About this file
This is a Commercial Item Sole Source Justification document for a repair requirement issued by the United States Marshals Service Northern District of Texas. The justification authorizes the procurement of air conditioning unit repairs from a single source vendor without competitive bidding under FAR Overhaul Part 12 and FAR Part 6.103-2 (Unusual and Compelling Urgency).
The requirement involves repairing the air conditioning unit at the USMS Fort Worth facility, specifically replacing air conditioning cassettes on the 2nd and 5th floors due to leaking and replacing the evaporator coil. The A/C unit cools the cellblock and surrounding office areas where detainees are held during transfer or court proceedings and where attorneys meet with inmates. The estimated total value is $9,160.96, and the period of performance runs from July 27, 2026, to September 30, 2026. The selected vendor is Texas Total Comfort Systems, LLC (UEI: GHFKHJG8QLL3), an approved GSA vendor. The justification cites urgent safety and operational concerns due to the current unit's non-functionality, creating unacceptable temperature levels. Limited market research was conducted due to the urgency and the requirement for GSA facility access approval. The proposed price of $9,160.96 is deemed fair and reasonable based on FAR Overhaul Part 15.404-1(b)(4). The document has been certified and approved by the Technical Point of Contact (Annette Dominguez), Supervisory Contracting Officer (Rachael Vargas), and Contracting Officer (Julie M. Simpson), with publication requirements to be fulfilled under FAR Overhaul Part 5.

Requirements of the Procurement that makes it necessary to limit sources.
The requirement is urgent because the current unit is not operating properly, and the area is not cooled which makes the temperature reach unacceptable levels. USMS has the responsibility to properly cool the area for prisoners to be held while in transfer or waiting on court. This space is also used for attorneys to meet with the inmates. FAR Overhaul Part 12 – Soliciting from a Single Source for MIQ M-26-D77-R-000047 well as the safety and well-being of the detainees, to include in-custody criminal and material witnesses.
Texas Total Comfort Systems, LLC, is an approved GSA vendor who can work in this facility.
Results of Market Research
Due to the urgency of this requirement and the approvals granted by GSA to work at this facility, limited market research was conducted. While other vendors could potentially perform this service, granting them access to the facility would take additional time, which could impact the agency as discussed above.
Actions to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services
If this requirement was not of such urgency, there would be time to solicit and obtain three quotes. However, due to the urgency, soliciting is not advantageous to the government due to the reasons discussed above. Obtaining approval from GSA to do work in their facility could impact the agency as well.
This notice will be posted in accordance with FAR Overhaul Part 5.
