JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF BRAND NAME OR EQUAL DESCRIPTIONS, OR PROPRIETARY SPECIFICATIONS

AND STANDARDS, IN SOLICITATIONS

1. Contracting Activity.

Marine Corps Field Contracting System, Marine Corps Installations East-Marine Corps Base- Camp Lejeune, North Carolina

2. Description of the Action Being Approved.

Inclusion of a proprietary specification or standard in Request for Quote Number M6700123Q1010 for maintenance support of Dense Wave Division Multiplexing (DWDM) telecommunications hardware and software systems.

3. Description of the Supplies/Services.

The Government requires maintenance and support services for Dense Wave Division Multiplexing (DWDM) telecommunications hardware and software systems manufactured by Infinera Corp. for a period of nine months.

4. Statutory Authority Permitting Other Than Full and Open Competition.

This document meets the regulatory requirement at DFARS 213.501(a)(ii) to execute the justification and approval addressed at FAR 13.501(a) in order to use proprietary specifications and standards. FAR Subpart 13.5 procedures are being utilized for this acquisition in accordance with 41 U.S.C. 1901.

5. Rationale Justifying Use of Cited Statutory Authority.

The existing Infinera/Coriant Dense Wave Division Multiplexing system is a telecommunications systems hardware and software platform. The system has propriety software and hardware noted below that requires support from Infinera/Coriant or an authorized partner in order to ensure software patches, security updates and repair/replacement parts are compatible with the existing system.

The Infinera Dense Wave Division Multiplex (DWDM) Optical Transport network includes, but is not limited to the 7100 Optical Transport Systems (OTS), the 7100 Nano Optical Transport Systems, the 5500 NGX SONET Add/Drop Multiplexers, and the 7100E Electrical Interface Nodes.

All of the Infinera DWDM transport equipment is managed by the Tellabs 7194 Network Management System software. The brand name requirement is to ensure that the s software and hardware requirements are compatible with the existing system.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market research was conducted in accordance with FAR Part 10 and revealed that there are multiple vendors in the commercial market capable of providing the required services. A Request for Information (RFI) was sent to three SDVOSB with one vendor responding positively. A sources sought was posted to SAM.gov on 14 October 2022 with one reply from an 8(a) small business who expressed interest in the requirement.. A solicitation will be posted to Sam.gov to allow for competition to the maximum extent practicable.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, the activity has no plans at this time to eliminate the use of proprietary specifications and standards from future solicitations for the types of services covered by this document; however, this will be reassessed during follow-on acquisition planning.
