Q&A

1. The following are Government answers to Contractor questions received in response to solicitation M00681-17-T-0048:

Q1: PWS section 5.2.4 - The Twentynine Palms training range is approximately 300 ft x 300 ft. It does not permit Level III training to be performed adequately or safely. Would the government consider allowing the use of an off-site training range?

A1: Yes, provided it allows the contractor to meet the safety and training requirements of the PWS.

Q2: CLIN 1 and 2 (page 13-14 of RFP) - In order to maximize outcomes for training as early as possible, would the government consider changing the frequency of trainings from 1 per week to up to 5 per week?

A2: No, the frequency for training in accordance with the PWS of this order remains at 1 per week.

Q3: PWS Section 2.0 – “The curriculum for all courses must be recognized by the state as the license waiver course for the state where the training is performed.” This statement seems to be non-applicable, as Level 1 and 2 courses are typically associated with licensing a student, while Level 3 courses are given post-license. Would the government consider rewording this requirement to be in line with standard industry practices?

A3: This sentence has been deleted from the PWS.

Q4: PWS Section 5.2.4 – Based on our knowledge of the training range at Camp Pendleton, we believe to effectively and safely conduct trainings it would be ideal to change the required class size from 24 to 16.

Would the government consider this?

A4: Yes, the class size has been reduced to 16 students and the quantity of classes has been increased to 21.

Q5: PWS Section 5.3.1 – Contractor Liaison section of RFP states “The CL shall possess the certifications, qualifications, and credentials as specified by the owner of the curriculum for any courses they may be assigned to instruct”. Is it necessary that the CL be an instructor for Level III trainings, as the expertise for managing events does not necessarily include Level III knowledge?

A5: No. “The CL shall possess the certifications, qualifications, and credentials as specified by the owner of the curriculum for any courses they may be assigned to instruct.” has been removed from the PWS.

Q6: Will the government consider an extension of at least 3 days to allow industry to properly react to updates to the solicitation and/or from q&a responses?

A6: Yes, the new closing date for receipt of quotations is 12:00 pm PST on 10 July 2017.

1st MARINE DIVISION Level III MOTORCYCLE SAFETY TRAINING

PERFORMANCE WORK STATEMENT

1.0 Introduction

The Office of the Commandant of the Marine Corps, Safety Division (CMC SD) provides the overall program management for the traffic safety program for all Marine Corps commands and installations and personnel assigned.

Marine Corps Order (MCO) 5100.19 defines the traffic safety program objective to establish and maintain motor vehicle driving skills, habits, and behaviors in order to reduce injuries and fatalities that negatively impact military readiness. The CMC SD Traffic Safety Program Manager has the responsibility and authority for implementation of the program objective.

This Performance Work Statement (PWS) addresses formal training components in support of the objective for 1ST Marine Division (1st Mar Div), Camp Pendleton, California. Formal training includes specific recognized courses and curricula that have been accepted by the Traffic Safety Program Manager. This contract will be centrally coordinated and implemented by the 1st Mar Div, Safety Division.

2.0 Scope

The purpose of this requirement is to provide current traffic safety training to service members to comply with MCO 5100.19, which establishes the authority of the Traffic Safety Program Manager to determine course content, structure, and subject matter relevance to the traffic safety training objectives. This regulation may be revised due to legal or regulatory changes, new technologies, or other factors and it is the Government’s intention to incorporate regulatory changes under this contract as required.

The traffic safety training courses shall include advanced on road/range motorcycle safety classes. The training courses identified herein are proprietary curricula that are property of the identified curriculum owners and have been determined by the CMC SD Traffic Safety Program Manager to meet the curriculum content and subject matter requirements under MCO 5100.19.

Curriculum owners may modify course content, restructure courses, or offer new curricula as a result of legal or regulatory changes, new technologies, or other factors. As these changes are incorporated into MCO 5100.19, the contractor shall adjust the traffic safety training provided accordingly; however, the contractor shall not incur additional costs for new work under this contract without a properly executed modification by the Contracting

Officer. All curriculum content and execution shall be in accordance with the requirements of the identified curriculum provider.

The intent of this requirement is to establish training efficiencies that lead to timely delivery of training and consistency across the program through contractor services.

Vendors are encouraged to quote more than one course curriculum for each level. The Government reserves the right to award at a quantity less than the quantities stated below.

