STATEMENT OF WORK

Chemical Toilets and Hand Wash Stations

1. BACKGROUND. Marine Corps Logistics Base (MCLB) Barstow supplies the Porta Johns for use on Nebo and

Yermo Annexes. This is a Firm-Fixed-Price, Requirement Type Contract for one base year and four option years plus an option to extend for up to six months to provide support and services for chemical toilets/equipment throughout MCLB Barstow, Nebo (approximately 1879 acres) and Yermo (approximately 1859 acres) Annexes.

2. GENERAL REQUIREMENTS. Contractor is to supply all equipment, labor, transportation, materials, tools, supplies, and supervision necessary to perform all operations required to furnish and service chemical toilets and hand wash stations. Generally, all chemical toilets will remain on location for a permanent basis. Some of the areas of placement and servicing will be in rugged off-road locations and may require four-wheel drive capability to access. Geographical areas will required include, but not limit too, firing range areas, field training areas, and populated areas.

3. NON-PERSONAL SERVICES. The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Contracting Officer immediately.

4. PERIOD OF PERFORMANCE. The anticipated period of performance is for base period from date of award through 08 February 2025 and four option periods and an option to extend for up to six months as follows:

Option One: 09 February 2025 – 08 February 2026

Option Two: 09 February 2026– 08 February 2027

Option Three: 09 February 2027 – 08 February 2028

Option Four: 09 February 2028 – 08 February 2029

Option to Extend: 09 February 2029 – 08 October 2029

5. BUSINESS RELATIONS. The contractor shall successfully integrate and coordinate all activity needed to execute the requirement. The contractor shall manage the timeliness, completeness, and quality of problem identification. The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel.

6. PERFORMANCE REQUIREMENTS.

a. Contractor Responsibilities.

(1) The contractor shall provide standard units, handicap units and hand wash stations at various locations aboard

MCLB Barstow.

The quantities for the YERMO ANNEX locations include:

- seven (7) standard portable toilets,

- two (2) handicap portable toilets,

- three (3) handwashing stations,

- and seven (7) drip pans to prevent spillage for all standard portable toilets at the YERMO ANNEX.

The quantities for the NEBO ANNEX locations include:

- eight (8) standard portable toilets,

- one (1) handwashing stations,

- and eight (8) drip pans to prevent spillage for all standard portable toilets at the NEBO ANNEX.

The contractor shall furnish all labor, supervision, tools, materials, vehicles, equipment, transportation, and other items necessary to provide the services required. The contractor shall be responsible for all cleaning, placing, and relocating of products as required contract guidelines. The contractor shall also be responsible for cleaning, resupplying, removing all waste collected from the respective units and transportation of the waste to an approved waste disposal site. The contractor shall pay the costs for all waste discharge fees and transportation associated with removal of waste to the disposal site.

(2) Duration of Placement and Periods of Service. The Government requires the placement and servicing of chemical toilets/equipment for Full Term Placement throughout the life of the contract and/or option year with an option of two location moves per year based on the following:

(a) Toilets and equipment placed from the start of the contract with the Governments anticipation that the toilets and equipment will remain in place through the full term of the contract including any and all option periods exercised.

(b) Toilets placed after the initial delivery order is placed with the Governments anticipation that the toilets and equipment will remain in place through the full term of the contract including any and all option periods exercised. The government reserves the right to request removal of full-term toilets and equipment at its discretion if there is no longer an identified need.

(3) The services will include delivery/pickup and cleaning TWICE per week for equipment provided to

Maintenance Center Barstow on the YERMO ANNEX. For equipment located aboard the NEBO ANNEX, FIRING

RANGE, and RAIL OPERATIONS the services are only required ONCE per week. Additional services may be required in the event a tip-over occurs that was created by high winds or MCLB Barstow personnel and shall be charged accordingly.

(4) Toilets and hand wash stations must be operational at all times. A quality control plan (QCP) must be submitted to the Contracting Officer and discuss the maintenance that will be performed to keep all toilets and hand wash stations operational. The QCP will also discuss how the cleanliness standards for all toilets and hand wash stations will be met as described herein. Each service will be in accordance with standard commercial practices, in compliance with prescribed Federal, State and local regulations and will include at a minimum:

- Removal of all waste (including human waste, toilet paper, and any trash or debris)

- Restock of Toilet Paper (minimum 2 rolls per chemical toilet)

- Replacement of de-scent

- Cleaning and Sanitizing

- Refilling of hand wash stations

- Refilling of waterless anti-bacterial hand sanitizer

(5) The Quality Assurance Surveillance Plan (QASP) provided herein outlines the standard of surveillance for monitoring contract performance. The contractor shall demonstrate the ability to meet the specifications of the

QASP. The contractor must communicate any possible service failures with COR. If service failure occurs, the contractor must notify the COR within six hours.

