain the inventory of supplies between servicing. A minimum of two (2) rolls of toilet paper shall be placed in toilets, provide an odorless disinfectant and maintain fluid.

2. The contractor may reserve their obligation to clean the unit(s) in question if the cleaning of the unit may be harmful to the operators (i.e. live fire in the area, live ammunition, etc.). The COR shall be notified immediately of such situations, and the contractor shall follow the COR’s instructions.

2. The contractor shall utilize chemicals that have been approved for use in accordance with all applicable local, state, and federal laws and regulations, and all applicable DOD and DON Regulations. The contractor shall comply with sustainable acquisition policies, which apply to both contracts for supplies and services that require the delivery, use, or furnishing of products. Sustainable acquisition includes products that are energy-efficient and water-efficient, bio based, environmentally preferable, non-ozone depleting, are made with recovered materials, or use renewable energy technologies. See FAR Part 23. The contractor shall comply with all changes to sustainable acquisition policies (e.g., addition of USDA-designated items), and such compliance will not be grounds for contract modification or equitable adjustment.

2. The contractor shall maintain and repair toilets as necessary to keep them in good working order and with a good appearance. All dirt, mud, dust, markings, and graffiti shall be removed from the interior and exterior of the toilets. When it appears to the contractor that damages to a unit are due to deliberate and extensive abuse by government personnel, the contractor shall contact the COR to arrange a joint inspection prior to commencing repairs. The determination concerning government responsibility will be made by the KO and is final. Claims for excessive damages or total losses as a result of government action or inaction shall be treated as a contract claim and handled under the disputes clause. Contractor shall document each case.

3. Any required repairs or replacement of equipment, including but not limited to urinals, latches, hinges, toilet paper dispensers, and toilet seats shall be made within 24 hours after notice by the COR or KO. In the event the toilet is leaking, the toilet shall be removed from service immediately.

4. Emergency Delivery and Cleaning Services: The government may require the contractor to provide additional cleaning and maintenance services when directed by the KO.

1. MCAGCC Access/Security Requirements-Contractor and Contractor-Employee Access Conditions:

Access Procedures Are Mandatory: The contractor shall comply with all current access procedures throughout all performance periods under this contract, and changes to these procedures shall not constitute grounds for contractor claims or request for equitable adjustment. All contractor employees are required to obtain business access or permanent business access. Daily access procedures must not be used to circumvent background check requirements outlined below. Attempts to improperly use daily access procedures may result in denial of access to the involved employees.