3.0 Period of Performance

The period of performance is 17 July 2017 – 20 October 2017.

4.0 Place of Performance

The contractor shall provide for traffic safety training at the installations listed below:

1st MarDiv Marine Corps Base, Camp Pendleton CA

Marine Corps Air Ground Combat Center, Twentynine Palms CA

The designated Marine Corps installations are subject to change due to Base Realignment and Closure (BRAC), Joint Basing Initiatives, or other Government-directed action. The Contracting Officer’s Representative (COR) shall inform the Contractor of any installation changes.

5.0 Training Requirements

The Contractor shall provide the categories of training identified below to 1st MarDiv identified in Section 4.0 of this PWS. The Contractor shall deliver the training in the required quantities in accordance with the contract. The Contractor will be paid for courses actually completed upon acceptance in the Invoicing, Receipt, Acceptance and Property Transfer (iRAPT) system (formerly known as Wide Area Work Flow).

• Instructors – The Contractor shall provide instructors with current certifications, qualifications, and credentials as specified by the owner of the curriculum and as required by the applicable state that training will occur. No substitutions of instructors shall be made except in accordance with this section.

All proposed substitutions must be submitted, in writing, at least two (2) weeks in advance of the proposed substitutions to the COR. All requests for substitutions must provide a detailed explanation of the circumstances necessitating the proposed substitution and the certifications, qualifications, and credentials of the proposed replacement(s) as required by the owner of the curriculum. The COR will evaluate such requests and promptly notify the Contractor of his/her approval or disapproval thereof.

• Course Materials – The Contractor shall provide the instruction materials to each student as required by the specific curriculum for each course conducted. Courses that currently satisfy the technical content requirements and the respective curriculum owners are listed in Exhibit A.

5.1 Level III Motorcycle Training – Includes more advanced courses designed for the experienced rider to prepare them to potentially serve as mentors to other motorcycle riders. Level III training may also be provided to other experienced riders in conjunction with special events which focus on motorcycle safety within a unit, higher command, installation, or region. Level III advanced Motorcycle Training is more specialized and may focus on different advanced aspects of motorcycle riding. Level III courses are specifically reviewed and accepted by CMC SD for content and manner of execution under the requirements of MCO 5100.19. Curriculum elements may include the knowledge, skills, and abilities in the list below:

• Cornering Techniques

• Emergency Braking

• Dirt / Off-Road

Riding

• Track Riding

• Hazard Avoidance

• Riding in Groups

• Judgment

• Riding in Traffic

• Riding with Passengers

• Responding to a Loss of

Traction

• Motorcycle Suspension

Principles and Practice

• Maneuvering at realistic street riding speeds (45 mph and higher)

• Responding to locked rear or front wheels

• Trail Braking

• Braking in a Curve

The curriculum elements may be divided among different course offerings. Students should own a motorcycle to take a Level III course and should take the training on their own motorcycle. Government owned training motorcycles are not recommended for Level III Motorcycle Training courses. Exceptions to this rule are not anticipated.

5.2 Curriculum and Providers

5.2.1 Approved Curriculum and Curriculum Owners – The curriculum content and requirements for instructor qualifications are established by and shall be obtained from the listed curriculum owner.

Exhibit A identifies the currently approved curricula and the curriculum owners.

5.2.2 Method of Delivery – The curriculum owners establish the requirements for instructor qualifications and the distribution and use of course materials. The Contractor shall provide instructors qualified to deliver the listed courses at each location identified in Section 4.0 of this PWS. The course delivery shall be provided through either of two (2) constructs:

• The Contractor may deliver courses using its own employee-instructors (or individual sub-contractors) who are trained and certified to the requirements of the curriculum owner and utilize the materials and course content in accordance with the license requirements of the curriculum owner. This applies to the majority of course content listed above. The Contractor shall not utilize or task Government employees to deliver courses under this Contract. The Government may administer courses at its discretion that will be independent of this Contract.

• The Contractor may subcontract the respective curriculum owner or their licensed agents to deliver course content.

5.2.3 Level III Availability – Level III curricula may involve mobilization/demobilization costs, travel, or other costs due to its more limited availability or regional concentration.