(6) PRIOR to rendering services outlined in this agreement, the contractor representative must make in-person contact with the COR located aboard MCLB Barstow Base Supply, Warehouse 8 and assigned a Quality Assurance

Employee (QAE). The COR or QAE will be present at each location to verify required services are completed.

Upon completion of services, the contractor representative must sign the Inventory Control Form provided by the

COR. The ICF will be uploaded by an authorized acceptor in Wide Area Work Flow (WAWF) upon acceptance of the invoice.

(7) Inventory. Due to the magnitude of this requirement, the contractor shall have an adequate inventory to meet the estimated quantities of chemical toilets required at one time, and an adequate number of trucks to make the deliveries. The contractor will conduct an initial joint inventory and thereafter a joint semi-annual inventory with the

COR. The inventory is expected to remain accurate between the joint inventories because of the weekly/bi-weekly cleaning/maintenance requirements. The contractor must demonstrate the ability, via maps, maintenance/service checklists, or other such method, to ensure that service technicians are able to locate and service chemical toilets and hand wash stations that may not be readily visible throughout the installation(s). The contractor shall provide copies of service documentation upon request of the COR or Contracting Officer. Additionally, trucks must be equipped with appropriate backflow or airgap devices in accordance with California State Regulations and must be able to navigate rough terrain. All contractor vehicles will prominently display the company name and telephone number.

(8) Delivery and Pick-Up. The contractor will provide toilets as required to ensure 100% Operational

Support. Delivery or relocation charges are one-time charges for as long as the unit is placed in the same location. No additional charges will be assessed unless the unit is relocated from the originally placed site. Pick-up and delivery of a unit due to unit failure will be at no additional cost to the government.

(9) Additional Fees. Charges will be assessed by the contractor for damages occurring to chemical toilets above normal wear and tear. Damages that are a result of Acts of God, such as but not limited to abnormal heat, excessive winds, and flooding, will be repaired or replaced at no cost to the government. For the purposes of this contract, a worn, stretched, or broken spring or other door closing mechanism is considered to be normal wear and tear resulting from use. The contractor is advised that strong winds can occur and that damages to unit doors, hinges, and frames resulting from an unsecure door may occur. The vendor may take any action necessary to prevent potential damages from high wind or prop/rotor wash. The government is not responsible for failure to take the appropriate measures.

(10) Waste Disposal Fees. Actual waste disposal costs shall be borne by the contractor. There will be no waste discharge aboard any federal installation for services performed under this contract.

(11) Service Hours. The work may be performed within reasonable weather conditions (where safety is not an issue). The standard work hours for chemical toilet services will be Monday through Friday 7:00 a.m. - 4:00 p.m.

PST. Non-normal working hours would include any time outside of standard work hours, weekends, federal holidays and those days designated as federal holidays. In the event of unforeseen damage to the supplied equipment, work may be required on short notice (2.5 hours response time); however, at least 24 hours advance notice of requirements will be given if possible. For communication with Government personnel the office hours are Monday through Friday, 7:30 a.m. to 4:00 p.m. PST.

(12) Invoicing. The contractor shall invoice once a month. The contractor shall prepare a detailed invoice in electronic spreadsheet format under this contract. The invoice must detail the invoice date, period of services provided, location of services provided, contract number, relevant sub CLINs, description of the service, quantity of the service performed, unit price of the service, extended price of the service, and grand total of the invoice. The invoice must be a proper invoice in accordance with contract terms and conditions. The spreadsheet shall be prepared and provided to the COR for review and reconciliation with the contractor prior to the contractor rendering an invoice in WAWF. The WAWF invoice submission shall be accomplished as a single CLIN billing reflecting the total value of the services performed for the month for each delivery order received. The spreadsheet file detailing the relevant SLINs shall be uploaded to the WAWF invoice of the respective delivery.

(13) Contractor Monthly Status Report. The contractor shall submit a consolidated monthly status report detailing any service requests that were not completed within the prescribed timeframes, the reason for any service failure(s), any problems encountered during the period, any service complaints received during the period, status of government provided space and equipment, and total waste volume discharged for the period for all deliveries issued for service aboard MCLB Barstow. The waste volume is informational only for the governments use in tracking cyclical use and trends. The monthly report should be uploaded to the WAWF invoice of the Base Support delivery.

