PERFORMANCE WORK STATEMENT
Heavy Equipment Leasing Performance Work Statement
1.0 Background – This is a Firm Fixed-Price Indefinite Delivery/Indefinite Quantity contract for one base year and four one year option periods to provide short-term off-road heavy construction equipment leasing services for the United States Marine Corps (USMC) Southwest Regional Fleet Transportation (SWRFT) department. These services are required at Marine Corps Base (MCB) Camp Pendleton, California; Marine Corps Air Station (MCAS) Miramar, California; and Marine Corps Recruit Depot (MCRD) San Diego, California.
2.0 Scope – The services set forth in this Performance Work Statement (PWS) will provide SWRFT with the capability to lease heavy construction equipment on a short-term basis when internal capacity cannot support the installation’s requirements. This equipment will be utilized by USMC personnel to maintain roads, firebreaks, buildings, ranges, landfill, and other extraneous locations when the need for such equipment exceeds the internal capacity available. This contract is for the temporary lease of the listed vehicles without operators. The Government’s obligation under this contract applies only to the lease of heavy construction equipment, and the Government is not precluded from the use of Government owned equipment. The period of each individual lease shall be on a weekly or monthly basis, but no longer than 180 days. The contractor shall provide all of the parts and labor necessary to maintain the Contractor’s equipment in a serviceable and operational condition in accordance with the manufacturer’s service requirements and current industry standards, except for daily/weekly operator maintenance, excluding parts. All parts, supplies, labor, and transportation required to properly service the Contractor’s leased equipment, to include inspections, minor/major repairs, and preventative/remedial maintenance on the Contractor’s equipment, shall be supplied by the Contractor at no additional cost to the Government.

3.1 General – The Contractor shall provide the equipment specified in each task order. The Contracting Officer, at their sole discretion, will determine whether equipment is “similar” within the requirement of the Contract Line Item Number (CLIN) to be a model number “or similar” and such determination shall not be the basis for claim or request for equitable adjustment. The Government will not pay transportation costs if equipment is rejected because it is not the item ordered, or it is not in proper working condition upon delivery.
3.1.1 The Contractor shall deliver the equipment to the Government worksite on or before the requested date, or shall have five (5) working days after receipt of an immediate delivery task order to deliver the equipment to the Government worksite.
3.1.2 The fuel tank for each piece of equipment shall be full upon delivery and will be filled prior to the return by the Government.
3.1.3 The responsibility for lease payment shall be determined in accordance with the clause at Federal Acquisition Regulations (FAR) 52.208-4 for all equipment subject to this contract.
