PERFORMANCE WORK STATEMENT
1.0 BACKGROUND: This Performance Work Statement (PWS) defines the requirements for the Forklift
Simulators that will be delivered to Marine Corps Logistics Base Albany, GA; Marine Corps Support Facility
Blount Island Command, FL; and Marine Corps Air Station Beaufort, SC.
2.0 SCOPE OF WORK: This is a non-personal services contract to provide stand-alone Virtual Reality
(VR) Forklift Simulators. The government shall not exercise supervision or control over the contract service providers performing the services herein.
3.0 REQUIREMENT: Contractor shall provide forklift simulators that meet the salient characteristics included in this solicitation. This requirement has specific delivery, installation and training requirements identified in paragraphs 4.0 and 5.0 below.
4.0 DELIVERY: Contractor will coordinate delivery with the designated point of contact, to be prvoided upon contract award, for each facility as follows:
-Marine Corps Logistics Base Albany, GA.
-Marine Corps Support Facility Blount Island Command, FL.
-Marine Corps Air Station Beaufort, SC.
5.0 INSTALLATION: (Marine Corps Logistics Base Albany, GA only) The contractor will be responsible for uncrating, unpacking, assembly, connecting cables and installation of the VR Forklift Simulator only at MCLB
Albany. Installation shall include the assembly, mounting, installation and software configuration of all equipment.
5.1 All materials and accessories shall be installed in accordance the industry standards and manufacturer’s written instructions.
5.2 The contractor shall provide all documentation, user guides, maintenance, operations and administrative manuals to the Government.
5.3 The contractor will provide the preventive maintenance, warranty replacement, firmware upgrades, software support and replacement of defective equipment for up to one year at the time of installation.
5.4 The contractor shall provide unlimited telephone support and Email support 24-hours a day, 7 days a week
Monday through Friday 0900-1700, Pacific Standard Time. The contractor shall not be required, except in case of emergency, to furnish services on Federal Holidays.
6.0 TRAINING. Training shall be conducted at Marine Corps Logistics Base Albany, GA only.
6.1 The contractor shall provide an authorized and proficient technical representative to deliver requisite training
For the VR Forklift Simulator in accorandance with industry standards.
6.2 Government personnel participating in the training will be from Marine Corps Logistics Base Albany, GA;
Marine Corps Support Facility Blount Island Command, FL; and Marine Corps Air Station Beaufort, SC.
6.3 The contractor shall not use Government facilities or other Government property for personal or other business not related to this contract.
6.4 The Government reserves the right to restrict the performance of this contract by any individual who is identified as a potential threat to the health, safety, security, general well-being, or operational mission on the installation and its population.
6.5 Sepcific training objectives are as follows:
6.5.1 Review of printed documentations to include all user guides, maintenance, operations and administrative manuals.
6.5.2 Describe and demonstrate how to properly operate and shut down the VR Forklift-Simulator.
6.5.3 Describe and demonstrate how to provide VR Forklift-Simulation training to include software menu navigation.
6.5.4 Troubleshooting the VR Forklift Simulator to return to an operational condition.
6.5.5 Share knowledge and best practices to conduct forklift simulation training.
6.5.6 Describe and demonstrate required preventive maintenance of all components.
6.5.7 Demonstrate how to properly clean and sanitize the components for healthful use.
6.5.8 Answer any questions related to the VR Forklift Simulator.
6.5.9 Conduct this training and remain available up to 6 hours in a single business working day.
Delivery will be made during normal business hours.
7.0 BASE ACCESS: Due to COVID-19 DBIDS access/applications are limited.
7.1 Contractors and or Delivery drivers must have in their possession: their contract number, delivery address and sponsors contact information in order to gain initial access to the base. The Government POC will be provided at time of award.
7.2 Contractors must be registered in the Defense Biometrics Identification System (DBIDS). It is the
Contractors responsibility to ensure all their employees and or subcontractors are properly registered within
DBIDS.
7.3 DBIDS credentials will be valid for the duration of your contract, not to exceed three years; however, re-vetting of individuals' information will occur each year.
7.4 Contractors requiring access for over 60 days will receive a credential valid for up to one year.
7.5 Contractors requiring access for less than 60 days will receive a temporary paper pass.
7.6 Contractor Common Access Card (CAC) Eligibility: Contractor personnel authorized CAC's are exempt from DBIDS enrollment.

8.0 CONTRACTOR'S UNAUTHORIZED WORK PERFORMANCE. The Contractor shall not Perform work that deviates from contract requirements and specifications. If the Contractor deviates from contract requirements and specifications without approval of the CONTRACT ADMINISTRATOR/OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.

The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the U.S. Marine Corps via a secure data collection site. Contracted services excluded from reporting are based on Product Service Codes (PSCs).
The excluded PSCs are:
(1) W, Lease/Rental of Equipment;
(2) X, Lease/Rental of Facilities;
(3) Y, Construction of Structures and Facilities;
(4) D, Automatic Data Processing and Telecommunications, IT and Telecom-Telecommunications
Transmission (D304) and Internet (D322) ONLY;
(5) S, Utilities ONLY;
(6) V, Freight and Shipping ONLY.
The contractor is required to completely fill in all required data fields using the following web address:

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause
52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or
Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM)
(https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as
OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered
(include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--

2019)
(a) Definitions. As used in this provision, “covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video
Surveillance Services or Equipment.
(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM)
(https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(c) Representation. The Offeror represents that it [ ___ ] does, [ ___ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) (Tailored)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
BASIS OF AWARD: Award will be based on Best Value with price and other factors considered. The Government intends to make an award to the vendor whose proposal represents the best value to the Government based on (1)
Vendor’s Technical Acceptability, (2) Delivery and (3) Price.
Each vendor must ensure that a completed FAR Provision 52.204-24 (Representation Regarding Certain
Telecommunications and Video Surveillance Services or Equipment) accompanies their submitted quote.
EVALUATION: The Government reserves the right to award without discussions, but reserves the right to engage in discussions if later determined to be in the best interest of the Government. A mere statement that the vendor https://www.sam.gov/
“will meet the Government’s requirement” is insufficient; the vendor must demonstrate how it will meet the requirement. Vendor quotes shall include the following information:
a. Price: All quotes must be the Contractor’s best pricing. The price quote must reflect unit prices, extended amounts per line item, and overall total. (Note: All prices must be actual “face-value” pricing having already accounted for any discounts offered and extended to the Government).
b. Technical Capability: Demonstrate the capability to provide all items requested. The quote shall have all pertinent information in sufficient detail to provide the evaluators a clear understanding of the vendor’s ability to meet the technical requirements of this solicitation. It is the responsibility of the Contractor to present enough information to allow the items to be meaningfully evaluated without discussions.
Descriptive literature outlining the specifications of the items quoted to include drawings, the manufacturer’s name, and manufacturer’s complete part numbers of all items quoted shall be submitted in the quote.
c. Delivery: Clearly state if the quoter can meet the required delivery of 30 September 2020. To be considered for award, quoters who cannot meet the required delivery date shall provide a date/lead time that the units will be made available to the Government.

“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or

“Sensitive technology”—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act
(50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