This order is identified as the delivery containing the full-term chemical toilets. The contractor may include additional information as necessary in the monthly status report.

(14) Spill Reporting. All spills shall be reported to the COR immediately. The contractor shall be responsible for the reporting and appropriate clean-up and associated costs, to include applicable laboratory testing as required by the Government.

(15) Contractor Personnel

(a) It is the responsibility of the contractor to comply with all applicable laws regarding the hiring of individuals that are not U.S. citizens. The contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest nor shall the contractor employ any person who is an employee of the United States Marine Corps, either military or civilian, unless such person seeks and receives approval in accordance with Joint Ethics Regulations.

(b) Contractor personnel shall be well trained and proficient in their assigned tasks, present a neat appearance, and be easily recognized by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges. No item of military clothing or clothing resembling military clothing may be worn. All employees of the contractor must be able to read, write, and understand English.

(c) The contractor shall provide a Project Manager who shall be designated as the primary point of contact

(POC) and who shall be responsible for the daily performance of the contract. The contractor shall provide a current resume for the Project Manager detailing recent (within the last 5 years) similar work experience, operations capabilities and chemical toilet and hand wash station handling with knowledge of rough terrain.

The resume shall be included with the contractor’s proposal and made available for review during source selection. The name of this person and alternate(s), who shall act for the contractor when the manager is absent, shall be designated in writing by the contractor and approved by the Contracting Officer.

(d) The Project Manager may be required to meet at least weekly with the Contracting Officer Technical

Representative and/or Contracting Officer during the first month of the contract to ensure a smooth transition. Subsequent meetings will be held as necessary. The Project Manager or alternate shall be available within two (2) hours, during normal working hours to meet on MCLB Barstow with the COR to discuss problem areas.

(e) After normal hours, the Project Manager or alternate shall be available within four (4) hours.

7. SECURITY REQUIREMENTS.

a. Contractor and subcontractor employees must comply with installation rules and regulations. The Contractor is responsible for ensuring that each of its subcontractors fully complies with the following provisions and shall flow down to subcontracts a clause to satisfy this contractual obligation. The Contractor is responsible for providing information required to obtain clearances, permits, passes, or security badges that are required for Contractor personnel or equipment access. This includes information required for police or background checks or investigations. The Contractor is responsible for ensuring such clearances, permits, passes, or security badges are promptly returned to the issuing activity upon termination of an employee, completion of a project, or termination of a contract or subcontract.

b. All Contractor personnel performing work under this contract who require access to military installations shall obtain personal entry and vehicle passes from the Provost Marshalls Office (PMO) of each base. This process currently includes the requirement that employees under a contract of one year or longer obtain a Business Pass, which requires completion of an application used to conduct background checks.

c. The Commanding Officer of MCLB Barstow has broad authority to remove or exclude any person from the military installation to protect personnel and property, to maintain good order and discipline, and to ensure the successful and uninterrupted performance of the Marine Corps mission. In the exercise of this authority, the

Commanding Officer may refuse to grant personal entry passes or may bar Contractor employees, including employees who have been granted a personal entry pass. Refusal to grant an employee a personal entry pass or barment of an employee does not relieve the Contractor of the responsibility to continue performance under this contract.

d. The Contractors employees shall observe and comply with all base rules and regulations applicable to contract personnel, including those applicable to the safe operation of vehicles, and shall not be present in locations not required for the proper performance of this contract. Contractor personnel performing work under this contract shall be readily identifiable as an employee of the contractor through the use of uniforms with nametags. The contracting officer may approve alternate methods of ensuring contractor personnel are readily identifiable. Contractor personnel and equipment entering a military installation are subject to security checks. Contractor personnel shall follow any direction given by Military Police or other security or safety personnel.

e. The Immigration Reform and Control Act of 1986 (IRCA), Public Law 99-603 (8 U.S.C. 1324a) requires employers verify the eligibility of individuals for employment to preclude the unlawful hiring, or recruiting or referring for a fee, of aliens who are not authorized to work in the United States. By signing this proposal/contract or by beginning work under this contract, the Offeror/Contractor certifies it has and will comply with IRCA, to include that it has verified the identity and employment eligibility of any individual employed who is or may be employed by the offeror and works under this contract.

f. Application for Vendor/Contractor Business Passes: The procedures below are the requirements for MCLB

Barstow:

(1) The Contractor will obtain a letter of support from the customer that their contract ultimately supports. The letter of support will identify the Company Name, Contract Number, period of performance of the Contract, location of performance, the Driver’s license and expiration date of each of the Contractors employees, and the point of contact information for the customer that signed the request. The Contractors personnel will take the letter of support to request either a business pass or RAPIDGate access to Marine Corps Police Department BLDG. 101

Barstow, Ca. 92311 for processing.

