PERFORMANCE WORK STATEMENT

Heavy Equipment Leasing Performance Work Statement

1.0 Background – This is a Firm Fixed-Price Indefinite Delivery/Indefinite Quantity contract for one base year and four one year option periods to provide short-term off-road heavy construction equipment leasing services for the United States Marine Corps (USMC) Southwest Regional Fleet Transportation (SWRFT) department. These services are required at Marine Corps Base (MCB) Camp Pendleton, California; Marine Corps Air Station (MCAS) Miramar, California; and Marine Corps Recruit Depot (MCRD) San Diego, California.

2.0 Scope – The services set forth in this Performance Work Statement (PWS) will provide SWRFT with the capability to lease heavy construction equipment on a short-term basis when internal capacity cannot support the installation’s requirements. This equipment will be utilized by USMC personnel to maintain roads, firebreaks, buildings, ranges, landfill, and other extraneous locations when the need for such equipment exceeds the internal capacity available. This contract is for the temporary lease of the listed vehicles without operators. The Government’s obligation under this contract applies only to the lease of heavy construction equipment, and the Government is not precluded from the use of Government owned equipment. The period of each individual lease shall be on a weekly or monthly basis, but no longer than 180 days. The contractor shall provide all of the parts and labor necessary to maintain the Contractor’s equipment in a serviceable and operational condition in accordance with the manufacturer’s service requirements and current industry standards, except for daily/weekly operator maintenance, excluding parts. All parts, supplies, labor, and transportation required to properly service the Contractor’s leased equipment, to include inspections, minor/major repairs, and preventative/remedial maintenance on the Contractor’s equipment, shall be supplied by the Contractor at no additional cost to the Government.

3.0 General Tasks

3.1 General – The Contractor shall provide the equipment specified in each task order. The Contracting Officer, at their sole discretion, will determine whether equipment is “similar” within the requirement of the Contract Line Item Number (CLIN) to be a model number “or similar” and such determination shall not be the basis for claim or request for equitable adjustment. The Government will not pay transportation costs if equipment is rejected because it is not the item ordered, or it is not in proper working condition upon delivery.

3.1.1 The Contractor shall deliver the equipment to the Government worksite on or before the requested date, or shall have five (5) working days after receipt of an immediate delivery task order to deliver the equipment to the Government worksite.

3.1.2 The fuel tank for each piece of equipment shall be full upon delivery and will be filled prior to the return by the Government.

3.1.3 The responsibility for lease payment shall be determined in accordance with the clause at Federal Acquisition Regulations (FAR) 52.208-4 for all equipment subject to this contract. Lease prices shall be quoted on a monthly basis, and any delivery order that contains a fraction of a month shall be prorated at 1/30 the monthly price per day. Adjustment to lease payments will not be made unless the equipment is unavailable or unusable for 24 hours or longer.

3.1.4 All delivery orders will be for a minimum of one week (seven calendar days), and a maximum of no more than 180 days. A monthly lease is defined as thirty calendar days, and all periods of performance will utilize a prorated price based on the quoted monthly rate.

In the event that an attachment, accessory, or ancillary piece of equipment is needed to complete a project, the Contracting Officer will determine whether the over and above equipment falls within the scope of the contract. Once that determination has been made, the Contractor will provide a quote for the equipment needed. The Contracting Officer will determine whether the price is fair and reasonable prior to awarding a delivery order containing over and above equipment.

3.4 Maintenance: Except for daily/weekly operator checks and services, the Contractor shall provide all labor and parts necessary to maintain the Contractor’s equipment in a satisfactory condition in accordance with the manufacturer’s published specifications and current industry standards. 3.4.2 The Contractor shall perform all repairs to the equipment leased under this contract. In the event that a repair is needed during a delivery order’s period of performance, the contracting officer shall determine whether the equipment will be repaired or whether the equipment will be replaced. If the equipment is to be replaced, the contractor shall bear all costs associated with replacing the equipment. The contractor shall have twenty-four (24) hours to replace the removed piece of equipment with a substitute piece of equipment.

3.4.4 If the Government requires a replacement piece of equipment due to multiple remedial repairs, the contractor shall have twenty-four (24) hours from the time the equipment replacement determination is made to replace that piece of equipment with one of equal capabilities. The contractor shall bear all costs associated with replacing or “swapping out” pieces of equipment.

3.4.5 After performing maintenance, the Contractor’s clean-up process shall be accomplished in accordance with applicable Federal, State, and local laws and regulations, to include applicable installation regulations. The Contractor shall also clean the immediate work area and remove all debris generated by the Contractor in performance of these maintenance services. CLAUSES INCORPORATED BY FULL TEXT

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2016)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision. Additional copies will be issued for a fee.