5.2.4 Contract Line Items. The requirement was determined to be commercial in nature according to FAR

Part 12; therefore, a fixed price contract is suitable for acquiring the requested commercial services.

5.2.5 Alternative Curricula – Traffic Safety Training is a dynamic industry and the curricula identified herein may be combined, upgraded, or superseded during the period of performance. Additionally, individual state requirements may change with regard to courses acceptable for license waiver or due to changes in Marine Corps, Department of Navy, or Department of Defense requirements.

Consequently, in order to ensure the continuing effectiveness of the traffic safety program over the period of performance, the Government may seek to add or delete specific traffic safety training curricula or modify the locations where specific curricula is to be provided under the provisions of the Changes Clause of the Contract.

5.3 Scheduling and Course Management – The Contractor shall coordinate the scheduling of courses with the

Director of Safety, 1st MarDiv. The Contractor shall provide the course materials to each student as required by the specific curriculum for each course conducted and shall inspect training ranges in advance of scheduled training in order to provide sufficient time for correction of any deficiencies.

The Contractor shall set up all signage, range markers, traffic cones, and other items required by the specific curriculum prior to the start of each course and shall return the items upon course completion. This includes all motorcycle training equipment, safety gear, training sites, and classrooms in which training will be performed.

In locations where there are multiple installations within a geographical area, scheduling may be coordinated on a regional basis. The Safety representative will provide the Contractor with rosters, schedules, and other information necessary to deliver courses authorized under this contract. The roster shall identify each student by name, rank (if applicable), and category. The schedule will be coordinated with the COR with 2 weeks advance notice.

5.3.1 Contractor Liaison – The Contractor shall designate a Contractor Liaison (CL) to coordinate the scheduling of courses with COR.

The COR will consult with the CL during the scheduling of course schedules to minimize conflicts and ensure the availability of required Government and Contractor resources.

5.3.2 Core Working Hours – Courses may be scheduled during Government core working hours of

7:30AM to 5:00PM local time on Tuesday, Wednesday, or Thursdays. Training may be scheduled on weekends or beyond designated core working hours where improved weather conditions or extended daylight hours provide an advantage to the training delivered or due to local availability of personnel, training ranges, or other resources. Overtime is not anticipated and not permitted.

Training is not anticipated on Federal holidays, which include New Year’s Day, Martin Luther King Jr.’s Birthday, President’s Day, Memorial Day, Veteran’s Day, Independence Day, Labor Day, Columbus Day, Thanksgiving Day, and Christmas Day; however, consistent with Section 2.0, training may be scheduled to coincide with larger promotional programs (e.g. Semper Ride or Semper Drive).

In such cases, task orders will be written for delivery of a specific number of course units at the designated event location and date, but registration may be on-site or on a walk-in basis rather than advance. For event-related training, the COR will provide on-site assistance for registration and student management.

5.3.3 Order Of Precedence – The personnel categories below are listed in order of precedence for seats available and are authorized to register for and take courses under this Contract:

• Active Duty Marine Corps Personnel

• Other Active Duty Military Personnel, Military Reservisits, and National Guard

5.3.4 Class Size and Attendance – The Contractor shall follow the limits regarding class size and student-to-instructor ratios established by the curriculum owner.

The COR is responsible for directing the appropriate number of students to the training location.

Operational demands may result in fewer than the expected number of students reporting for a course.

Upon taking attendance, the Contractor shall immediately report any discrepancies between the roster provided and the students present for the course to the COR to include:

• Names of students on roster that are not present

• Names of students present that are not on the roster

• Whether the numbers present are or are not within the limits per the course, as ordered

• Whether the number of students present are or are not within the limits established by the curriculum owner.

5.4 Record Keeping and Other Documentation – The Contractor shall provide all training records to include student attendance rosters, course evaluations, and written test results for all courses conducted in accordance with the requirements of the specific curriculum used to the COR by 10 days after course completion.

Training records should not contain any Personally Identifiable Information (PII); however, the Contractor must ensure that any PII provided or generated shall be protected. In addition to the regularly submitted reports below, copies of specific student records or aggregated data shall be provided in hard copy or electronic media on request of the COR.

The Contractor shall provide to the COR the final rosters of each course conducted within three (3) calendar days after the conclusion of each course and report the student outcomes as Pass, Fail, Drop/Incomplete, or No Shows.