(2) Business Passes issued by Marine Corps Police Department to vendors or contractors are effective from the date of issuance, for a period of 60 days or the end of the contract whichever date occurs first. Personnel denied a business pass might appeal in writing to the Commanding Officer, MCLB Barstow (Attn: CMD Inspector). Denial or revocation of a business pass may be made if the applicant:

- Is listed on the National Terrorist Watch List.

- Is not a U.S. Citizen and is illegally present in the U.S. or whose U.S. citizenship, immigration status, or

Social Security Number (SSN) cannot be verified.

- Is subject to an outstanding criminal warrant.

- Whose business pass application contains false or fraudulent information.

- Has obtained a felony conviction within the last 10 years.

- Has obtained a total of three criminal misdemeanor convictions within the last 10 years.

- Who is a registered sex offender regardless of the date of the criminal offense.

- Has obtained a criminal misdemeanor or felony conviction for the following types of criminal offenses:

• Offenses of a sexual nature;

• Offenses of violence;

• Offenses related to gang related activity, supremacist, or extremist behavior, i.e., hate crimes;

• Crimes resulting from the possession, use, manufacturer, introduction, or distribution of any illegal drug listed in the Comprehensive Drug Abuse Prevention & Control Act of 1970, Schedules I through IV.

• Offenses in which weapon instrumentality (e.g., firearm, knife, or other bladed instrument, club, brass knuckles) was used either as a means of violence, or threat of violence;

• Whose military active duty was terminated by the receipt of a dishonorable discharge or bad conduct discharge;

• Has been issued a debarment order and is currently banned from any military installation; or

• Who has exhibited characteristics, traits, or other indications that cause concern for the safety or welfare of personnel and/or residents aboard the base; or that causes concern for the physical security of the base.

g. MCLB Barstow has implemented a Contractor-managed security service, RAPIDGate. RAPIDGate is consistent with and complementary to Homeland Security Presidential Directive 12 (HSPD-12) and the Federal Information

Processing Standard 201 (FIPS 201). NOTE: RAPIDGATE IS TO BE REPLACED WITH DBIDS ACCESS

REQUIREMENTS. DETAILS ON REQUIRED ACCESS UNDER DBIDS WILL BE PROVIDED WHEN

AVAILABLE.

(1) Participation in RAPIDGate is optional, but contractor personnel who are not enrolled in RAPIDGate will be limited to gates which can safely accommodate traffic backups.

(2) Under the RAPIDGate program, Contractor personnel are vetted through a series of national and local record checks to determine whether they meet MCLB Barstow’s criteria for access. The determination of whether to authorize a pass (badge) is made by the Government. The badges have Radio Frequency Identification (RFID) capability and will be scanned upon entry onto the installation. Contractor personnel departure from the installation will be recorded by passive RFID receivers.

(3) The cost of the RAPIDGate program is $99.00 per year for the Contractors firm, and $129.00 per Contractor employee for a one-year pass. The fee for lost or stolen passes is $30.00.

(4) Contractors who choose not to participate in the RAPIDGate program will be required to obtain a 30-day business pass from PMO.

(5) Contractor personnel who are issued a Common Access Card (CAC) as a requirement for their positions

(specifically access to the Navy Marine Corps Intranet), do not need to participate in RAPIDGate.

h. Application for Common Access Card (CAC): For personnel that require access to any government computers, the following procedures are required:

(1) The Contractor will be required to provide proof that a National Agency Check (NAC) or National Agency

Check with Inquiries (NACI) has been submitted to the Office of Personnel Management (OPM) for each employee that has a requirement for a CAC Card. During the period between the time that the request is submitted and the time that the investigation is returned, the Government may grant temporary access to the Contractors employee.

Whether to grant temporary access is within the sole discretion of the Government, and a decision not to grant access shall not be grounds for a request for an equitable adjustment or other contract modification, and shall not constitute an excuse for Contractor failure to perform. Such temporary access will not exceed 90 days.