(2) Most unclassified Defense specifications and standards may be downloaded from the following ASSIST websites:

(i) ASSIST (https://assist.dla.mil/online/start/).

(ii) Quick Search (http://quicksearch.dla.mil/).

(iii) ASSISTdocs.com (http://assistdocs.com).

(3) Documents not available from ASSIST may be ordered from the Department of Defense Single Stock Point (DoDSSP) by--

(i) Using the ASSIST Shopping Wizard (https://assist.dla.mil/wizard/index.cfm);

(ii) Phoning the DoDSSP Customer Service Desk (215) 697-2179, Mon-Fri, 0730 to 1600 EST; or

(iii) Ordering from DoDSSP, Building 4, Section D, 700 Robbins Avenue, Philadelphia, PA 19111-5094, Telephone (215) 697-2667/2179, Facsimile (215) 697-1462.

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.

(j) Unique entity identifier. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database.) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.

(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(4) A summary of the rationale for award;

(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.

(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

ADDENDUM

INSTRUCTIONS TO OFFERORS

1. This is a request for quotation. Responses to this solicitation are considered quotations and not offers. In the instances where the words offer, offeror, and proposal are used, the reader should understand that the use of such words does not change the nature of this request for quotation. This Request for Quote will result in a Firm-Fixed Price Indefinite Delivery/Indefinite Quantity (IDIQ) contract to provide heavy equipment leasing services in accordance with the Performance Work Statement at Marine Corps Base (MCB) Camp Pendleton, CA.; Marine Corps Air Station (MCAS) Miramar, CA.; and Marine Corps Recruit Depot (MCRD) San Diego, CA.

2. In accordance with FAR 52.212-1(f), quotes are due at the time designated in block 8 of the SF 1449. Electronic submission of quotes is encouraged. In accordance with FAR 4.302(b), if electronic submission is not used, offerors shall use at least 30 percent postconsumer fiber paper and print or copy double-sided (or include an explanation concerning why it is not possible to print or copy double-sided). Do not attempt to send the proposal via the US Postal Service (USPS) since the US Postal Service does not deliver to the building.

Proposals may be submitted as follows:

ELECTRONIC MAIL (EMAIL):

roger.lonoza@usmc.mil

HAND DELIVERY:

USMC Regional Contracting Office Attn: Roger Lonoza Bldg. 22180 Camp Pendleton, CA 92055

UPS/FEDEX MAIL:

FAXED PROPOSALS WILL NOT BE ACCEPTED

For proposals delivered by hand, offerors are advised that entry to the installation is restricted, and offerors are directed to familiarize themselves with the entry control location and process. Entry processing time is unpredictable and can be lengthy. The addressee indicated above may be able to facilitate entry processing, but is not required to do so, and inability to gain access shall not excuse late delivery.

Proposals shall be submitted using a page size of 8.5 x 11 inches. Pages may be single-spaced but shall have at least double spacing between paragraphs. Times New Roman, 12 point font shall be used except for figures, tables, and diagrams where smaller is acceptable as long as it is readable.

If proposals are submitted in different formats requiring different delivery methods, the proposal of record shall be the last complete version received prior to the deadline.

For email proposals, the Government office designated for receipt of the proposal is the email inbox of the addressee indicated above. Notwithstanding the provisions at FAR 52.212-1(f) or FAR 52.215-1(c)(3), delivery is not accomplished until the addressee can open the email; delivery to a server or an email inbox on a server is not considered delivery to the designated Government office and the quotation is not under the Government’s control until the addressee can open the email. The email shall not be considered to be delivered unless the entire content of the email and all attachments can be read by the addressee indicated above. Receipt of an electronic acknowledgment from the addressee establishes that a record was received but does not establish that the content sent corresponds to the content received. Email attachments are limited to no more than 2MB. Offerors are specifically warned that email may be subjected to spam filters or attachment stripping.

All transmissions must clearly state the solicitation number and the name of the contract specialist on the first page to ensure proper receipt.

Attention is directed to FAR 52.212-1(f), concerning late submissions. Offerors are responsible for allowing adequate time for transmission to be completed. The offeror bears the risk of non-receipt of transmissions, and should ensure that all pages of the proposal (and any authorized modifications) have been received by the designated office before the deadline indicated. Pages of a transmission that arrive after the deadline will not be considered.

The Government may make award based solely on the proposal received.

4. Period of Acceptance of Offers: The pricing terms and conditions of the quote shall be valid for 90 days unless stated otherwise in the quote.