The Contractor shall provide a report in writing to the COR that details any accidents, mishaps, and/or injuries sustained during training. The Contractor shall follow local incident reporting procedures and will submit the report no later than the following calendar day after the incident.

The Contractor shall provide the COR a monthly cumulative status report as follows:

• The Status Reports shall be developed in Microsoft Excel (2010 version or later) and submitted by the

10th day of the month in electronic format.

• Cumulative data shall be based on the period(s) of performance specified in the resulting award.

• Courses conducted shall be itemized by CLIN and will include the total number of students from each group.

5.5 Insurance – The Contractor shall maintain insurance in accordance with FAR Clause 52.228-5, Insurance – Work on a Government Installation, to include:

• General Liability: bodily injury liability insurance coverage written on the comprehensive form of policy valued at $500,000 per occurrence.

• Automobile Liability: insurance written on the comprehensive form of policy for bodily injury and property damage liability covering the operation of all automobiles operated in the United States and used in connection with performing the contract valued at: $200,000 per person, $500,000 per occurrence for bodily injury; and $20,000 per occurrence for property damage.

All insurance changes shall be submitted to the COR within seven (7) business days after the changes occur.

6.0 Government Provided Information, Services, and Equipment. The Government shall provide the following:

6.1 Classrooms/Auditoriums & Audio-Visual and Peripheral Equipment – The COR will provide the Contractor access to a classroom or auditorium equipped with audio-visual equipment appropriate to the curriculum of each specific course.

6.2 Ranges and Other Training Areas – The Government shall provide the Contractor with access to training ranges, where available, to support scheduled training. The Government is responsible for range upkeep, including surface condition, weed/debris removal, and marking, as well as for obtaining and maintaining range certifications that may be required. The Government shall provide sufficient signage, range markers, traffic cones, and other items required by the specific curriculum, which shall be set up and returned to the Government by the Contractor.

6.3 Personal Protection Equipment (PPE) – Students shall provide their own PPE.

7.0 Information Security

Reference is hereby made to Marine Corps awarded contracts requiring contractor access to Department of Navy information systems, sensitive unclassified information, or areas critical to the operations of the command.

Although these contracts are not classified and contractor employees are not required to have obtained a National Agency Check (NAC) Trustworthiness Determination, the Department of the Navy (DoN) has determined that all DON information systems are sensitive regardless of whether the information is classified or unclassified. The Contractor shall abide by the following security protocols:

7.1 Foreign Nationals – In accordance with NAVSUPINST 5239.1A, if the Contractor employee is a Foreign

National, prior approval of the Network Security Officer (NSO) is required. Access may be granted to Foreign Nationals who have a need to know and at least one (1) of the following applies:

7.2.1 Foreign National is employed by DOD, or

7.2.2 Foreign National possesses a current Functional Accreditation approved by the Navy International

Program Office (NAVIPO), or

7.2.3 Foreign National possesses a current Visit Request Form (OPNAV 5521/27 (1-73) as defined in OPNAVINST 5510.1H), which is on file with the requesting activity.

7.2 Contractor Responsibility – The Contractor shall take all lawful steps available to ensure that information provided or generated pursuant to this arrangement is protected from further disclosure unless the agency provides written consent to such disclosure.

8.0 Physical Security

The Contractor is responsible for ensuring that Contractor personnel performing work under this contract display the appropriate photo-identification badges at all times they are on-duty on any installation or on any Federal property.

Neglect to display the photo-identification badge may result in an unsuitability determination and a security escort off the installation. Upon Contractor personnel termination, resignation, or the end of the contract life, the

Contractor is responsible for returning all Government identification, Common Access Cards, building passes, keys, and other Government property that was issued to the Contractor.

The requirements herein are applicable to all subcontractors affiliated under this Contract.

9.0 Travel Requirements

All travel costs for contractor personnel are to be borne by the contractor. All participating Government personnel from off of MCB Camp Pendleton will be issued travel orders by their units.