(2) Upon the return of the Investigation Schedule Notice and Certificate of Investigation from OPM, the Contractor shall provide a copy to the security manager that has overall responsibility for the customer supported by the

Contractors employees.

(3) "Report of Agency Adjudication Action" (form 79A) is sent when there are potential actionable issue (s) at the minor, moderate, or substantial level which may be disqualifying under suitability/security considerations. If the contractor receives an Agency Adjudication Action from OPM, the security manager shall be consulted before such adjudicative action is determined and returned to OPM.

(4) The Government will use the Adjudicative Guidelines (CNO ltr 5520 Ser 09N2/6U871220 of Sept 06) to guide determinations on whether access shall be granted.

(5) The Contractor shall be notified in writing if there is a disqualifying event that prevents the Contractors employee from obtaining a CAC. If temporary access was granted it shall be immediately revoked.

(7) Base access requirements and procedures may change during the term of a contract. The contractor shall comply with all changes, and such compliance shall not be grounds for a request for an equitable adjustment or other contract modification.

8.SAFETY. Contractor Compliance: The contractor and its subcontractors shall comply with Public Law 91-596

(Occupational Safety and Health Act (OSHA)) and the Environmental, Safety, and Occupational Health (ESOH)

(DODD 4715.1E). These requirements shall be incorporated into the contractor’s safety and health program. The

Department of Defense (DoD) participates in the OSHA Voluntary Protection Program (VPP). Contractor personnel performing services on a DoD installation shall participate in the local VPP. Information on the VPP is available at http://www.osha.gov/dcsp/vpp/index.html.

a. Mishap Notification and Investigation: The contractor and its subcontractors (if applicable) shall promptly report pertinent facts regarding mishaps involving Government property damage or injury to Government personnel and to cooperate in any resulting safety investigation. The contractor shall notify (via telephone) the cognizant contracting officer, the contracting officer’s representative, and/or other applicable members within four (4) hours of all mishaps or incidents. The Government person notified by the contractor will in-turn notify the Safety office. Contractor notifications made after duty hours shall be reported to the appropriate installation Command Post. If requested by the cognizant contracting officer, the contracting officer’s representative, and/or the cognizant program manager, the contractor shall immediately secure the mishap scene/damaged property and impound pertinent maintenance and training records until released by the investigating safety office. If the Government investigates the mishap, the contractor and the subcontractors shall cooperate fully and assist the Government personnel until the investigation is completed.

9.TRANISTION. The contractor shall follow the transition plan submitted as part of the proposal and keep the

Government fully informed of status throughout the transition period. Throughout the phase-in/phase-out periods, it is essential that attention be given to minimize interruptions or delays to work in progress that would impact the mission. The contractor must plan for the transfer of work control, delineating the method for processing and assigning tasks during the phase-in/phase-out periods.

10.INSURANCE REQUIREMENTS. As required by FAR 52.228-5, the following minimum amounts are established for performance under this contract:

a. Workers Compensation: Statutory Minimum.

b. General Liability: $500,000 per occurrence.

c. Automobile Liability: $200,000 per person/$500,000 per occurrence for bodily injury/$20,000 per occurrence for property damage.

11.ADDITIONAL REQUIREMENTS.

a. Photography is restricted on the Base. Clearance for photography will be obtained from appropriate Base personnel. When requested by the Base, all films must be turned over to the appropriate personnel for processing and security inspection.

b. All contractor personnel are to be familiar with the MCLB Barstow Fire Danger Rating System

(FDRS). Personnel are required to observe all restrictions applicable under the FDRS pertaining to permit activities while on the Base. In particular, vehicles shall be parked only on bar soli/rock. Smoking is restricted to areas of bare soil. Fires of any nature are prohibited.

c. Do not pickup, remove, or disturb any ordnance (spent or live ammunition, brass, pyrotechnics, etc) found while on MCLB Barstow.

d. Some areas of the Base may be inaccessible due to road conditions following heavy and/or prolonged rainfall.

Adjustments to work schedules due to road/weather conditions shall be coordinated with the POC. If your vehicles gets stuck or breaks down, military personnel cannot pull or tow your vehicle. Call MCLB Barstow Police Dispatch

(577-6666/6020) who will refer you to a civilian wrecker service or information (411) for assistance.

12.QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). The Government shall monitor the Contractors performance under this Task/Delivery Order in accordance with the Governments QASP.
