Question: Will the Marine Corps provide an estimated number for each of the training classes for each location for each contract period so all offerors are able to propose on the same information?

Question: In virtually identical type work to this solicitation, the Department of Labor has determined that instructors teaching motorcycle training courses should be classified as wage determination employees. We request that the Government incorporate in the Service Contract Act and WDs for all locations listed in the solicitation and require that all bidders be evaluated for proper utilization of WD rates in their price proposal.
Answer: In accordance with 29 CFR 541.303(b), teachers engaged in automobile driving instruction are exempt from the Fair Labor Standards Act of 1938, as amended. In accordance with 29 CFR 541.4, employers, on their own initiative or under a collective bargaining agreement with a labor union, are not precluded by the Act from providing a wage higher than the statutory minimum, a shorter workweek than the statutory minimum, or a higher overtime premium than provided by the Act.
Question: What are the minimum and maximum number of students for each course?
Answer: The maximum number of students per course is set by the owner of the course curriculum. It is the offeror’s responsibility to adhere to the student/instructor ratios established by the curriculum owners.
Each CLIN identifies a minimum number of students per course for pricing purposes. The CLIN structure is not set up for the price per student; however, it is set up for the price per course for a set number of students. For example, CLIN 0001 shall be priced for six (6) students per course. If the Government has a requirement for 6 students for CLIN 0001 training, the resulting task order would be issued for a quantity of one (1) course for CLIN 0001 which would allow for 1-6 students to attend. However, if the Government has a requirement for 12 students, the resulting task order would be issued for a quantity of two (2) for CLIN 0001 which would allow for up to 12 students to attend.
The Government is not directing which sources offeror’s utilize (if any) for the Level III Motorcycle Safety Training; however, a list was provided of previously approved and acceptable curriculum and sources that meets the requirements of Section 5.3 of the PWS. If the Offeror proposes any sources and/or curriculum owner for the Level III Motorcycle Safety Training that is not listed in Section 5.6.2 of the PWS, the offoror shall meet the specified criteria in Section L, Paragraph L.1.4.1.1, to include but not limited to, the minimum and maximum student/instructor ratio.
Question: Will canceled classes be reimbursed if the class is canceled the day it is to begin?
Answer: Task orders issued for courses will likely be rescheduled instead of cancelled in their entirety. The Government shall give the resulting contractor a minimum notice of five (5) business days of cancellation or rescheduling. If the ordering activity does not provide the contractor a minimum of a five day notice, the Government shall be responsible for reimbursing the contractor’s incurred travel expenses, in accordance with Paragraph G.1 of this solicitation.
Question: Since the offeror must provide a breakdown of pricing for each training course identified in Section B in Volume III Price, can the page limit be increased since 15 pages may not be sufficient for all classes for each year?
Answer: The page limitation for Volume III Price will be changed from 15 pages to unlimited pages.