10.0 Non-Personal Services Statement

Contractor employees performing services under this contract will be controlled, directed, and supervised at all times by Contractor management personnel. Contractor management shall ensure all employees comply with the performance work standards outlined in this PWS. Contractor employees shall perform their duties independent of, and without the supervision of, any Government official or other Defense Contractor. The tasks, duties, and responsibilities set forth in this PWS shall not be interpreted or implemented in any manner that results in any Contractor employee creating or modifying federal policy, obligating the appropriated funds of the United States Government, overseeing the work of federal employees, providing direct personal services to any federal employee, or otherwise violating the prohibitions set forth in Subparts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will grant contractor access to the facilities and will perform the inspection and acceptance of the completed work.

11.0 Quality Surveillance and Performance Standards

The Government will conduct quality surveillance in accordance with the Performance Requirements Summary (PRS) in Section 12.0 below. Contractor performance will be measured against the specific standards and metrics identified in the PRS. The Marine Corps will establish respective Quality Assurance Surveillance Plans to track timeliness of training delivered and identify training backlogs. The PRS will establish standards for evaluating the reports required under Section 5 of this PWS.

13.0 Type of Contract

The Government contemplates award of a Firm Fixed Price contract resulting from this solicitation.

14.0 Contracting Officer’s Representative (COR)

The COR will represent the Contracting Officer in the administration of technical details within the scope of this contract and will perform inspection and acceptance of all deliverables. The COR is not otherwise authorized to make any representations or commitments of any kind on behalf of the Contracting Officer or the Government. The COR does not have the authority to alter the Contractor's obligations or change the specifications in the contract or issue Task Orders. If, as a result of technical discussions, it is desirable to alter contract obligations or statements of work, a modification must be issued in writing and signed by the Contracting Officer. The COR is responsible for reviewing the invoices submitted by the Contractor and informing the Contracting Officer of areas where exceptions are to be taken. The COR authority is non-delegable. The COR may be personally liable for unauthorized acts.

15.0 Authorized Changes Only By The Contracting Officer

Except as specified in paragraph (b) below, no order, statement, or conduct of Government personnel who visit the Contractor’s facilities or in any other manner communicates with Contractor personnel during the performance of this contract shall constitute a change under the Changes clause of this contract.

a. The Contractor shall not comply with any order, direction, or request of Government personnel unless it is issued in writing and signed by the Contracting Officer or is pursuant to specific authority otherwise included as a part of this contract.

b. The Contracting Officer is the only person authorized to approve changes in any of the requirements of this contract and notwithstanding provisions contained elsewhere in this contract, said authority remains solely the Contracting Officer’s. In the event the Contractor effects any change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase incurred as a result thereof. 17.0 Enterprise-Wide Contractor Manpower Reporting Application (ECMRA)

The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for traffic safety training via a secure data collection site. Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:

(1) W, Lease/Rental of Equipment;

(2) X, Lease/Rental of Facilities;

(3) Y, Construction of Structures and Facilities;

(4) S, Utilities ONLY;

(5) V, Freight and Shipping ONLY.

The contractor is required to completely fill in all required data fields using the following web address https://doncmra.nmci.navy.mil.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs 01 October through 30 September. While inputs may be reported any time during the FY, all data https://doncmra.nmci.navy.mil/ shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the help desk, linked at https://doncmra.nmci.navy.mil.

18.0 Data, Software And Intellectual Property Rights

18.1 All reports, materials, data, information, and all electronic/digital files and other items described herein, and any other items, (hereinafter referred to individually or collectively as the Work or Works), and all intellectual property rights in or to such Works, in whatever form, created, generated, produced or provided under, or as a result of, this contract/effort shall become the property of the U.S. Government/Marine Corps, i.e., the U.S. Government/Marine Corps shall be the owner of all of these Works and all intellectual property rights in or to these Works. Therefore, any restricted data rights, information, software, materials and/or other items including, the contractor's or a Third-Party's Proprietary data, information, software, materials and/or items must not be used under this contract without the specific written approval by the COR prior to start of any work.

18.2 Use of Works: Except as provided in writing by the COR, no Work (as defined in the Intellectual Property Rights paragraph above) material and/or other item created, generated, produced or provided under, or as a result of, this PWS/Contract/effort shall be used by the Contractor or any of its employees/agents, subcontractors and/or representatives, for any purpose other than for the support and performance of this PWS/Contract/effort. Therefore, the Contractor is obligated to protect the Works from unauthorized use and shall incorporate this paragraph in each of its contracts/subcontracts associated with the goods and/or services provided under this PWS/Contract/effort.
